HomeMy WebLinkAbout1994-05-02STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met on Monday evening, May 2, 1994, at 6:00 P.M. in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Patti Bass Vice Chairman Randy Howell Secretary Ery Meyer Member Chris Coy Member Carl Hecht Ist Alternate Jeff Wood 2nd Alternate constituting a quorum. Also present was City Council Representative, Gil Traverse, and the following City Staff: Greg Wheeler Building Official Marcy Ratcliff Planner Teresa Wallace Planning Secretary Chairman, Charles Giffin, called the meeting to order at approximately 6:05 P.M. NEW BUSINESS BZA94-13 - TIM LANCASTER The first item of new business was for the Board of Zoning Adjustment to consider BZA94-13, submitted by Tim Lancaster, who is requesting a variance for side buffer yard requirements for the property located at 1813 and 1815 West Wall Street, legally described as Lot 1, Block 5, Ridgecrest Addition, Grapevine, Texas. Greg Wheeler, Building Official, explain3d the applicant is requesting the Board of Zoning Adjustment table request BZA93-13 to allow a revision of the application to increase the variance to the side buffer yard requirement. Mr. Wheeler noted any change in the request would require notice to be placed in the newspaper and notification of surrounding property owners. 1 5/2/94 Chris Coy, with a second by Patti Bass, moved to table variance request BZA94-13 to June 6, 1994, which prevailed by the following vote. Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Next for the Board of Adjustment to consider was BZA94-14 submitted by Tim Lancaster representing Drs. E. L. and M. L. Lancaster requesting variances to the Grapevine Comprehensive Zoning Ordinance 82-73 for 1812, 1814, 1816, and 1818 Evergreen court, being legally described as Lots 8 & 9, Block 5, Ridgecrest Addition, Grapevine, Texas. Greg Wheeler, Building Official, explained that Mr. Tim Lancaster is proposing to rezone Lot 9, Block 5, Ridgecrest Addition, from "R-3.75" Three and Four Family District to "R-3.5" Two Family District. The property is adjacent to "PO" Professional Office and requires a forty foot buffer yard between residential and commercial zoning districts. Mr. Tim Lancaster's property was platted prior to the amendment of the Grapevine Comprehensive Zoning Ordinance No. 82-73, which introduced buffer yard requirements, Section 18. H., "R-3.75" Three and Four Family District Regulations. The following requests are to the Grapevine Comprehensive Zoning Ordinance 82-73: Section 17.H. "R-3.5" Two Family District Regulations which requires a forty (40) foot buffer yard between residential and commercial districts. Section 18.H., "R-3.75" Three and Four Family District Regulations which requires a forty (40) foot buffer yard between residential and commercial districts. The request is for Lots 8 and 9 to Section 18.H. "R-3.75" Three and Four Family District Regulations to allow a fifteen (15) foot variance to encroach the forty (40) foot rear buffer yard as shown on the plot plan . If approved, it would allow a twenty five (25) foot rear yard setback. An additional request for Lot 9, if a zone change request is approved is to Section 17.H., "R-3.5", Two Family District Regulations to allow a fifteen (15) foot variance to encroach the forty (40) foot rear buffer yard as shown on the plot plan. If approved it would allow a twenty five (25) foot rear yard setback. The request is for Lots 8 and 9 to Section 18.H. "R-3.75" Three and Four Family K 5/2/94 District Regulations to allow a fifteen (15) foot variance to encroach the forty (40) foot rear buffer yard as shown on the plot plan . If approved, it would allow a twenty five (25) foot rear yard setback. Tim Lancaster was sworn in to respond to questions from the Board regarding the request. Mr. Lancaster told the Board the property was platted prior to the buffer yard requirement between districts. The additional fifteen foot required makes it impossible to have enough buildable area for his development. With no other guests to speak, one letter in favor of the request, Chris Coy moved to close the public hearing. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Chris Coy moved that a special condition did exist for the requests and that being the property was platted before the amendment to the Grapevine Comprehensive Zoning Ordinance requiring a forty foot buffer yard between residential and commercial zoning districts. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Chris Coy moved, with a second by Patti Bass, to approve the variance requests to the Grapevine Comprehensive Zoning Ordinance 82-73 for 1812, 1814, 1816, and 1818 Evergreen Court, legally described as Lots 8 & 9, Block 5, Ridgecrest Addition, Grapevine, Texas to allow a fifteen (15) foot variance to encroach the forty (40) foot rear buffer yard setback, to allow a twenty five (25) foot rear yard setback as shown on the plot plan with the prevailing vote as follows: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None BZA94-15 - TIM LANCASTER Next for the Board of Adjustment to consider was BZA94-15 submitted by Tim Lancaster representing Drs. E. L. and M. L. Lancaster for property located at 1813, 1815, 1817, 1819, 1820, 1822, 1824, and 1826 Fern Court, legally described as Lots 18 & 19, Block 5, Ridgecrest Addition, Grapevine, Texas. E. L. and M. L. Lancaster for property located at 1801 and 1803 Fern Court, legally described as Lot 22, Block 5, Ridgecrest Addition, Grapevine, Texas. Greg Wheeler, Building Office, explained the variance request is to the Grapevine El 5/2/94 Comprehensive Zoning Ordinance 82-73, Section 17.H., "R-3.5" Two Family District Regulations, which requires a forty (40) foot buffer yard between residential and commercial districts. The request is to Section 17.H. to allow a fifteen (15) foot variance to the required forty (40) foot rear buffer yard requirement as shown on the plot plan. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None :1 :11 0 Next for the Board of Adjustment to consider were the minutes of the April 4, 1994 meeting. Ery Meyer moved, with a second by Patti Bass, to approve the minutes of April 4, 1994. The vote prevailed as follows: A 5/2/94 Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None MISCELLANEOUS DISCUSSION Marcy Ratcliff, City Planner, presented a report of gross revenue generated from the restaurants having on premise alcoholic beverage sales requested by Gil Traverse, City Councilman at the March 7, 1994 meeting. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None The meeting was adjourned at approximately 6:30 P.M. 0
