HomeMy WebLinkAbout1994-06-06--- STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met on Monday evening, June 6, 1994, at 6:00 P.M. in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Randy Howell Secretary Ery Meyer Member Chris Coy Member constituting a quorum. Also present was City Council Representative, Gil Traverse, and the following City Staff: Greg Wheeler Marcy Ratcliff Teresa Wallace -R - Building Official Planner Planning Secretary Chairman, Charles Giffin, called the meeting to order at approximately 6:10 P.M. NEW BUSINESS BZA94-13 - TIM LANCASTER The first item of new business was for the Board of Zoning Adjustment to consider BZA94-13, submitted by Tim Lancaster, who is requesting a variance for side buffer yard requirements for the property located at 1813 and 1815 West Wall Street, legally described as Lot 1, Block 5, Ridgecrest Addition, Grapevine, Texas. Greg Wheeler, Building Official, explained the applicant is requesting a variance to allow a thirty four (34) foot encroachment to Section 17.H. Two Family District Regulations which requires a forty (40) foot side yard buffer separation when abutting a nonresidential district. Mr. Wheeler explained the subdivision had been platted in 1984 prior to the forty (40) foot buffer yard now required by the current zoning ordinance. One letter of approval was received relative to the case. BZA Minutes 6/6/94 Chris Coy moved, with a second by Ery Meyer, to close the public hearing, which prevailed by the following vote. Ayes: Giffin, Howell, Meyer, Coy Nays: None Chris Coy moved that a special condition did exist and that being the subdivision was platted by the current owners in 1984 prior to the current requirement of a forty (40) foot buffer yard when abutting nonresidential districts. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: None Chris Coy moved to approve the variance to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 17.H., to allow a thirty four (34) foot encroachment to the forty (40) foot buffer side yard requirement allowing a six (6) foot buffer side yard setback for 1813 and 1815 West Wall Street, Lot 1, Block 5, Ridgecrest Addition. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: None BZA94-16 - NORMAN WEST Next for the Board of Adjustment to consider was BZA94-16 submitted by Norman West requesting a variance to the Grapevine Comprehensive Zoning Ordinance 82-73 for 521 Dunn Court, being legally described as Lot 6, Block 1, Lakeside Estates Addition, Grapevine, Texas. Greg Wheeler, Building Official, explained that Mr. Norman West was requesting a variance to allow the existing house a four (4) foot encroachment into the required thirty (30) foot front yard setback to allow a twenty six foot front yard setback as shown on the plot plan. The encroachment of the principal structure was apparent on the closing survey of the property at the time of purchase. The encroachment is not the fault of the owner. This dwelling was built prior to the City's required setback inspection. Mr. West was not present to address his request. Mr. Roger Riekenberg of 506 Dunn Court spoke in favor of the request. 0 BZA Minutes 6/6/94 With no further comments, Ery Meyer moved to close the public hearing. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: None Randy Howell moved that a special condition did exist and that being the encroachment was not the fault of the owner as the dwelling was built prior to the City's required setback inspection. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: None Randy Howell moved to approve the request to allow a variance to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1., to allow the existing house a four (4) foot encroachment into the required thirty (30) foot front yard setback allowing a twenty six (26) foot front yard setback as shown on the plot plan addressed as 521 Dunn Court, legally described as Lot 6, Block 1, Lakeside Estates Addition. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: None BZA94-18 - TOM & SHERYL KACOR Next for the Board of Adjustment to consider was BZA94-18 submitted by Tom & Sheryl Kacor for property located at 2932 Creekwood Drive South, legally described as Lot 32, Block 1, Creekwood Estates Addition, Grapevine, Texas. Greg Wheeler, Building Official, explained the variance request is to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1, Single Family District Regulations, which requires a thirty (30) foot front yard setback. The request is to Section 15.G.1. to allow a four (4) foot variance to the required thirty (30) foot front yard setback as shown on the plot plan. If approved, it would allow a twenty six (26) foot front yard setback. With no guests to speak Chris Coy moved, with a second by Randy Howell, to close the public hearing. The vote was as follows: 3 BZA Minutes 6/6/94 Ayes: Giffin, Howell, Meyer, Coy Nays: None Chris Coy moved that a special condition did exist and that being the property was purchased with the existing house encroaching the front yard setback. The dwelling was built prior to the city's required setback inspection and therfore was not the fault of the owner. Section 15.G.1. which requires a thirty (30) foot front yard setback. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: None Chris Coy moved, with a second by Ery Meyer, to approve the request for a variance to the Grapevine Comprehensive Zoning Ordinance 82-73 for 2932 Creekwood Drive South, legally described as Lot 32, Block 1, Creekwood Estates Addition, Grapevine, Texas to allow a four (4) foot variance to the required thirty (30) foot front yard setback to allow a twenty six (26) foot front yard setback as shown on the plot plan. