COMMUNITY DEVIELOPMENT DIRECTOR STATE OF TEXAS COUNTY OFTARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met on Monday evening January 3, 1994, at 6:00 P.M. in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Patti Bass Vice -Chairman Randy Howell Secretary Ery Meyer Member Chris Coy Member Carl Hecht Ist Alternate Jeff Wood 2nd Alternate constituting a quorum. Also present was City Council Representative, Gil Traverse, and the following City Staff: Marcy Ratcliff Planner Teresa Wallace Planning Secretary CALL TO ORDER Chairman, Charles Giffin, called the meeting to order at approximately 6:00 P.M. NEW BUSINESS BZA93-41 - METROCEL CELLULAR TELEPHONE The first item of new business was for the Board of Zoning Adjustment to consider BZA93-41, submitted by Metrocel Cellular Telephone, who is requesting five (5) variances for property located at 3428 Anderson -Gibson Road, proposed for replat of Lot 1, Block 1, Cross Creek Ranch Addition. The following variance requests are to the Grapevine Comprehensive Zoning Ordinance 82-73: Section 37.A.1., Planned Industrial Development, under the standard development option requires a minimum lot size of three (3) acres. 9 The variance request is to allow a 2.662 acre variance to the minimum required three (3) acre lot as shown on the plot plan. If approved, it would allow a 0.338 acre lot. Section 31.G.1. Light Industrial District, which requires a minimum lot width of 100 feet. The variance request is to allow a forty (40) foot variance to the minimum required one hundred (100) foot width of lot as shown on the plot plan. If approved, it would allow a sixty (60) foot width of lot. Section 31.G.4. Light Industrial District, which requires a minimum 15 foot side yard setback. The variance request is to allow the west side of the building an eleven (11) foot variance to the minimum required fifteen (15) foot side yard setback as shown on the plot plan. If approved, it would allow a four (4) foot west side yard setback. Section 31.G.5. Light Industrial District which requires a minimum 30 foot rear yard setback. The requests are to allow a fifteen (15) foot variance for the building and a twenty one (21) foot variance for the tower to the minimum thirty (30) foot rear yard setback as shown on the plot plan. If approved, it would allow a fifteen (15) foot rear yard setback for the building and a nine (9) foot rear yard setback for the tower. Marcy Ratcliff explained that Metrocel Cellular Telephone is back before the Board of Zoning Adjustment to request variances for the development previously approved on October 4, 1993 (BZA93-30) due to a survey error placing the building on the property line which changed the lot configuration requiring a replat of the property. Don Peebles, of Peebles & Associates, took the Oath of Truth and explained an error in calculations placed the building and tower in the wrong location on the lot. He stated the lot size would remain the same size but would be greater in width than depth. Mr. Peebles stated additional property could not be leased from the property owner and a replat of the property was necessary to meet the ordinance requirements. With no one to speak to the request, any letters or petitions, Chris Coy moved to close the public hearing. Patti Bass seconded the motion with the prevailing vote as follows: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None 0,41 -- Ery Meyer moved that a special condition did exist to Section 37.A.1., Planned Industrial Development District Regulations; Section 31.G.1., Section 31.G.4. and Section 31.G.5., Light Industrial Districts, and the special condition being the applicants could not obtain additional property to meet the requirements of the Grapevine Comprehensive Zoning Ordinance 82-73. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Ery Meyer moved to approve the requests to Grapevine Comprehensive Zoning Ordinance 82-73, Section 37.A.1., Planned Industrial Development to grant a 2.662 acre variance to the required three (3) acre minimum lot size to allow a 0.338 acre lot; Section 31.G.1., Light Industrial District to grant a forty (40) foot variance to the required one hundred (100) foot width of lot to allow a sixty (60) foot width of lot; Section 31.G.4., Light Industrial District to grant a eleven (11) foot variance to the required minimum fifteen foot side yard setback to allow a four (4) foot side yard setback; Section 31.G.5., Light Industrial District to grant a fifteen (15) foot variance for the building and a twenty one (21) foot variance for the tower to the required minimum thirty (30) foot rear yard setback as shown on the plot plan with a requirement that future platting of the property would include the development to form one lot. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None BZA93-42 - IMAGE CUSTOM HOMES Next for the Board of Adjustment to consider was BZA93-42 submitted by Rick Kinnison representing Image Custom Homes for Lot 75, Block 1, Countryside Estates Addition and addressed as 4250 Hearthside Drive requesting a six (6) foot variance to encroach the twenty five (25) foot rear yard setback for a proposed house as shown on the plot plan. If approved it would allow a nineteen (19) foot rear yard setback. Marcy Ratcliff, City Planner, stated that after review of the application staff could find no special condition for the request because there was ample room on the lot to move the proposed house to meet the Ordinance requirements. Rick Kinnison and John Margentis, representing Image Custom Homes, were present to address the request. They stated the topography of the pie shaped lot was creating the need to move the proposed house into the rear yard, encroaching the required rear yard setback. They also stated the plans for the proposed house were drawn specifically for the home buyer and attempts had been made to fit the house 3 on the unusual shaped lot. With no other guests to speak to the request and one letter of approval, Patti Bass made a motion to close the public hearing. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None During discussion of the variance request board members determined the proposed house could either be decreased in size or moved toward the east side yard property line to make it fit the topography of the lot. Patti Bass moved, with a second by Chris Coy, that a special condition did not exist which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None BZA93-43 - DEONNA LOVING Next for the Board of Adjustment to consider was BZA93-43 submitted by Deonna Loving for Lot 7, Block 1, Grapevine Lake Estates Addition and addressed as 3619 Oakwood Drive requesting variances to Section 15.G.1., R-7.5 Single Family District regulations which requires a thirty (30) foot front yard setback on reverse frontage lots to allow a ten (10) foot encroachment allowing a twenty (20) foot front yard setback and Section 15.G.2. Single Family District regulations which requires a twenty five (25) foot rear yard setback to allow a fifteen (15) foot variance to encroach the required rear yard to allow a ten (10) foot rear yard setback as shown on the plot plan. Marcy Ratcliff, City Planner, stated that Deonna Loving was purchasing the property from Karen Palmer and was proposing to demolish the existing structure to build a new house on the lot which had already received variances granted under BZA88-26 on December 8, 1988, which allowed a fifteen (15) foot variance on the east front yard along Oakwood Drive and a five (5) foot variance on the south front yard along Red Bird Lane. Deonna Loving was not able to be present to address the request. With no other guests to speak to the request and one letter of approval, Chris Coy made a motion with a second by Patti Bass, to close the public hearing. The vote prevailed as follows: 51 Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Chris Coy made a motion that a special condition did exist for both requests and that being the irregular shape ,size, and topography of the lot make the development of a dwelling impractical. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Chris Coy made a motion to grant the variances to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1. to allow a ten (10) foot variance to encroach the thirty (30) foot front yard setback along Red Bird Lane and Section 15.G.2. to allow a fifteen (15) foot variance to encroach the twenty five (25) foot rear yard setback as shown on the plot plan. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None BOARD OF ZONING ADJUSTMENT MINUTES - DECEMBER 6 1993 Next for the Board of Adjustment to consider were the minutes of the December 6, 1993 meeting. Chris Coy moved, with a second by Ery Meyer, to approve the minutes of December 6, 1993 as amended. The vote prevailed as follows: Ayes: Giffin, Howell, Meyer, Coy, Hecht Nays: None Abstain: Bass WAUNAMMMI With no further discussion, Chris Coy made a motion to adjourn. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy, Nays: None 5 The meeting was adjourned at approximately 8:15 P.M.
