IN ACCORDANCE WITH ARTICLE 6252-17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS OF THE 61 ST LEGISLATURE, REGULAR SESSION, THE BOARD OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 12TH DAY OF NOVEMBER, 1993, AT 5:00 P.M. •lei t• i -' •- STATE OF TEXAS COUNTY OFTARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met in emergency session, Monday evening November 15, 1993, at 6:00 P.M. in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Patti Bass Vice -Chairman Randy Howell Secretary Ery Meyer Member Chris Coy Member Carl Hecht Ist Alternate Jeff Wood 2nd Alternate constituting a quorum. Also present was City Council Representative, Gil Traverse, and the following City Staff: Greg Wheeler Building Official Teresa Wallace Planning Secretary CALL TO ORDER Chairman, Charles Giffin, called the meeting to order at approximately 6:00 P.M. NEW BUSINESS The first item of new business was for the Board of Zoning Adjustment to consider BZA93-38, submitted by Bob Burrus, who is requesting a special exception for property located at 912 West Northwest Highway, Legally described by metes and bounds survey. The special exception requested is to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3., Nonconforming Uses and Structures Regulations, which requires approval of the Board of Zoning Adjustments to allow an existing nonconforming development to remain as built. The applicant is asking for a special exception to allow the current development to exist as developed as shown on the plot plan. 1 Greg Wheeler explained that Mr. Bob Burrus is seeking a special exception to allow Burrus Super Market to exist as currently developed. The development was conforming when it was developed under' Zoning Ordinance 70-10, but does not conform to the current Zoning Ordinance 82-73. If approved the special exception will allow Burrus Super Market to pursue a Conditional Use Permit to sell beer and wine only for off -premise consumption. Bob Burrus took the Oath of Truth and explained to the Board he felt that in order to compete with the other grocers in the city he needed to be able to sell beer and wine for off -premise consumption. A Conditional Use Request requires the subject property be a conforming property to the current Zoning Ordinance 82-73, therefore he was requesting a special exception for the development to exist as is. Greg Wheeler stated there were no letters of objection received. With no one else to speak either for or against the request, Patti Bass made a motion to close the public hearing. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Patti Bass made a motion that a special condition did exist to Section 43.E.3., Nonconforming Uses and Structures Regulations, and the special condition being the current owners developed the existing property as currently shown on the plot plan under Zoning Ordinance 70-10. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Patti Bass made a motion to approve the special exception to Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3., Nonconforming Uses and Structures Regulations, to allow the development to be conforming as currently shown on the plot plan. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None !9 With no further discussion, Chris Coy made a motion to adjourn. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy, Nays: None The meeting was adjourned at approximately 6:10 P.M.
