HomeMy WebLinkAboutItem 18 - Emergency Purchase Water Hauling ServicesMEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: JUNE 19, 2018 SUBJECT: RATIFICATION OF A CONTRACT WITH THE CLEANING GUYS, LLC FOR WATER HAULING SERVICES RECOMMENDATION: City Council to consider a resolution authorizing the ratification of an emergency contract with The Cleaning Guys, LLC for water hauling services. FUNDING SOURCE: Funding for this service is available in the Water PCMF 200-43360-534-0 in an amount not to exceed $25,475. BACKGROUND: On April 6, 2018 the City's paving contractor on the Austin Street Project ruptured the existing 12" water line during liming operations. The water line depth was determined in several locations to verify depth but was struck at a depth of 12" where the water line was installed over a crossing storm drain inlet. As a result, water mixed with lime entered the storm drain system and then into the Cable Branch watershed adjacent to the Vineyards Campground. Staff immediately contacted Texas Parks and Wildlife and the US Army Corps of Engineers to craft a remediation plan. Over the following 72 hours, using a combination of our own forces and the two tanker trucks from The Cleanup Guys, LLC, 1,000,000 gallons was pumped out of the slough to reduce the pH of the water to protect existing wildlife. This was a 24 hour operation using the contractor's equipment and drivers. In addition, multiple drivers were needed to meet commercial driver regulations. Staff recommends approval. RESOLUTION NO. 2018-051 A RESOLUTION OF THE CITY OF GRAPEVINE CITY COUNCIL FINDING AND DECLARING AN EMERGENCY TO PERFORM THE NECESSARY HAUL OFF OF LIME SATURATED WATER; AUTHORIZING EXPENDITURES FOR THE PERFORMANCE OF SAID WORK; RATIFYING CITY STAFF’S VERBAL COMMITMENT FOR SAID WORK AND DECLARING AN EFFECTIVE DATE WHEREAS, on the April 6, 2018, the City’s paving contractor on the Austin Street Project ruptured the existing 12 inch water line during liming operations; and WHEREAS, said water mixed with the lime and entered the storm drain system which ultimately lead to the Cable Branch Watershed adjacent to the Vineyards Campground; and WHEREAS, the emergency purchase of hauling services was required to haul the water from the tributary; and WHEREAS, the City Council finds and concludes that an emergency existed that required the immediate appropriation of funds to preserve the property of the City, to protect the public health and safety of the City’s residents and to preserve the safety of the City and its citizens; and WHEREAS, this emergency obligates the City to complete the water haul off in the most efficient manner possible; and WHEREAS, the City Council finds and concludes that the citizens are best served by the City completing the water haul off services through a verbal agreement with The Cleaning Guys, LLC., without the necessity of accepting additional competitive bids pursuant to Chapter 252, Texas Local Government Code; and WHEREAS, all constitutional and statutory prerequisites for the approval of this resolution have been met, including but not limited to the Open Meetings Act; and WHEREAS, the City Council deems the adoption of this resolution to be in the best interests of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Resolution No. 2017-051 2 Section 2. The City Council approves and ratifies the City Staff’s verbal agreement with The Cleaning Guys, LLC for emergency water haul off. This approval is deemed necessary as a result of unforeseen damage to the water line and subsequent lime water entering the Cable Branch Watershed and the need to preserve and protect the public health or safety of the City’s residents. Section 3. That the City Manager or his designee is authorized to take all steps necessary to enter into agreement for the water haul off in an amount not to exceed $25,475. Section 4. That this resolution shall take effect from and after the date of its passage. PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on this the 19th day of June, 2018.
