The specific lot contains 7.75 acres , Q ; and is platted as Lot 4R1, Block 1, Tom Thumb � Hall-Johreton sy,� ADP a ; Addition No. 1. The property has 150 feet of � frontage along the southbound service road of �� � , ��-- � � William D. Tate Avenue. Glede Rd. m 1 _i F C O 3 REQUESTED CONDITIONAL USE AND COMMENTS: The applicant is requesting a conditional use permit to amend the previouslv aqproved site plan of CU02-30 (Ord. 2002-61) for a planned commercial center, specificallv to allow a motorcvcle dealership with sales, service and disqlav of new and used vehicles and associated equiqment and outdoor speakers. Currently operating in a stand-alone structure on the eastbound service road of State Highway 114, it is the applicant's intent to relocate the Grapevine Kawasaki motorcycle dealership into a new, purpose built structure on the subject site to be called Grapevine Powersports. Specifically, the former Home Depot Landscaping Supply structure will be demolished and a new, single story, 31,800 s.f. structure will be constructed to house the dealership. A 1 portion of the site encompassing the area to the north, south and west (rear) of the new building will be secured and screened for the outside display and storage of ATV's and motorcycles along with shade structures that will provide protection from the elements for these vehicles. Outdoor display of ATV's and motorcycles during operating hours only will be provided in an area to the north and south of the main entrance immediately in front of the building. The applicanYs proposal requires 120 parking spaces and the applicant has provided 120 spaces. The applicant intends to utilize the exiting monument sign the previous tenant erected along the William D. Tate Avenue service road. Two outdoor speakers are proposed for employee paging only. Hours of operation are proposed to be Monday through Friday 9:00 a.m. to 6:30 p.m. and Saturday 9:00 a.m. to 5:00 p.m. Sunday the dealership will be closed. PRESENT ZONING AND USE: The property is currently zoned "CC" Community Commercial District with a planned commercial center designation. HISTORY OF TRACT AND SURROUNDING AREA: Zoning Case Z83-29, approved in August 1983, rezoned the subject site from "R-1" Single Family District to "R-MF-2" Multifamily Residential District (Ord. 83-47), however the site never developed. In January 1986, Council approved Z86-01 (Ord. 86-09), rezoning a 16.3 acre portion of the site to "CC" Community Commercial District for a mixed use retail concept that never developed. Zoning Case Z94-01 (Ordinance 94-17) revised the stipulations set forth in Ordinance 86-09 by eliminating a 30 foot right-of-way dedication for a proposed street that was to connect Heritage Avenue to the southbound service road of William D. Tate Avenue/State Highway 121. Zoning Case Z97-18 (Ord. 97-134) and CU97-47 (Ord. 97-135) were approved by Council on December 2, 1997, changing the zoning of the entire site to "CC" Community Commercial District and approved a conditional use permit for a Planned Commercial Center with the possession, storage, retail sale, and off-premise consumption of alcoholic beverages (beer and wine only) in conjunction with a grocery store. Conditional Use Permit CU98-23 (Ord. 98-75) was approved at the June 16, 1998 meeting which modified the site plan for Tom Thumb by realigning an internal drive and reallocating parking spaces to improve vehicle movement within the center. At the same meeting Conditional Use Permit CU98-27(Ord. 98-76)was approved to allow for the development of a drive-thru restaurant(Wendy's)on Lot 2 of the Tom Thumb Addition. Conditional Use Permit CU98-44 (Ord. 98-114) allowed the reconfiguration of the signage on the existing lots of the planned commercial center. Conditional Use Permit CU98-74 (Ord. 99-14)allowed for the on-premise consumption of alcoholic beverages in conjunction with Cotton Patch restaurant. Conditional Use Permit CU99-48 (Ord. 99-148) allowed for the development of a branch bank with drive-through lanes. The Site Plan Review Committee at the May 29, 2002 meeting approved Conditional Use Permit CU02-19 to allow for exterior elevation and floor plan revisions for Cantina Laredo. At the August 20, 2002 meeting, Conditional Use Permit CU02-30 (Ord. 2002-61)allowed for the development of a retail nursery and garden supply. The Site Plan 2 � Review Committee at the August 28, 2002 meeting approved revisions to Conditional Use Permit CU02-30 to allow for an eight-foot wrought iron fence with masonry columns adjacent to the outdoor storage areas of the nursery/garden center. At the April 15, 2014 meeting a special use request(SU14-02)was approved to allow massage therapy services in a 1,400 s.f. lease space in the multi-tenant portion of center. Property located north of the subject site was rezoned in the 1984 City Rezoning from "R- 1" Single Family District to "CC", Community Commercial District and from "C-2", Community Business District to "CC", Community Commercial District. Conditional Use Permit CU96-23 (Ord. No. 96-76) allowing the possession, storage, retail sale and off- premise consumption of alcoholic beverages (beer and wine), and a pole sign and monument sign with changeable copy in excess of 30 percent and was approved by Council on September 17, 1996. Randy's Chevron Station was subsequently developed on the site. West of the Chevron Station a site plan for a multi-tenant commercial center was administratively approved in June 2000(SP00-06). Conditional Use Permit CU00-74, (Ord. 01-06) approved at the January 16, 2001 meeting, allowed for the