SUBJECT: CONDITIONAL USE REQUEST CU10-06
RECOMMENDATION:
Staff recommends the City Council table conditional use permit request CU 10-06 and the
replat of Lot 5, Block 1, W.R. Boyd Center and take any other action necessary.
BACKGROUND.INFORMATION:
The engineer Don.Harrelson on behalf of the applicant, RaceTrac Petroleum, submitted a
conditional use request and a replat for property addressed as 751 East Northwest
Highway to allow gasoline service and off-premise consumption of alcoholic beverages
(beer and wine.)in conjunction with a convenierice store located on the northwest corner of
East Northwest Highway and Boyd Drive. The applicant needs additional time to
investigate the possible purchase of additional property adjacent to the subject site.

Subject: RaceTrac#937 NW Hwy& Boyd Rd.
Thank you for working with us to move the plat and CUP applications through
the process. We have been instructed by our client to stop development of
this site temporarily while they investigate the purchase of additional
property to the north. To that end, please place our plat and CUP cases on
hold and do not place our cases on the upcoming P&Z/CC agenda. Once
RaceTrac has come to a conclusion about the additional property
negotiations, I will contact the engineering and planning departments to
place our cases on the next available/possible public hearing.
If you have any questions or comments, please feel free to contact me
