ROLL CALL Chairman Hecht held roll call and announced that all members were present. SC WILLIAMS BUIL NG OFFICIAL/ASSISTANT DIRECTOR OF DEVELOPMENT SERVICES STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, September 8, 2003, at 6:15 P.M., in the Council Chambers, 200 South Main Street, Grapevine, Texas with the following members present: Carl Hecht Chairman Dennis Luers Vice -Chairman Ron Cook Secretary Kip Bruner Member Jim Kelso Member Debbie Holt Alternate Richard Adams Alternate constituting a quorum. ROLL CALL Chairman Hecht held roll call and announced that all members were present. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA03-10 TRACI D. WILKINSON 312 WEST NORTHWEST HIGHWAY The first item was for the Board of Zoning Adjustment to consider BZA03-10, submitted by Traci D. Wilkinson, for property located at 312 West Northwest Highway, platted as Lot 2-R, Block 13R, Starr Addition. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 26.G.3 "HC" Highway Commercial District, Area Regulations, requires a front yard setback of not less than 25 -feet. Board of Zoning Adjustment 09/08/2003 The applicant requested a variance of 15 -feet to this requirement and if approved, would allow a front yard setback of 10 -feet for an existing structure. Section 53.H.2.b Landscaping Regulations requires a 10 -foot landscaping buffer be provided whenever an off-street parking area or vehicular use area abuts an adjacent property line. The applicant requested a complete variance (10 -feet) to this requirement and if approved would eliminate the landscape buffer along the eastern property line associated with a proposed joint drive/fire lane. Mr. Stombaugh explained that Staff found that there were special conditions for both requested variances, specifically, the structure was an existing one-story stucco building constructed prior to the establishment of the current zoning ordinance requirements, and the narrowness of the subject lot coupled with the location of the existing structure would leave no room to establish the 10 -foot landscaping buffer adjacent to the necessary fire lane along the eastern side of the lot. Lanny Wilkinson was present to represent the case. With no one else to speak regarding the case, Dennis Luers made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None BOARD OF ZONING ADJUSTMENT CASE BZA03-11 RONNIE SMITH 308 RUTH STREET The next item of business was for the Board of Zoning Adjustment to consider BZA03-11, submitted by Ronnie Smith for property located at 308 Ruth Street, platted as Lot 1, Block 6, D. E. Box Addition. Mr. Stombaugh explained that the case needed to be tabled to the October 6, meeting, due to an additional variance requirement. Jim Kelso made a motion to table Case BZA03-11 until the October 6, 2003, meeting. Ron Cook seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None BOARD OF ZONING ADJUSTMENT CASE BZA03-12 GRAPEVINE EXPRESS WASH LP 214 WEST NORTHWEST HIGHWAY Next, the Board of Zoning Adjustment consider BZA03-12 submitted by Grapevine Express Wash, LP, for property located at 214 W. Northwest Highway, platted as Lot 1 R, Block 10, Starr Addition. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 53.H.2.b Landscaping Regulations requires a 10 -foot landscaping buffer be provided whenever an off-street parking area or vehicular use area abuts an adjacent property line. The applicant requested a complete variance (10 -feet) to this requirement and if approved would eliminate the landscape buffer along the western property line associated with a proposed joint drive/fire lane. Mr. Stombaugh explained that Staff found that there was a special condition for the requested variance, specifically, the need for a fire lane that jointly served both the subject lot and the lot immediately to the west precluded placement of the drive anywhere other than along the western edge of the property line. He further explained that that coupled with the internal circulation of the carwash eliminated any area for the 10 -foot landscaping buffer. 3 Board of Zoning Adjustment 09/08/2003 Mr. Stombaugh explained that a conditional use permit was initially approved for a carwash on this site in October 2002, but the request was modified to improve internal vehicle circulation and provide emergency vehicle access to the subject lot and the adjacent lot to the west. He explained that Council did approve the revised plan at their August 19th meeting. Lanny Wilkinson was present to answer any questions. With no one else to speak regarding the case, Kip Bruner made a motion to close the public hearing. DOOLEY STREET The next item of business was for the Board of Zoning Adjustment to consider BZA Case 03-13, submitted by Tim Bowling for property located at 504 S. Dooley M Board of Zoning Adjustment 09/08/2003 Street, platted as Lot 6, and E. 45' of Lot 5, Block 30, City of Grapevine as follows: Section 43.E.3., Nonconforming Uses and Structures, allows the Board to approve the remodeling and/or enlargement of a nonconforming use. The applicant requested to allow an addition to be placed on an existing nonconforming single family residence. Mr. Stombaugh explained that staff found that there were special conditions for the requested special exception, specifically, this was an existing single family residence with an existing second residence located above a detached garage constructed before the current ordinance requirements that precluded more than one residence on platted single family property. Mr. Stombaugh explained that it was the applicant's intent to enclose an area between the main residence and the detached garage, and with that attachment, the residence and garage would create an encroachment into the rear