Also present were City Council Representative Sharron Spencer and the following City Staff: Scott Williams Building Official Ron Stombaugh Planner II Gerrie Bewley Development Services Assistant 0 -9 Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to order at approximately 6:00 P.M. ROLL CALL Chairman Hecht announced that all members were present except for Alternate, Carl Tomerlin. NEW BUSINESS BRIEFING SESSION Mr. Stombaugh briefed the Board of Zoning Adjustment regarding the item scheduled to be heard in the regular public hearing. ADJOURNMENT With no further discussion, Ron Cook made a motion to adjourn. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: Tomerlin The Briefing Session was adjourned at 6:13 P.M. Also present were City Council Representative Sharron Spencer and the following City Staff: Scott Williams Building Official Ron Stombaugh Planner II Gerrie Bewley Development Services Assistant CALL TO ORDER Chairman Carl Hecht called the public hearing to order at approximately 6:15 P.M. ROLL CALL Chairman Hecht announced that all members were present except for Alternate Carl Tomerlin. NEW BUSINESS :'`i AND LINDA TAILFORD The first item was for the Board of Zoning Adjustment to consider BZA03-01, submitted by Brad and Linda Tailford, for property located at 1524 Dublin Circle, platted as Lot 14, Block 1, Dove Meadows, City Of Grapevine. The following requests were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 16.H "R-5.0" Zero Lot Line District, Buffer Area Regulations, requires that whenever a "R-5.0" Zero Lot Line District is located adjacent to an existing multifamily district or non-residential district without any division such as a dedicated public street, park or permanent open space, all principal buildings or Board of Zoning Adjustment 02/03/2003 structures shall be setback a minimum of 40 -feet from the adjoining property line. The applicant requested a variance of 14 -feet to this requirement and if approved by the Board, would allow a buffer area setback of 26 -feet for an expansion to an existing single-family home. Mr. Stombaugh explained that Staff found that there was no special condition for the requested variance. He explained that the applicant submitted the variance request after being cited by a Code Enforcement officer for construction of an addition onto an existing single family home without a building permit. Mr. Stombaugh explained that the survey, dated May 20, 1993 clearly showed the rear building line created by the required 40 -foot buffer. He explained that despite the buffer requirement, there was adequate buildable area on the lot for a structure well in excess of the minimum 1,200 square foot floor area requirement within the "R-5.0" Zero Lot Line District. Brad Tailford, applicant, of 1524 Dublin Circle, took the Oath of Truth and explained that half of the back of his lot backed up to residential and the other half backed up to multi -family. He explained that the addition was needed for his mother-in-law who was in poor health. Randy McDonald of 1528 Dublin Circle, Grapevine, took the Oath of Truth and explained that the addition matched the brick on the house and was attractive. He explained that he did not know anyone that was opposed to the addition. Patricia Fruendt of 1530 Dublin Circle, Grapevine, took the Oath of Truth and explained that there was a special circumstance regarding Mr. Tailford's mother- in-law needing to move in with the family, and that she had no objection to the addition. With no one else to speak regarding the case, Dennis Luers made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: Nays Absent: Tomerlin Chairman Hecht announced that five letters of approval had been received. Kip Bruner told everyone that spoke that their opinions were appreciated but that the special conditions that were cited were not the types of hardships that would warrant a variance. I? Board of Zoning Adjustment 02103/2003 The Board asked whether the addition could be built in another location. Mr. Tailford explained that if he built the addition in another location, it would devalue the property and it could be seen by the neighbors. After further discussion, Dennis Luers made a motion that there was no special condition. Ron Cook seconded the motion which prevailed by the following vote Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: Nays Absent: Tomerlin The variance request was denied. STAFF REPORTS Mr. Williams announced that the Wal-Mart/Sams projects should be starting soon, the pre -owned car sales at the new Hummer dealership was open, P F Chang's restaurant should open in March, the Blue Goose seafood restaurant, located by the Grapevine Mills Mall was now open, and the previous China Garden restaurant, located on William D. Tate Avenue, will open as a new Chinese buffet. Mr. Williams explained that interior drawings of the Opryland atria had been submitted and that if anyone would like to see them or want a tour of the site, he would make arrangements. He said that four prototype rooms would be set up for viewing. T I la�IIY= Next the Board of Zoning Adjustment considered the minutes of the December 2, 2002, Public Hearing. Ron Cook made a motion to approve the minutes of the December 2, 2002, Public Hearing.
