Home My WebLink AboutItem 08 - Walnut Street CC ITEM #8 MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MEETING DATE: MARCH 19, 2013 SUBJECT: RIGHT-OF-WAY ABANDONMENT — WALNUT STREET RECOMMENDATION: City Council consider adopting an ordinance abandoning a 50 foot wide strip of Walnut Street right-of-way extension extending east for a distance of approximately 245 feet from the intersection of Eckley Street and Walnut Street into Lot 1 R-All, Block 2A, Grapevine Station Addition, and take any necessary action. BACKGROUND: Walnut Street runs east — west from Ruth Street to Eckley Street. The right-of-way for Walnut Street extends east for a distance of 245 feet beyond that intersection into Lot 1R-A1, Block 2 Station subdivision in an unimproved state and was incorporated into the development. The existence o f t he right-of-way, dedicated by deed tote City by Joe N. Box on September 27, 1961, has just recently been discovered in updated title work. Public utilities have reviewed the request and have no objections. Staff has reviewed the request and has no objections. Staff recommends approval. Section 2. That the lic street right of y described in Exhibit " " attached hereto n incorporated herein r all purposes, is hereby abandoned and vacated for public use subject to the retention of said right of y for a utility easement. Section . That the terms nd provisions of this ordinance shaII be deemed to be severable, and that if the li it any section, subsection,word, sentence or phrase shall be held to be invalid, i shall not affect the remaining of this ordinance. Section That the fact right of y is o longer needed by the u lic for public usage and would create hardship or burden upon the City of Grapevine keep open and maintain such right of way creates an urgency n an emergency for the immediate r a tics of the public health, safety, general welfare which requires that CC ITEM #8 this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
