MINUTES BOARD OF ZONING ADJUSTMENT TO CONSIDER THE MINUTES OF THE NOVEMBER 7, 1994 MEETING. VI. MISCELLANEOUS REPORTS AND/OR DISCUSSION VII. ACTS OF THE 1993 TEXAS LEGISLATURE, THE BOARD OF ZONING ADJUSTMENT MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 2ND DAY OF DECEMBER, 1994, AT 5:00 P.M. COMMUNITY DEV LOPMENT DIRECTOR STATE OF TEXAS COUNTY OFTARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met on Monday evening, December 5, 1994, at 6:00 P.M. in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chris Coy Ery Meyer Randy Howell Carl Hecht Jeff Wood Jill Davis Chairman Vice -Chairman Secretary Member Member 1 st Alternate 2nd Alternate constituting a quorum. Also present was the following City Staff: Scott Williams Teresa Wallace CALL TO ORDER Building Official Planning Secretary Chairman Charles Giffin called the meeting to order at 6:00 P.M. NEW BUSINESS The first item for the Board of Zoning Adjustment to consider was BZA94-41 submitted by John Louderback who is requesting a variance for 5103 Shadow Glen Drive, Lot 9, Block 12, Shadow Glen Phase IIB. The request is to Grapevine Comprehensive Zoning Ordinance 82-73, Section 42.C.3, Accessory Buildings & Structures which requires a ten (10) foot accessory building setback from the principal structure. The request is to allow a variance of three (3) feet to encroach the required ten foot setback to allow a seven foot accessory building setback from the principal structure as shown on the plot plan. i BZA Minutes 12/5/94 Scott Williams, Building Official, explained Staff could find no special condition for the request. He told board members he had walked the property with the owner and found a large lot with adequate space to locate an accessory structure. Mr. John Louderback of 5103 Shadow Glen Drive, was sworn in to speak to the request. He showed a chart of his back yard illustrating the number of trees and open space available to place an accessory structure. He told board members he was planning on adding a pool to the yard also. He currently has a deck attached to the rear of his home and prefers to place the accessory structure to the side of the house rather than in the rear yard. He contends that by placing the structure more to the rear he will have to remove trees to allow space for the 12 x 20 foot accessory building. With no other guests to speak, Chris Coy moved to close the public hearing. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Coy, Meyer, Howell and Hecht Nays: None During discussions, members concluded a variance would not be required if he could move the building or attach it by common wall to the principal structure. They also discussed the loss of two trees and the slope of the lot if the applicant constructed the 12 x 20 foot accessory structure. Members determined there was no hardship for the request. Ery Meyer moved there was no special condition for the request and the applicant had alternatives for the location of the accessory structure. Carl Hecht seconded the motion which prevailed by the following vote: Ayes: Giffin, Coy, Meyer, Howell and Hecht Nays: None Next for the Board of Adjustment to consider was BZA94-42 submitted by JPB, Inc. who is requesting a variance for 2101 Pritchard Drive, Lot 1, Block 2, Oakwood Meadows Addition. The request is to Grapevine Comprehensive Zoning Ordinance 82- 73, Section 16.H., "R-5.0" Zero Lot Line District which requires a forty (40) foot rear buffer yard setback when adjacent to a nonresidential district. The request is to allow 0 BZA Minutes 12/5/94 a variance of fifteen (15) feet to encroach the required forty (40) foot rear buffer yard setback to allow a twenty five (25) foot rear yard setback as shown on the plot plan. Scott Williams, Building Official, told the board the lot was unusually shallow and it would be difficult to fit a complying structure on the lot. The City of Grapevine required Pritchard Drive to be aligned with an existing median cut in Park Boulevard at time of platting. This requirement reduced the depth of the subject lot and made it irregular in shape and size. Chris Coy moved, with a second by Ery Meyer, to close the public hearing. The motion prevailed by the following vote: Ayes: Giffin, Coy, Meyer, Howell and Hecht Nays: None Chris Coy moved, with a second by Ery Meyer, that a special condition did exist and that being the lot was platted in an irregular shape and size and too shallow to fit a complying structure on the lot. The motion prevailed by the following vote. Ayes: Giffin, Coy, Meyer, Howell and Hecht Nays: None Chris Coy moved, with a second by Ery Meyer, to approve the request for a variance to the Grapevine Comprehensive Zoning Ordinance for 2101 Pritchard Drive, Lot 1, Block 2, Oakwood Meadows Addition, to allow a variance of fifteen (15) foot to the rear buffer yard setback to allow a twenty five (25) foot rear yard setback. The motion prevailed by the following vote. Ayes: Giffin, Coy, Meyer, Howell and Hecht Nays: None MINUTES Next the Board of Zoning Adjustment considered the minutes of the November 7, 1994, meeting. Chris Coy moved to approve the minutes of November 7, 1994. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Coy, Meyer, Howell and Hecht Nays: None 3 BZA Minutes 12/5/94 With no further discussion, Chris Coy made a motion to adjourn.
