IN ACCORDANCE• •D ' 551.001 ET SEi ACTS OF E 1993 TEXAS LEGISLATURE, TEEBUILDING :••'D OF APPEAL MEETING D• WAS PREPARED POSTED ON 1 6TH DAY OF OCTOBER, •• 11 P.M. •s DING OFFYCIAL STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Building Board of Appeals for the City of Grapevine, Texas, met in regular session, Monday, October 9, 1995, at 6:30 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas with the following members present: Joe Lipscomb Chairman Art Gordon Member Greg Czapanskiy Member constituting a quorum. Also present was Council Representative, Gil Traverse and following City Staff: Scott Williams Building Official Kelly Doughty Secretary Chairman Joe Lipscomb called the meeting to order at 6:30 P.M. NEW BUSINESS The first item for the Building Board of Appeals to consider was BBA95-04 submitted by Paul Dennehy for Delaney Vineyards who is requesting a variance for the property located at Lot 1, Block 1, Delaney Addition and addressed as 2000 Champagne Boulvard. The request is to the City of Grapevine Code of Ordinances as follows: 1. Section 7-126., SIDE YARD REQUIREMENTS. It shall be unlawful to erect a fence at a height exceeding eight (8) feet in any side yard or along any side yard lot line. 2. Section 7-127(a), FRONT YARD REQUIREMENTS. (a) CORNER LOTS: It shall be unlawful to erect a fence in the required front yard building setback area or the established front yard area, whichever area is greater in depth, on any corner lot, except along the interior lot line in accordance with subsection (b). BBA Minutes 08/14/95 (b) Interior Lots: (1) It shall be unlawful to erect a fence, hedge or vines over thirty-six (36) inches in height in the required front yard area or the established front yard area, whichever area is greater in depth, on any interior lot. (2) It shall be unlawful to erect a fence, hedge or vines in the required front yard area or the established front yard area, whichever area is greater in depth, on any interior lot that does not have at least fifty (50) per cent through vision. (3) It shall be unlawful to maintain a fence, hedge, or vines in the required front yard area or an established front yard area, whichever area is greater in depth, of an interior lot in a manner that does not permit at least fifty (50) per cent through vision. (4) For the purpose of this section, "established front yard area" shall mean an open, unoccupied space on a lot facing a street and extending across the front of a lot between the side yard lines and extending from the abutting street a principal building or structure. The phrase "required front yard" shall have the meaning ascribed to it in the Grapevine Zoning Ordinance No. 82-73. * The variance request, if approved, would allow a fence exceeding 8'-0" in height in the required side yard along Merlot Avenue as shown on the plot plan. * * Additionally, the variance request, if approved, would allow a fence exceeding thirty six (36) inches in height and fifty (50) per cent through vision to be constructed in both the required and established front yard on a corner lot as shown on the plot plan. An application was submitted to the Department of Development Services by Mr. Paul Dennehy representing Delaney Vineyards for the proposed fence located at 2000 Champagne Boulevard. The arrangement of the fence around the perimeter of this property is a similar situation to the subdivision screening walls that have been approved by the Board in the past. Scott Williams, Building Official, explained the case to the board. 0 BBA Minutes 08/14/95 With no one else to speak for or against the request, Greg Czapanskiy motioned to close the public hearing. Art Gordon seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Czapanskiy, and Gordon Nays: None Absent: Roberts, Long, Kidd, and Smith Art Gordon moved, with a second by Greg Czapanskiy, to grant the variance to the City Code of Ordinances, Chapter 7, Article IV for Lot 1, Block 1, Delaney Addition and addressed as 2000 Champagne Boulvard allowing a fence to exceed eight (8) feet in height in the required side yard and allowing a fence to exceed thirty six (36) inches in height and fifty (50) per cent through vision to be constructed in both the required and established front yard on a corner lot as shown on the plot plan. Ayes: Lipscomb, Czapanskiy, and Gordon Nays: None Absent: Roberts, Long, Kidd, and Smith OLD BUSINESS STATUS OF DANGEROUS BUILDINGS - 1004 PINE STREET 911 BALL STREET 1061 EAST NORTHWEST HIGHWAY, 3001 WILLIAM D. TATE AVENUE A demolition permit was issued for 3001 William D. Tate Avenue and the structure has been demolished. No action has been taken on 1004 Pine Street, 911 Ball Street, and 1061 East Northwest Highway. MISCELLANEOUS REPORTS AND/OR DISCUSSION Mr. Williams suggested modifying the fence ordinance to provide exceptions for subdivision type fences. MINUTES The Building Board of Appeals considered the minutes of the August 14, 1995 meeting. Art Gordon motioned to approve the minutes of the August 14, 1995 meeting. Greg Czapanskiy seconded the motion which prevailed by the following vote: 3 BBA Minutes 08/14/95 Ayes: Lipscomb, Czapanskiy, and Gordon Nays: None Absent: Roberts, Long, Kidd, and Smith ADJOURNMENT With no further discussion, Art Gordon made a motion to adjourn.
