Those of us in South Grapevine have not had easy access to a major food chain in the past. Tom Thumb, now located at Hall Johnson Road, provides easy access for some, but not for others in this area due to the lack of a 121 off -ramp at Timberline Drive. I am physically challenged and would delight at having close access to a competitively -priced grocery store. Dear Mr. Mayor, members of the Council and members of the Planning & Zoning Committee: For the fourth time, many of the residents of Creekwood West and other areas surrounding Pool Road and Highway 26 are faced with fighting a development by Greenway Investment Company which is unwanted and which conflicts with existing zoning. This is beginning to resemble the recent Florida election in that one side (Greenway) is intent on finding away to, win, despite what the people say and despite the rules that are in place. In this particular case, Greenway has found a way to get on the City Council agenda at a time when it is obvious that many of the residents who oppose the project will be unable to attend because of holiday commitments. Is it fair to the taxpayers of Grapevine that a hearing on such a controversial issue is allowed to go forward when many of those taxpayers will be unable to have their voices heard? While I would like to see this project voted down again, I would ask that you at least table a hearing until there is equal representation. I would like to remind you that one of the prevalent reasons for denying Greenway in the past was the overwhelming opposition of the residents who live near the proposed development site. Mr. Mayor, you yourself stated publicly at the last hearing on this that it was hard to justify a project which seemed to cause so much opposition and anger in those who reside closest to the development site. Nothing has changed! Those same residents still oppose the project. Because of the timing, however, our voice and presence during the meeting may not seem as strong. Development under specified zoning rules is acceptable. Development outside the rules or a change in zoning to accommodate this request is not only unacceptable but passionately unwanted. A decision by you to approve the project this time will raise many questions. A decision to again deny Greenway's request will reconfirm your stance from last time and will prove again that you are doing what you were elected to do - that is to serve the interests of the citizens of Grapevine. Thank you for diligently considering this. I ask you to vote "No" to Greenway's request or, at least, to table this until January. Everyone is aware of the tremendous opposition expressed by the immediately -affected homeowners inthe previous three hearings. This has the appearance ofan attempt to "trump" that opposition by scheduling the hearing at the busiest time ofthe year for individual citizens. They are proposing two basic changes since their 3rd attempt at passage and offer to reduce the amount of sub -9500 SF retail space and eliminate the professional office space altogether. The smaller retail shops and professional offices are exactly what the Master Plan calls for and are what this community would gladly embrace. Unfortunately, Greenway wants to cut out the good types of development when they should be eliminating the grocery store. At 67,362 SF, Albertsons would be seven (7) times larger than what the Master Plan has deemed to be the best and most appropriate usage of the land. Current zoning restricts the size of businesses to 9,500 SF for good reason. We can't let that change! The City Council and the P&Z must determine in this case whether the Application submitted by Greenway satisfactorily meets the conditions contained in Section 48 of Appendix "D". of the City Code. Some of that criteria is as follows: 1) You must determine that it is necessary and that there has been a change in the conditions of the surrounding lands in close proximity which would support the Application; 2) You must determine, solely through the presentation of evidence, that there is a public necessity, the public demands it, the public interest clearly requires it and that the changes do not invade the rights of those who bought or improved property who were reliant on the existing classification when their investment was made; 3) You have considered the character of the existing zoning and its suitability for particular uses with a view to encourage the most appropriate use of the land; 4) You must consider the safety of the motoring public and pedestrians using the facilities in areas of close proximity to the site; i.e.. the already overly dense traffic patterns at the intersection of S.H. 26 and Pool Rd. as well as Cross Timbers Middle School and Glen Hope Elementary; and, 5) The City Council finds that the Application lessens the congestion in the streets. These conditions must be satisfied through the submission of evidence by Greenway at this public hearing. Members of the P&Z and the City Council, it is your decision to make this determination and I trust that once you've evaluated all the evidence you'll conclude that Greenway has not met several of the required conditions of Section 48 of Appendix "D" that are critically important. Please don't let your concerns for the unknown regarding the future and quality development of these lands persuade you to make decisions that the surrounding community may come to deeply regret. I urge you to allow the hands of time to play themselves out on this issue by not feeling compelled to vote for change. As residents of Creekwood West for 20 months we have been very disturbed that the City Council and the Planning & Zoning Committee would give serious consideration to Greenway Investment Company's proposal to change Grapevine's Master Plan and put in a huge Albertson's grocery store on one of the most already congested intersections in the city. It would seem that the store is for the convenience of those residents of nearby Colleyville and Southlake, since we have an abundance of nearby grocery stores already. Approving a zoning change to allow this development would severely