IN ACCORDANCE WITH ARTICLE 6252-17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS OF THE 61 ST LEGISLATURE, REGULAR SESSION, THE BOARD OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 29TH DAY OF OCTOBER, 1993, AT 5:00 P.M. if STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met in regular session, Monday evening November 1, 1993, at 6:00 P.M. in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Patti Bass Vice -Chairman Randy Howell Secretary Chris Coy Member Carl Hecht Ist Alternate with members Jeff Wood and Ery Meyer absent, constituting a quorum. Also present was City Council Representative, Gil Traverse, and the following City Staff: Greg Wheeler Marcy Ratcliff Teresa Wallace CALL TO ORDER Building Official Planner Planning Secretary Chairman, Charles Giffin, called the meeting to order at approximately 6:05 p.m. NEW BUSINESS The first item of new business was for the Board of Zoning Adjustment to consider BZA93-33, submitted by Philip & Susan Stonecipher, who are requesting a variance for their property located at 1801 Rolling Ridge Drive, Lot 13, Block 10, Shadow Glen Addition, Phase II B. The variance requested is to Grapevine Comprehensive Zoning Ordinance 82-73, Section 42.G.7., Supplementary District Regulations, which requires a triangle of visibility on corner lots. The applicant is asking for a variance to allow a wrought iron fence to encroach the triangle of visibility as shown on Exhibit A, allowing a forty (40") inch fence to be erected along the front and side property line only as shown on the plot plan. Greg Wheeler explained that Philip & Susan Stonecipher are proposing to erect a wrought iron fence, with an 85% see through visibility, encroaching the required triangle of visibility. The builder installed the existing retaining wall raising the height of the yard at the northeast corner of the front and side yards. The applicants are concerned they are at risk from their child, or other neighborhood children, failing and seriously injuring themselves. Susan Stonecipher, applicant of 1801 Rolling Ridge Drive, Grapevine, Texas, took the Oath of Truth and explained that she and her husband bought the house with the retaining wall in place. She further explained she had spoken to her neighbors regarding the danger involved and had received no negative responses after explaining their position. Greg Wheeler stated one letter of objection was received. With no one else to speak either for or against the request, Chris Coy made a motion to close the public hearing. Patty Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Hecht, Coy Nays: None Absent: Meyer, Wood Chris Coy made a motion that a special condition did exist to Section 42.G.7., Supplementary District Regulations, and the special condition being the retaining wall was in place when Mr. & Mrs. Stonecipher purchased the property, and is no fault of the property owners. Patty Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Hecht, Coy Nays: None Absent: Meyer, Wood Chris Coy made a motion to approve the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 42.G.7., Supplementary District Regulations, to allow a forty (40") inch high fence to encroach the required triangle of visibility as shown on Exhibit A, allowing an encroachment that does not interfere with the triangle of visibility. Patty Bass seconded the motion which prevailed by the following vote: N Ayes: Giffin, Bass,- Howell, Hecht, Coy Nays: None Absent: Meyer, Wood. The next item of new business was for the Board of Zoning Adjustment to consider BZA93-34, submitted by Robert & Shirley Norman. Mr. & Mrs. Norman are requesting a special exception to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3., Nonconforming Uses and Structures Regulations, which requires action by the Board of Zoning Adjustment for remodeling, enlarging, or expanding a nonconforming use. The applicant is requesting a special exception to allow a three car garage to be built as shown on the plot plan. The property is located at 2311 Lonesome Dove Road, being a part of the L. Lincoln Survey, Abstract No. 981, Tarrant County, Texas. Greg Wheeler explained the special condition for the request is Mr. & Mrs Norman's property is to be annexed into the City of Grapevine on Tuesday evening, November 2, 1993. The property owners in the northwest quadrant were notified that any development on their property would require a building permit. All of the property in the northwest Grapevine annexation area will become "R-20" Single Family Residential zoning. Mrs. Norman operates a beauty shop, licensed by the State of Texas, on the property which places their property into nonconformity as a commercial/residential use with zoning district regulations. Building permits may not be issued by the Building Official on nonconforming properties. Shirley Norman, applicant of 2311 Lonesome Dove Road, Grapevine, Texas, took the Oath of Truth. Mrs. Norman explained their property was developed without any zoning district regulations because it was in the county. She further explained when they received notice from the City of Grapevine their property was proposed to be annexed into the City, she and her husband spoke to staff regarding the garage they were in the process of building to inquire about any permits or inspections that would be required. She was told she must file for a special exception to allow her beauty shop a legal nonconforming status to remain as a commercial/residential use in a single family district. With no one else to speak either for or against the request, Randy Howell made a motion to close the public hearing. Carl Hecht seconded the motion which prevailed by the following vote: 3 Ayes: Giffin, Bass, Howell, Hecht, Coy Nays: None Absent: Meyer, Wood' Carl Hecht made a motion that a . specialcondition did exist for the special exception to Section 43.E.3., Nonconforming Use I s and Structures, and the special condition being that Mrs. Norman operates a beauty shop on residential property and was not previously regulated by any zoning ordinance. Patty Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Hecht, Coy Nays: None Absent: Meyer, Wood Carl Hecht then made a motion to grant the special exception to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3., Nonconforming Uses and Structures District Regulations, to allow the addition of a three car garage as shown on the plot plan, allowing the expansion of a nonconforming use. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Hecht, Coy Nays: None Absent: Meyer, Wood MINUTES Next the Board of Zoning Adjustment considered the minutes of the August 2, 1993, meeting. Patty Bass made a motion to approve the minutes of the August 2, 1993, meeting as amended. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy, Hecht, Nays: None Absent: Meyer, Wood IM MISCELLANEOUS REPORTS AND DISCUSSION Marcy Ratcliff, City Planner, discussed issues involving upcoming cases for December 6, 1993.