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: None BZA94-19 - RICHARD PEMBERTON Next for the Board of Adjustment to consider was BZA94-19 submitted by Richard Pemberton for property located at 1805 Silverside Drive, legally described as Lot 61, Shorecrest Acres Addition, Grapevine, Texas. Greg Wheeler, Building Official, explained the variance requests are to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1 and 15.G.2., Single Family District Regulations, which requires a thirty (30) foot front yard setback and a twenty five (25) foot rear yard setback. The first request is to Section 15.G.1. to allow a proposed house three and one half (3 1/2) foot variance to the required thirty (30) foot front yard setback requirement as shown on the plot plan. If approved, it would allow a twenty six and one half (26 1/2) foot front yard setback. The second request is to Section 15.G.2. to allow a proposed house five (5) foot variance to encroach the twenty five foot rear yard setback as shown on the plot plan . If approved, it would allow a twenty (20) foot rear yard setback. BZA Minutes 6/6/94 Mr. Wheeler explained the subject property was located in an older subdivision that was platted and approved with less than the one hundred (100) foot lot depth as currently required in the "R-7.5" Single Family District of the Grapevine Comprehensive Zoning Ordinance 82-73. The subdivision was designed for development of ranch style homes. Mr. Richard Pemberton was sworn in to address the request. He told the Board he was proposing to build the house to the south end of the lot to preserve a large tree at the rear of the lot. Greg Wheeler reported one letter of support for the request had been received. Ery Meyer moved, with a second by Chris Coy, to close the public hearing. The vote was as follows: Ayes: Giffin, Howell, Meyer, Coy Nays: None Randy Howell moved that a special condition did exist and that being the property was platted prior to the current zoning ordinance which requires a minimum one hundred (100) foot lot depth. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Randy Howell moved, with a second by Chris Coy, to approve the request for a variance to the Grapevine Comprehensive Zoning Ordinance 82-73 for 1805 Silverside Drive, legally described as Lot 61, Shorecrest Acres Addition, Grapevine, Texas, Section 15.G.1. to allow the proposed house a three and one half (3 1/2) foot variance to the required thirty (30) foot front yard setback to allow a twenty six and one half (26 1/2) foot front yard setback and Section 15.G.2. to allow the proposed house a five (5) foot variance to the required twenty five (25) foot rear yard setback to allow a twenty (20) foot rear yard setback as shown on the plot plan. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: None E BZA Minutes 6/6/94 BZA94-20 - GREG & CHRIS MINTEER Next for the Board of Adjustment to consider was BZA94-20 submitted by Greg & Chris Minteer for property located at 510 West Dallas Road, legally described as Lot 1 R, Block 1 R, Lipscomb -Daniel Subdivision, Grapevine, Texas. Greg Wheeler, Building Official, explained the variance requests are to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 31.G.4., Light Industrial District Regulations which requires a minimum fifteen (15) foot side yard setback; Section 53.H.2.a., Perimeter Landscaping Regulations which requires a fifteen (15) foot setback; and 53.H.1.c., Planter Island Regulations which requires a planter island at the end of a row of parking. The first request is to Section 31.G.4. to allow the car wash building a fifteen (15) foot variance to encroach the required fifteen (15) foot side yard setback requirement as shown on the site plan. If approved, it would allow a zero (0) foot side yard setback. The next request is to Section 53.H.2.a. to allow a fifteen (15) foot variance to encroach the fifteen (15) foot perimeter landscaping setback as shown on the site plan. if approved, it would allow a zero (0) foot landscaping setback along the northern property line. The next request is to Section 53.H.2.a. to allow a five (5) foot variance to encroach the fifteen (15) foot perimeter landscaping setback as shown on the site plan. If approved, it would allow a ten (10) foot perimeter landscaping setback along Dallas Road and Ira E. Woods Avenue. The next request is to Section 53.H. 1.c. to allow the elimination of one planter island by the lube center as shown on the site plan. If approved, it would allow the elimination of one planter island only, next to the lube center. Mr. Wheeler explained the applicants were proposing to develop a full service car wash and lube center on a very narrow piece of property with frontage on Ball Street at the corner of West Dallas Road. The property is landlocked on all four sides by three street frontages; Ball Street, West Dallas Road and Ira E. Woods Avenue. The property is bounded on the north by a railroad right-of-way. Greg & Chris Minteer, 5216 Fairmount Drive, were present to address the request. Chris Minteer was sworn in to answer questions regarding the difficulty of the property to develop. 0 [1.101010 a •� Chris Coy moved, with a second by Ery Meyer, to close the public hearing. The vote was as follows: Ayes: Giffin, Howell, Meyer, Coy Nays: None Chris Coy moved that a special condition did exist and that being the property was landlocked and additional land could not be acquired. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: None Chris Coy moved, with a second by Randy Howell, to approve the requests for variances to the Grapevine Comprehensive Zoning Ordinance 82-73 for 510 West Dallas Road, legally described as Lot 1R, Block 1r, Lipscomb -Daniel Subdivision, Grapevine, Texas, Section 31.G.4. to allow a fifteen (15) foot variance to the required fifteen (15) foot side yard setback along the northern property line to allow a zero (0) foot side yard setback; Section 53.H.2.a. to allow a fifteen (15) foot variance to the required fifteen (15) foot perimeter landscaping setback to allow a zero (0) foot perimeter landscaping setback along the northern property line; Section 53.H.2.a. to allow a five (5) foot variance to the required fifteen (15) foot perimeter landscaping setback to allow a ten (10) foot perimeter landscaping setback along Dallas Road and Ira E. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: None MINUTES - MAY 2 1994 Next for the Board of Adjustment to consider were the minutes of the May 2, 1994 meeting. Ery Meyer moved, with a second by Chris Coy, to approve the minutes of May 2, 1994. The vote prevailed as follows: VA BZA Minutes 6/6/94 Ayes: Giffin, Howell, Meyer, Coy Nays: None MISCELLANEOUS DISCUSSION Marcy Ratcliff, City Planner, reported that new board member appointments would be made by the City Council on June 21, 1994. With no further discussion, Chris Coy made a motion to adjourn. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: None The meeting was adjourned at approximately 6:50 P.M.