impact the traffic on Old Mill Run which is already used as a cut -through street. Current zoning restricts the size of businesses to 9,500 SF at this location for good reason: to limit traffic, to limit light and noise pollution, to limit commercial truck traffic on Pool Road. Permitting a 24-hour grocery store this close to the high school and middle school is just inviting trouble. Again, we totally oppose Greenway Investment Company's current move to bring in a huge development at the intersection of 26 and Pool Road. Scheduling this hearing for December 19 is just another way that Greenway Investment is trying an end -run around the will of the people. Gee, it's Christmas; the opposition will probably stay away. I urge each of you to vote against this plan of Greenway Investment Company. Grapevine may need another grocery store, but certainly not at this location! This development would be extremely detrimental to a very in a u -Greenway Investment age 2 nice neighborhood resulting in lower property values. This is not the way to develop Grapevine. We are VERY concerned about the current traffic conditions existing in the area, especially near Cross Timbers Elementary School and on Old Mill Run. We have observed far too many vehicles driving at excessive speeds on Old Mill Run in recent months, and increased traffic congestion near Cross Timbers School. The proximity of Grapevine High School to Cross Timbers school is bad enough; a nearby supermarket with its accompanying stores and offices can only increase the level of traffic and danger to the many children who are walking and playing in the neighborhood. Believe me, I have seen TOO MANY close calls as it is. We DO NOT mind at all the drive to the nearest grocery store. We support the continued development of our community in accordance with the current master plan and zoning designations. We also feel that Greenway Investment's request for tomorrow's hearing, so close to Christmas, is very low -life and reflects their true colors, good old GREED. Please oppose this development on behalf of the residents. If memory serves, this is Greenway's fourth attempt to modify the Master Plan Zoning on this property. In the previous cases the board and the Council have listened to the concerns of the homeowners, who will be immediately affected, and voted to not deviate from that Master Plan. The concerns that were voiced then by the homeowners still exist. The traffic congestion issue is still tantamount and has not been adequately addressed - a "cut -through road" that disects a high-school parking lot, proceeds to cross eight -to -ten "speed bumps" in crossing a middle school campus, and finally winds around the middle school entrance is not, by any stretch of the imagination, an adequate solution. The issue of having a major shopping center immediately in front of the entrance to a school has not been addressed. The Greenway group tried to tell us that this type of situation existed at Branford Elementary in Colleyville and the elementary school that is adjacent to Highland Park Village in Dallas. Those situations are totally different -in the first case the shopping center is behind the school and nearly a block away. In the second case, the school is located behind the shopping center and is on a one-way street directed away from the shopping center. Finally, let me add that the scheduling of this hearing during the week before Christmas, a busy time for homeowners, certainly gives the impression that there is little concern for participation of the community in the hearing. I am writing in order to convey my opposition to Greenway's latest efforts to obtain a conditional use permit for the property at the southwest corner of Hwy. 26 and Pool Rd. First, let me explain, that I am a CPA, I own investment real estate, and accordingly, I am very pro-business, pro -capitalism, and pro -profits. However, I do not think that a property owner should seek excessive profits by overdeveloping a parcel of property to the detriment of surrounding property owners. Grapevine's master plan has this property with its current zoning restrictions for a reason. The area, with its concentration of schools, significant through traffic, and a new Krispy Kreme donut shop, cannot support a full-service grocery story. The area near Cross Timbers is already dangerous. This area will get more congested if the access road to Grapevine High School is built in that area, as has been proposed. The new plan that Greenway is proposing is no better than before. Their only changes are to eliminate some of the small retail shops and professional offices which are exactly what would be appropriate for the property, and are what the current zoning calls for. One of my clients owns the Mustang Square development... and based on my experience with him, the small retail and professional shops and offices can and would be very profitable for the developers, and would better fit the needs of the area ... a win/win situation. Our neighborhood, Creekview West, has already been somewhat neglected, in the development of Grapevine. I would invite you to take a walk down Old Mill Run and morning between 7:30 and 8: 45, or any evening, all evening long. You'd easily see how that street has become almost unfit for single family living, due to the volume and speed of the traffic as it currently exists. Further over -development... destination -type development, of the property at the corner of Hwy 26, and Pool Rd. would further exacerbate the problem. As Mayor William D. Tate said during the previous rezoning meetings, and development that is not embraced by its neighbors usually will be a failure, and I can assure you that a full-service grocery store will not be embrace by these neighbors. I was very heartened to read that Southlake was sensitive to the needs of its residents when it recently denied a rezoning for a Super Target. I believe that the existing Master Plan contains appropriate restrictions which were put into place for good reasons: to protect the quality of life and community which the citizens of Grapevine have come to love, respect, and enjoy. 