yard setback area. The Board discussed the rear yard setback of 25 feet if the two buildings were tied together and the need for a special exception. Mr. Stombaugh explained that if the building was destroyed it would have to be built back according to the current ordinance and codes. Tim Bowling applicant of 504 S. Dooley Street, Grapevine, took the Oath of Truth. In response to Mr. Luers question, he explained that a tree was located by the driveway off of Franklin Street. With no one else to speak regarding the case, Ron Cook made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Dennis Luers then made a motion that there were special conditions, specifically, this was an existing single family residence with an existing second residence located above a detached garage constructed before the current ordinance requirements that precluded more than one residence on platted single family property. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None 5 Board of Zoning Adjustment 09108/2003 Dennis Luers made a motion to approve the special exception, allowing an addition to be placed on an existing nonconforming single family residence. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None 3829 POOL ROAD The next item of business was for the Board of Zoning Adjustment to consider BZA03-14, submitted by Darrell Huffman for property located at 3829 Pool Road, legally described as Tract 1A, Abstract 439, Grapevine. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 42.C.3 Supplementary District Regulations, Accessory Buildings requires that an accessory building in a residential district shall be located on the rear one half of the lot. If approved it would allow an accessory structure to be located within the front one half of the lot to the east of Pool Road. Mr. Stombaugh explained that Staff found that there were special conditions for the requested variance, specifically, this was a large, unplatted tract of land used primarily for agricultural purposes. He explained that the structure in question would be used for agricultural purposes and its location in the rear one half of the property would eliminate its usefulness, and the setback of the structure would greatly exceed the minimum required setback for other properties in the R-20 zoning district. Darrell Huffman, applicant, of 3324 Hall Johnson Road, Grapevine, took the Oath of Truth and explained that the structure could possibly be moved, but is anchored to the ground and would stay in its current place. He said that the structure was located approximately 279 feet from Pool Road and approximately 477 from Hall Johnson Road. With no one else to speak regarding the request, Jim Kelso made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Chairman Hecht announced that nine letters of approval had been received. A Board of Zoning Adjustment 09/08/2003 Kip Bruner made a motion that there were special conditions, specifically the property was a large, unplatted tract of land used primarily for agricultural purposes; the structure would be used for agricultural purposes and its location in the rear one half of the property would eliminate its usefulness; and the setback of the structure would greatly exceed the minimum required setback for other properties in the R-20 zoning district. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Kip Bruner made a motion to grant the variance, allowing an accessory structure to be located within the front one half of the lot to the east of Pool Road as indicated on the plot plan dated September 23, 2002. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None BOARD OF ZONING ADJUSTMENT CASE BZA03-15 GAYLEN MANCHESTER 900 W. WALL STREET Last, the Board of Zoning Adjustment considered BZA03-15, submitted by Gaylen Manchester for property located at 900 W. Wall Street, platted as Lot 3, M. L. Hurst Addition. The following request is from Grapevine Comprehensive Zoning Ordinance 82-73: Section 43.E.3., Nonconforming Uses and Structures, allows the Board to approve the remodeling and/or enlargement of a nonconforming use. The applicant requested to allow an expansion to the parking area for an existing structure and to allow the site to remain as developed. Mr. Stombaugh explained that staff found that there were special conditions, specifically, the existing lot was platted with an existing metal structure that had been used for retail purposes that predated the current zoning ordinance requirements. Mr. Stombaugh further explained that the existing metal structure which did not meet the current ordinance requirement of 70 -percent masonry for exterior wall covering plus parking within the front yard setback necessitated the special exception request. He added that the applicant had agreed to remove a wooden shed located to the west of the metal building in order to provide parking to meet the minimum requirements of the ordinance. Board of Zoning Adjustment 09/08/2003 Gaylen Manchester, applicant of 924 Glacier Lane, Grapevine, took the Oath of Truth and explained that he would make improvements for office space to the inside of the building, but would keep the exterior as it exists. Mr. Manchester explained that he would be adding more parking spaces in order to have the required 13 spaces. With no one else to speak regarding the case, Kip Bruner made a motion to close the public hearing. Ron Cook seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Chairman Hecht announced that one letter of protest was received. Kip Bruner then made a motion that there were special conditions, specifically, the existing lot was platted with an existing metal structure that had been used for retail purposes that predated the current zoning ordinance requirements.