possession, storage, retail sale and on-premise consumption of alcoholic beverages (beer, wine, and mixed drinks) in conjunction with Zuroma's restaurant. Conditional Use Permit CU01-44 (Ord. 2001-71), approved at the September 18, 2001 meeting, allowed for the possession, storage, retail sale and off-premise consumption of alcoholic beverages (beer and wine only) in conjunction with a gourmet and fine wine retail store (The Connoisseur). The Site Plan Review Committee on May 16, 2001 approved (CU01-24)which revised the floor plan for Zuroma's restaurant. Conditional Use Permit CU02-20 approved at the May 29, 2002 Site Plan Review Committee meeting allowed for enclosing of a drive-thru canopy and conversion to a storage area for Randy's Chevron. Conditional Use Permit CU11-15(Ord. 2011-30) approved at the July 19, 2011 meeting allowed for a revised floor plan for The Flats restaurant. Conditional Use Permit CU13-17 (Ord. 13-35) approved at the July 16, 2013 meeting allowed for outdoor dining and revised the existing floor plan for So Cal Tacos restaurant. South of the subject site the property was zoned "R-1" Single Family Residential District prior to the 1984 City Rezoning. Zoning Case Z94-05 (Ordinance 94-33) rezoned 27.9 acres to the south of the subject site from "R-MF-2" Multifamily District to "GU" Governmental Use District for the development of Heritage High School. Special Use Permit SU96-16 (Ord.97-07) approved at the November 18, 1996 meeting allowed for cellular equipment attached to athletic field light standards at Heritage High School. Property immediately adjacent and east and north of the subject site was zoned "R-MF-2" Multifamily District prior to the 1984 City Rezoning. Conditional Use Permit CU89-18 (Ordinance 90-05) established Hansom Hank's Texaco Station and allowed for a convenience store with alcohol beverage sales (beer and wine only) in conjunction with gasoline sales. Conditional Use Permit CU90-13 (Ord. 90-62)approved at the December 4, 1990 meeting allowed for approval of 20-foot pylon sign.Also east of the subject site the property was rezoned in the 1984 City Rezoning to "PCD" Planned Commerce Development District. A CVS Pharmacy has been developed on the location. At the 3 December 12, 1999 meeting Conditional Use Permit CU99-65(Ord.99-176)was approved to allow for on-premise consumption of alcoholic beverages in conjunction with a Boi-Na- Braza restaurant. The Site Plan Review Committed at the July 19, 2000 meeting approve CU00-31 to allow for revisions to lighting, landscaping,floor plan and building elevations for Boi-Na-Braza restaurant. At the June 21, 2005 meeting Council approved zone change request Z05-04 (Ord. 2005-45) from "PCD" Planned Commerce Development District to "CC" Community Commercial District for the development of an office. Property west of the subject site was zone"R-1" Single Family District priorto the 1984 City Rezoning. Zoning Case Z83-29, approved in August 1983, rezoned property west of the subject site from "R-1" Single Family District to "R-MF-2" Multifamily Residential District (Ord. 83-47), however the site never developed. Conditional Use Request CU87-04 (Ordinance 87-48) established the La Petite Academy day care center to the west. Grapevine Powersports is a well-established and successful motorcycle and all-terrain vehicle dealership in Grapevine that is experiencing substantial growth and demand for its vehicles and merchandise. This growth has prompted the dealership to seek alternative locations within the city to provide better service to customers than is physically possible at the current location on State Highway 114. With this goal,ownership acquired the long-vacant property on William D.Tate Avenue that was formerly a Home Depot Gazden Center. Tlus property, in its present layout,ideally suits the goals and needs of Grapevine Powersports for its expanded operation. The existing site configuration,parking,access drives,fire lane disposition, loading area,storage area,and refuse collection areas conveniently match the requirements for the new dealership and are not altered with this application. Landscaping will be enhanced to comply with current city requirements. The existing building structure will be razed,recycling much of the waste materials. The new building of concrete and steel construction will essentially be located exactly in the same location as the previous building. IMPACT&VALUE The new dealership represents no change in the property usage as previously approved by the City,merely a change in retail merchandise. The dealership will not create undue noise or traffic congestion and operational hours on a daily basis should be consistent with those of the previous retail establishment and with those of the neighboring Tom Thumb Addition commercial district properties. The new dealership provides added value to the neighborhood because it is an established business with a strong customer base that will follow the business to its new location. The viability of the business will add new customer traffic to the Tom Thumb neighborhood commercial center. Lastly,it eliminates a long-vacant property meaning improved property maintenance and reduced exposure to vandalism by eliminating an attractive nuisance enticement. As such,the new business will be a suitable neighboring use to the existing school to the south and west. CURRENT ZONRIG The current zoning is CC as part of a larger district that exists at the SW and NW comers of the intersection of Hall- Johnson Road and William D. Tate Avenue. The subject property is bounded on the north