1 am specifically opposed to a shopping center in the 90,000 square foot range as Albertson is currently proposing. I believe the traffic (including large delivery vehicles) and related noise and light "pollution" would be very detrimental to our community and my neighborhood. Additionally, although I have no children, I am concerned about the safety risks that a development of this magnitude poses to my neighbors' children. I might also point out that a commercial establishment like the Krispy Kreme already causes traffic snarls and backups on Pool Road. We do not need more traffic problems! Funny thing, but we never had the traffic congestion when Pool Road was a shaded, two lane "country road." I would appreciate your personal support of our community and neighbors by voting AGAINST the zoning change request and any future similar movements which would jeopardize the quality and safety of our neighborhood. We moved to Grapevine from Kingwood, Texas 2 1/2 years ago where the members of the community were not heard. I knew I was living in the right city as I watched the council respond to the citizens with their concerns not only in this situation but others. I come to you again, as many of us have previous times this issue has been brought up to urge you not to change the zoning for the proposed development at the corner of Poole Road and Hwy 26. Please remember the video that we all watched at the end of the last session which clearly shows how heavy and dangerous traffic is already on Hwy 26. My plea to you today is to remember Beth, the high school student who tried to get out of the middle of the traffic after a accident early one morning before school, only to be hit and killed. I cannot imagine the pain her Mother deals with on a daily basis. Cross Timbers Middle School is even closer to the proposed site which will bring about even more congestion to that particular area but it will also affect the high school as the traffic increases on Hwy 26, Poole Road and in the Creekwood subdivision. While I too am concerned with what this development would do to the value of my real estate, quality of life, the trees, etc ... I am most of all concerned with the safety of our children, our young adults and all citizen of Grapevine. Please don't put our daily lives and safety in the middle of a busy retail space with a 24 hour Albertson store. None of us want a heavy duty commercial space with congestion and increased traffic right next to our living quarters. Please respect the fore thought of those who zoned this lot originally and keep it as it was intended for smaller retail business. In Kingwood, Kroger wanted to knock down trees in our livable forest to build a Super Kroger. ..Kingwood wasn't incorporated so we dealt with the developer. Friendswood development was only interested in the monies and didn't listen to the neighbors Kroger would back up to. The fear was of the invasion of privacy. The lights, the noise of delivery trucks, the trees that would be lost—the quality of life. Like Greenway, Friendswood had answers for all of these concerns. The fences, the plants the limited access of trucks after hours. However<< the reality is today.. ..the neighbors wake up to the trucks in the middle of the night, the lights light the sky with a glow for miles around, even the blowers used to sweep the parking lot is heard in the homes in the area. All the fears they had, even in the wake of the developers promises, have all become a part of reality. We lost thousands and thousands of dollars on the sale of our home there 2 112 years ago. The for sale sign stand in the yards and no one wants to buy with a Kroger in their back yard. Please don't repeat this situation in Grapevine. Kroger too promised to be a good corporate neighbor.... They do the best they can for a large retail establishment in a neighborhood ... the fact is .... it simply doesn't fit well in that location just as Albertson's won't fit well in this proposed site. I am still opposed to the proposed zoning or conditional use changes to this property, primarily because of the traffic problem at the intersection of Hwy 26 and Pool Road and through the Creekwood West neighborhood. Though the developers have amended their plan time and again, the plan still includes a large grocery store. The people from Greenway Investments do not deny that the grocery store will increase traffic in this area. The traffic increase will be more significant with a grocery store than it would be if the property were developed in accordance with the current restrictions. Mayor Tate recently told Senator Gramm's office that Grapevine's number one concern is the transportation crisis in our city. How can we expect to get help from others with this problem if we take steps to exacerbate the situation? The traffic in this area greatly affects our quality of life, and it poses a safety risk too, especially with the schools located so close to this intersection. I expect the city council and the P&Z members to think about these concerns before voting tonight. I have just one other comment on this issue. Paving the way for a grocery store and strip retail center at the western entrance to our city would be an opportunity lost. Nothing says "Welcome to Hurst (or Colleyville, Euless, or North Richland Hills)" like a strip shopping center. Do we want the same to be true of Grapevine? Do we want visitors to our city to observe the backside of a strip center as they enter Grapevine along Highway 26? This piece of property, located in a highly visible area at our western border, could be developed into something really special that signifies to visitors that they have entered the best city in the metroplex. For example, I think this property would be a better place for a nature center and botanical gardens than the small site in the center of town. I would like to see something unique done with the last bit of undeveloped land in our city. A grocery store and strip center hardly sets Grapevine apart from the ordinary and mundane suburbs surrounding us. I think we have a special city.
