This property contains 5.12 acres and has approximately 668 feet of frontage along Westgate Plaza. m Glade Rd. REQUESTED PLANNED DEVELOPMENT OVERLAY AND COMMENTS: The applicant is requesting a planned development overlay to amend the previously approved site plan of PD10-01 (Ord. 10-05)for a 39-unit townhouse project specifically to allow the development of 22 detached townhomes. At Council's August 15, 2006 meeting a zone change request was considered and approved on the subject property allowing a change in zoning from "CC" Community Commercial District to "R-TH" Townhome District for the development of 39 townhouse units. Along with the zone change request a planned development overlay request was also approved allowing deviation from the front, rear, and side yard setback requirements, building separation; and building coverage standards for the townhouse development. Streets were developed at 25-feet in width with additional parking for the townhouse project built throughout the property. 0AZCU1PD10-03.4 1 051101104:33 PM Currently, 17 townhouse units have been constructed on site. With this request, the applicant intends to develop the remaining 22 lots as a "detached" product meeting all previously agreed to standards but with a five foot separation between each townhouse. Each remaining lot to develop would have a two story structure built on the property line on one side of the lot, with a five foot separation (setback) on the other side. No other changes are proposed with this request. Seethe attached letter. PRESENT ZONING AND USE: The property is currently zoned "R-TH"Townhouse District and is partially developed with townhomes. HISTORY OF TRACT AND SURROUNDING AREA: The subject property was zoned "R-2" Two Family Residential prior to the 1984 City Rezoning. During the City Rezoning the subject site was rezoned to "R-3.5" Two Family District. At a January 16, 1990 meeting, Council approved a rezoning (Z89-17) of the subject site to"CC" Community Commercial District and the property has remained vacant. The Grapevine Plaza Shopping Center to the east was rezoned from "C-2" Community Business District to"CN" Neighborhood Commercial District during the 1984 City Rezoning. It was later rezoned (Z85-10) to "SP" Site Plan District to allow the development of a shopping center with a grocery store with off-premise alcohol beverage sales. At the April 15, 2003 meeting, Council approved a conditional use permit (CU03-10) for a planned commercial center for a future retailloffice complex. Conditional Use Request CU06-31 was approved at the August 15, 2006 meeting which allowed for a 17,224 square foot medical office building immediately south of the subject site. At the August 15, 2006 meeting Council approved a rezoning (Z06-12) of 5.12 acres of the subject property from "CC"Community Commercial District to"R-TH"Townhouse District for the development of 39 townhouse units. Along with the zoning request the Council also approved a planned development overlay (PD06-08) which allowed for deviation from the front, rear, and side yard setback requirements and building separation. At Council's February 16, 2010 meeting an amendment to the site plan for the Townhomes at Westgate was approved (PD10-01)to allow the relocation of a screening wall relative to two single story townhouse properties near the northwest corner of the site. Subject: "Townhomes of Westgate PD Amendment Request" Dear Mr. Stombaugh, Due to the significant challenges in the current economic environment we are submitting this letter to request an amendment to PD # as we feel that this will result in the highest and best outcome for the City of Grapevine,the existing homeowners of the Townhomes of Westgate, and the Owners' and investors of the project. As we have faced and continue to face the reality of a slowing economy it has brought about the result of a significantly decreased home absorption. This effect has been especially hard in the attached housing product as it was always a `niche' product market when compared to single family detached choices_ I believe that the DFW market was hesitant to accept attached developments for several reasons. The first being that DFW has vast amounts of developable land in comparison to more urbanized cities. We also have a love affair with our automobiles and the freedom that they allow us which makes us less dependent on urban renewal or density in order to gain proximity to employment centers. Also,the savings and loan crisis of the eighties remained engrained on a lot ofpeople's minds and attached condominiums and townhomes were harder hit during that era than were the single family homes and lenders as well as potential buyers were hesitant to embrace density too quickly_ That is not to take away from the merit of dense developments as there are many. I believe that pent up demand presented itself for a few years in addition to the growth of people's desire for a maintenance free living choice causing developers to seek out `pockets' of suitable land to fill this demand. Currently,we exist in a cooling market that is roughly 25% of what it was a few years ago. The attached home market was small to begin with when compared to detached housing and has become unsustainable at current absorption rates to allow developers as well as builders to carry the lot and spec inventory necessary to maintain profitability. It should also be mentioned that areas demanding a higher price point have been hit especially hard. The Townhomes of Westgate fall into this category. I feel that by increasing the market acceptance and demand for a detached product we wall be able to acquire higher sales prices for the remaining homes due to supply and demand fundamentals. It has been my experience that a detached product appeals to nearly five times the number of buyers than attached product does. By increasing this market acceptance and demand we will be able to hold prices higher thereby protecting the investments of the current homeowners and protecting property values for the greater city. Being an architect and builder,this will be accomplished with considerable care to blend the neighborhood architecturally together by using similar roof lines, window configuration, and Iike brick and stone materials. I have included in nay presentation floorplans and house elevations and given them a connected streetscape facade to blend into the community tasetfully. We are able to work within the existing plat of the current PD given the ability on lots 1, 16, &21 to place the units on the property line where adjacent to open spaces and still allow window penetrations to give the facades a more"friendly" character. We will in effect be creating a zero lot line development with one side on the property line and a S' minimum side yard setback on the other side as allowed by current building codes. I have found that side yards of any size are often underutilized spaces and we are proposing to put gravel in these areas as a means of access to the backyards without going through the house. It is our hope that the city will see the merit in our request and expeditiously assist in the successful continuance of this wonderful development within the city. Time is of the essence as we are entering the spring selling season and want to capture as many sales as we are able. adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street locating spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health and the general welfare; effect on light and air; the effect on the overcrowding of the land; the effect on the concentration of population; the effect on the transportation, water, sewerage, schools, parks and other facilities; and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council of the City of Grapevine,Texas, did consider the following factors in making a determination as to whether this requested planned development overlay should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation,water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 41 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS,the City Council further considered among otherthings the characterof the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS,the City Council of the City of Grapevine,Texas, does find that there is a public necessity for the granting of this planned development overlay, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the planned development overlay lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this planned development overlay and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and, therefore, feels that the issuance of this planned development overlay for the particular piece of property is needed, is called for, and is in the best interest of the public at large,the citizens of the City of Grapevine,Texas, and helps promote the general health, safety and welfare of this community. ORD. NO. 2 NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the City does hereby issue a planned development overlay in accordance with Section 41 of Ordinance No. 82-73,the Comprehensive Zoning Ordinance of the City of Grapevine,Texas, same being also known as Appendix"D"of the City Code, by granting Planned Development Overlay PD10-03 to amend the site plan approved by Ordinance No. 2010-05 for a 39-unit townhouse project,to allow for the development of 22 detached townhomes in the "R-TH" Townhouse District Regulations within the following described property: Lots 1-39,Townhomes of Westgate Addition (2300 Westgate Plaza)all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73, attached. hereto and made a part hereof as Exhibit "A", and all other conditions, restrictions, and safeguards imposed herein, including but not limited to the following: None. Section 2. That the City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets;to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation,water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district,and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. That this ordinance shall be cumulative of all other ordinances of the City of Grapevine,Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of ORD. NO. 3 land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00)and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. That the fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
