HomeMy WebLinkAboutItem 02 - MIB 03-02 308 Ruth StreetMEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: ROGER NELSON, CITY MANAGER 4ql SUBJECT: MOVE -IN BUILDING REQUEST MIB 03-02 RECOMMENDATION Staff recommends City Council remove from the public hearing agenda M11303-02, for property located at 308 Ruth Street, and take any other necessary action. Move -in Building Application MIB03-02 was submitted by the property owner, Mr. Ronnie Smith. The request is to move in an approximate 2,056 square foot, single story residence to the vacant property addressed at 308 Ruth Street. A variance request for a six foot encroachment into the required 30 -foot front yard setback to the east along Texas Street, and a 25 -foot variance to the lot width requirement was considered by the Board of Zoning Adjustment at its October 6, 2003, meeting. Although the variance request of 25 -feet to the lot width requirement was approved, the Board denied the applicant's request to encroach six feet into the front yard setback. As a result of this denial the applicant will not be able to place the building on the lot and be in compliance with the zoning ordinance, therefore the Move -In Building application must be removed from the agenda. Box Addition affected by the requested variances and location of a structure on the platted Lot 1, Block 6, D.E. Addition, Grapevine do hereby protest against any alteration of the Grapevine Comprehensive Zoning Ordinance 82-73 as well as any violation of the Deed Restrictions/Conditions within said D.E. Box Addition. As stated in the original Deed Restriction/Conditions Document, Article 2 — "That no old house shall ever be placed or moved onto said lots." And Article 6 — "No dwelling, or any other building, or any part of said building, including roof, porches, shall be closer than 30ft. to the front line of said lots, and not closer than 10ft. to side line of corner lots." We, the undersigned protest against any person/persons amending any of the above mentioned variances or restrictions.
