HomeMy WebLinkAboutItem 13 - Convention Center Water ProofingMEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: DECEMBER 5, 2017 SUBJECT: APPROVAL OF A RESOLUTION FOR THE PURCHASE OF STUCCO AND BRICK WATER PROOFING AND AN APPROPRIATION ORDINANCE RECOMMENDATION: City Council to consider approval of a resolution for the purchase of stucco and brick water proofing from McClung Roofing for joint replacement, repair and restoration of all external Convention Center walls and an appropriation ordinance. FUNDING SOURCE: Upon approval of the attached ordinance, funding will be available in 115-43350-350-03 (Building Maint/Facilities/Convention Center) for an amount not to exceed $89,110.00. BACKGROUND INFORMATION: The Convention Center opened in 1988 and this will be the first wall restoration project. Tremco building materials will be used to restore and provide water proofing for the EFIS walls and will have a 15 year warranty. This purchase will be made in accordance with an existing interlocal agreement with The Cooperative Purchasing Network. Purchases through this program are authorized under Texas Local Government Code, Chapter 271 and Texas Government Code, Chapter 791. Bids were taken by the cooperative and a contract was awarded to McClung Roofing. The CVB and Purchasing staff reviewed the contract for departmental specification compliance and pricing and determined that the contract would provide the best product, service and pricing for meeting the needs of the City. Staff recommends approval. RESOLUTION NO. 2017-098 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AUTHORIZING THE CITY MANAGER OR THE CITY MANAGER'S DESIGNEE TO PURCHASE STUCCO AND BRICK WATER PROOFING THROUGH AN ESTABLISHED INTERLOCAL AGREEMENT AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine, Texas is a local government in the State of Texas and as such is empowered by the Texas Local Government Code, Chapter 271 and Texas Government Code, Chapter 791 to enter into an interlocal agreement with other qualified agencies in the State of Texas; and WHEREAS, The Cooperative Purchasing Network is a qualified purchasing program as authorized by Texas Local Government Code, Chapter 271 and Texas Government Code, Chapter 791; and WHEREAS, the City of Grapevine, Texas has an interlocal agreement with The Cooperative Purchasing Network and wishes to utilize established contracts meeting all State of Texas bidding requirements; and WHEREAS, The Cooperative Purchasing Network has an established contract with McClung Roofing, contract no. R132205, Roofing Products and Services; and WHEREAS, the City of Grapevine, Texas has a need to water proof the stucco and brick at the Convention Center; and WHEREAS, all constitutional and statutory prerequisites for the approval of this resolution have been met, including but not limited to the Open Meetings Act; and WHEREAS, the City Council deems the adoption of this resolution to be in the best interests of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated hereinabove are found to be true and correct and are incorporated herein as if copied in their entirety. Section 2. That the City Council of the City of Grapevine authorizes the purchase of stucco and brick water proofing at the Convention Center from McClung Roofing for an amount not to exceed $89,110.00. Section 3. That the City Manager or his designee is authorized to take all steps necessary to consummate the purchase and installation of said water proofing. Section 4. That this resolution shall take effect from and after the date of its passage. PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on this the 5th day of December, 2017. Boyle, Jr. City Attorney Resolution No. 2017-098 2 ORDINANCE NO. 2017-083 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, APPROPRIATING $89,110.00 IN THE CONVENTION AND VISITORS BUREAU FUND FOR THE CONVENTION CENTER WEATHER PROOFING PROJECT; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Grapevine desires to award a contract to McClung Roofing for the Convention Center weather proofing project; and WHEREAS, funding of $89,110.00 is available in the Convention and Visitors Bureau Fund; and WHEREAS, constitutional and statutory prerequisites for the approval of this ordinance have been met, including but not limited to the Open Meetings Act; and WHEREAS, the City Council deems the adoption of this ordinance is in the best interests of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. That the City Council hereby appropriates $89,110.00 in the Convention and Visitors Bureau General Fund. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 4. That the fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety, and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