by CC zoning;on the NW by R-MF-2 zoning; on the SW and S by GU zoning;and on the E by the TX 121 Highway and CC district located at the east side of the highway. APPLICATION FOR CONDITIONAL USE As stated previously,the existing zoning is CC with a Conditional Use for a retail garden and nursery supply store. In the preliminary meeting with Planning staff,and pursuant to Sect.48.E,it was determined that modifications proposed warranted a public hearing review. The updated Master Site Plan is included with ow application. COMPLIANCE WITH CC DISTRICT REQUIREMENTS(SECTION 25) For purposes of classifying this new development,the most-closely related Conditional Use provision is Sect. 25.C.7—automobile sales and service. However,there is a notable advantage of the proposed use over an automobile sales and service establishment—namely less density of development,less traffic congestion,and less inventory storage requirements. Other azeas of compliance include: • Storage areas are visually screened from the adjacent residential district by a steel mesh security fence of 8- foot height and landscape buffer trees(per Sect.25.D.2). ■ Property density requirements,exceeding the minimum lot size requirement of 30,000 SF(Sect.25.F.1). The lot is 337,374 SF. ■ Property open space requirements,exceeding the minimum requirement of 20%of the total lot area(Sect. 25.F.2). 138,022 SF is provided exceeding the minimum requirement of 67,475 SF. ■ Maximum building coverage compliance(Sect.25.F3):Maximum allowed is 202,424 SF,vs. 31,800 SF provided. ■ Maximum impervious area compliance(Sect.25.F.4): Maximum allowed is 269,899 SF,vs. 199,352 SF provided. ■ Compliance with Section 25.G for setbacks: The area abutting the residential district to the NW has a rear yard setback of 120 FT,exceeding the requirement of two times the maximum height of the building, which is 45 FT x 2=90 FT(Sect.25.G.5). ■ Complies with Section 25.I.1 for height:Maximum height allowed is 50 FT;principal structure is 35 FT and entry fenestration elements are 45 F'I'. ■ Complies with buffer requirements to the residential district of 20 FT minimum. 25 FT is provided with a steel mesh security fence 8 FT in height(Sect. 25.M.4). COMPLIANCE WITH LANDSCAPING REGULATIONS (SECTION 53) Despite the property being vacant for a number of years,the existing landscaping is in remarkable condition. Since the prior usage was a retail garden center,extensive site landscaping irrigation is provided. An extensive number (54)of existing trees of varying sizes(exceeding 8 IN trunk caliper)and species exist in the south and west perimeters of the site. These trees will be augmented with additional trees within the pazking area and the northern perimeter azeas to bring the site into compliance with regulations(Sect. 53.H.1 and 2). Additionally,shrub plantings will be added to provide the required off-street parking screening from public view. Species of trees and shrubs were selected from the city's preferred plantings list. COMPLIANCE WITH OFF-STREET PARKING REQUIItEMENTS(SECTION 56) The proposed dealership operation does not require,nor experience an inordinate demand for parking such as other retail uses. The most-closely related provision for parking is Section 56.C.5—automotive retail sales and service. However,it is important to note that the motorcycle and ATV dealership is significantly unlike auto dealerships in the following manner: ■ Much less product inventory,thus requiring much less parking and storage capacity. ■ Less intensive customer traffic for sales,thus requiring less parking demand. ■ Product servicing is much different in that customers typically drop off their units for service and leave the premises,thus requiring less parking and customer shuttle service than is typical of auto dealership servicing. For the pwposes of this application,parking requirements were calculated at 1 space per 2000 SF of net developable area(total site azea less the non-developable private drainage easement and rear set-back area)of 240,434 SF for a total of 120 spaces required(Sect. 56.C.5). COMPLIANCE WITH OFF-STREET LOADING REOUIREMENTS(SECTION 57) The 31,800 SF facility requires one space(Sect. 57.A.1). The loading space is provided within the fenced and screened area allowing for drive-through access by delivery vehicles,thus eliminating hazardous and disruptive backing maneuvers. The loading space is more than 50 FT from the nearest residential district(actual is 120 FT). Internal traffic access lanes comply with the City minimum requirement of 35 FT radius for turning. COMPLIANCE WITH PARKING-LOADING AREA DEVELOPMENT STANDARDS(SECTION 581 Parking surfacing,space sizes,configuration,and identification comply with City standards. COMPLIANCE WITH SIGN STANDARDS(SECTION 601 The existing monument sign located near the property access lane from William D.Tate Avenue on the east,as previously approved in the original conditional use permit,will be reused. Remaining signage will be building mounted illuminated wall signs within the design parameters of Section 60.C. No illuminated signage will face the neighboring residential district. CONSTRUCTION Construction activity will be conducted in accordance with City of Grapevine ordinance requirements. Construction will comply with the requirements of the City of Grapevine soil erosion control ordinance. effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS, the City Council further considered among other things the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this conditional use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made;
