A1i -• • ' ! ! • ! • • 1 1 • f 1 -ha :J►T1I:VII��:T�IC•3' STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday evening, August 4, 2003, at 6:00 P.M. in the Planning and Zoning Conference Room, 2nd Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the following members present to wit: Dennis Luers Vice -Chairman Kip Bruner Member Jim Kelso Member Debbie Holt Alternate Richard Adams Alternate constituting a quorum. Also present were City Council Representative Roy Stewart and the following City Staff: Scott Williams Building Official Ron Stombaugh Planner 11 Gerrie Bewley Development Services Assistant CALL TO ORDER Vice -Chairman Dennis Luers called the Briefing Session of the Board of Zoning Adjustment to order at approximately 6:00 P.M. ROLL CALL Vice -Chairman Luers held roll call and announced that Chairman Carl Hecht and Secretary Ron Cook were absent. NEW BUSINESS BRIEFING SESSION Mr. Stombaugh briefed the Board of Zoning Adjustment regarding the item scheduled to be heard in the regular public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Luers, Bruner, Kelso, Holt, Adams Nays: None Absent: Hecht, Cook The Briefing Session was adjourned at 6:15 P.M. SC13Z,T VWILLIAMS BUILDIN4 OFFICIALIASSISTANT DIRECTOR OF DEVELOPMENT SERVICES STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, August 4, 2003, at 6:15 P.M., in the Council Chambers, 200 South Main Street, Grapevine, Texas with the following members present: Dennis Luers Vice -Chairman Kip Bruner Member Jim Kelso Member Debbie Holt Alternate Richard Adams Alternate constituting a quorum. Also present were City Council Representative Roy Stewart and the following City Staff: Scott Williams Building Official Ron Stombaugh Planner I'l Gerrie Bewley Development Services Assistant Vice -Chairman Dennis Luers called the public hearing to order at approximately 6:17 P.M. ROLL CALL Vice -Chairman Luers held roll call and announced that Chairman Carl Hecht and Secretary Ron Cook were absent. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA03-09 304 E. FRANKLIN ST. MICHAEL AND KATHERINE REEDER The first item was for the Board of Zoning Adjustment to consider BZA03-09, submitted by Michael and Katherine Reeder, for property located at 304 E. Franklin Street, platted as Lot 2-R1, Block 30, City Of Grapevine. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.1, "R-7.5" Single Family District, Area Requirements, states that the minimum depth of the front yard shall be 30 -feet. Board of Zoning Adjustment 08/04/2003 The applicant requested a variance of 8 -feet to this requirement and if approved by the Board would allow a front yard setback of 22 -feet for a single family residence. Mr. Stombaugh explained that Staff found that there were special conditions, specifically the subject lot was surrounded to the east and west by existing developed single family property both of which have structures built closer than 30 -feet to the front property line. He explained that Staff's recommendation of approval was predicated on two conditions: 1. The property owners to the immediate east and west of the subject property did not protest the requested variance, and; 2. Any construction on the subject lot would not encroach further into the front yard setback than the encroachment existing on the lot immediately to the east. Mr. Stombaugh also noted that the lot received variances from the Board for lot size and lot width at the Board's June 5, 1995 meeting. Michael Reeder, applicant of 821 E. Dove Loop, #2217, Grapevine, took the Oath of Truth. Mr. Reeder explained that he was asking for the variance so the house would be in align with other houses along the street and that it would be out of the drip line of the tree located in the rear yard. In response to Ms. Holt's question concerning the location of the garage, Mr. Reeder explained that it would probably be located on the west side of the house. He explained that he was thinking of possibly building a carport or detached garage. Mr. Williams explained that before a building permit could be issued, two off- street parking spaces would have to be provided. With no one else to speak regarding the case, Kip Bruner made a motion to close the public hearing. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Luers, Bruner, Kelso, Holt, Adams Nays: None Absent: Hecht, Cook Vice -Chairman Luers announced that two letters of protest had been received. Kip Bruner then made a motion that there were special conditions, specifically; the property was surrounded to the east and west by existing developed single - family property both of which have structures built closer than 30 feet to the front 2 Board of Zoning Adjustment 08/04/2003 property line. Richard Adams seconded the motion which prevailed by the following vote: Ayes: Luers, Bruner, Kelso, Holt, Adams Nays: None Absent: Hecht, Cook Kip Bruner made a motion to grant the variance to Section 15.G.1., Single Family District, Area Requirements, allowing a front yard setback of 22 -feet for a single family residence. Jim Kelso seconded the motion. Mr. Williams asked Mr. Bruner to amend his motion to omit Condition 2 of the special condition and to tie the motion to the plot plan. Kip Bruner amended his motion to omit Condition 2 of the special condition and to grant a 22 -foot front yard setback per the attached plot plan. Jim Kelso seconded the amended motion which prevailed by the following vote: Ayes: Luers, Bruner, Kelso, Holt, Adams Nays: None Absent: Hecht, Cook STAFF REPORTS Mr. Williams announced that a 3 -million gallon aquarium was going to be constructed on an out -parcel at Grapevine --Mills Mall, north of the Hilton on 2.8 acres; and a 28,000 square foot office building, for the Southern Baptist Convention, was going to be constructed north of Glade Road and west of State Highway 360. MINUTES Next the Board of Zoning Adjustment considered the minutes of the July 7, 2003, Briefing Session and Public Hearing. Kip Bruner made a motion to approve the minutes of the July 7, 2003, Briefing Session. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Luers, Bruner, Kelso, Holt, Adams Nays: None Absent: Hecht, Cook Next, Kip Bruner made a motion to approve the minutes of the July 7, 2003, Public Hearing. Jim Kelso seconded the motion which prevailed by the following vote: 3 Board of Zoning Adjustment 08104/2003 Ayes: Luers, Bruner, Kelso, Holt, Adams Nays: None Absent: Hecht, Cook ADJOURNMENT With no further discussion, Jim Kelso made a motion to adjourn.
