ACTS OF THE 1993 TEXAS LEGISLATURE, THE BUILDING BOARD OF APPEALS MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 11TH DAY OF APRIL, 1997, AT 5:00 P.M. STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Building Board of Appeals for the City of Grapevine, Texas, met in regular session, Monday, April 14, 1997, at 6:00 P.M., in the Council Room, 200 South Main Street, Grapevine, Texas with the following members present: Joe Lipscomb Chairman Art Gordon Member Charles Bloomberg Member Russell Kidd Member constituting a quorum, with Members Dennis Roberts arriving late, and Catherine Cotter Smith absent. Also present was Council Representative Roy Stewart and the following City Staff: Scott Williams Building Official Mike Butler Code Enforcement Officer Teresa Wallace Secretary Chairman Joe Lipscomb called the meeting to order at 6:00 P.M. The first item of business was a follow up to Dangerous Building DB96-01, 845 Dawn Lane, legally described as Tracts 3B and 3131, Sunshine Harbor Industrial. At the November 11, 1996, public hearing, the Board determined the structure to be a dangerous building, ordered a permit to be secured for renovation within thirty (30) days and repairs to be completed within ninety (90) days. Mr. Williams stated that following the November 11, 1996 meeting, the applicant was required to obtain certain zoning variances. Mr. Williams confirmed that a building permit had been issued the week of April 17th on the property for renovation. The next item was for the Building Board of Appeals to consider Dangerous Building BBA MINUTES 4/14/97 DB96-07 for a garage on property located at 619 Austin Street, to determine whether it was a dangerous building pursuant to Chapter 7, Article II, of the Grapevine Code. At the February 10, 1997, public hearing, the Board tabled the request to consider the dangerous building at the April 14, 1997 public hearing because legal notifications were not properly sent. Mike Butler showed slides of the structure and its dangerous condition. Mr. Butler explained that the garage and not the residence was the dangerous building in consideration. Russell Kidd made a motion to close the public hearing. Art Gordon seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Bloomberg, Kidd Nays: None Absent: Roberts, Smith After a brief discussion, Charles Bloomberg moved that the board determine the garage to be a dangerous building as described in the Grapevine Code of Ordinances and require that the garage be repaired or demolished as specified. Art Gordon seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Bloomberg, Kidd Nays: None Absent: Roberts, Smith Scott Williams, Building Official, stated that Staff recommends the Building Board of Appeals deny the request to City Code of Ordinances, Chapter 7, Article IV, Fomes, Section 7-126, for Lot 3 Block 6, Woodland Hills Addition and addressed as 2937 Crestline Drive, Grapevine, Texas as follows: Section 7-126, Side Yard Requirements which limits the height of a fence to a maximum of eight (8) feet in any side yard or along any side lot line. Mr. Steve Ambrose submitted a request to allow a ten (10) foot high fence along the west property line as shown on the plot plan. The applicants felt that the additional fence height would improve their privacy. Staff visited the site and determined that the motor home parked on the adjacent lot was not in violation of the Zoning Ordinance. PJ Mr. Williams stated the applicant was not in attendance. Also, he stated the applicant had been notified of the meeting date and time by copy of the agenda. Further, Mr. Williams told the board he had personally visited the property and related that the neighbor did have a spotlight on a high pitched gabled roof. There is an existing eight (8) foot fence on top of a retaining wall. After delaying the public hearing to allow sufficient time for the applicants to arrive Charles Bloomberg moved to close the public hearing. Art Gordon seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Roberts, Gordon, Bloomberg, Kidd Nays: None Absent: Smith Charles Bloomberg moved, with a second by Art Gordon, to table the request to May 12, 1997 because the applicant was not available to speak to the request. The motion prevailed as follows: Ayes: Lipscomb, Roberts, Gordon, Bloomberg, Kidd Nays: None Absent: Smith Staff recommends the Building Board of Appeals ,deny the request to City of Grapevine Code of Ordinances, Chapter 7, Article IV, Fences, Section 7-127, for Lot 25, Shorecrest Acres Addition and addressed as 1859 Chris Craft Drive, Grapevine, Texas as follows: Section 7-127, Front Yard Requirements - prohibits the erection of a fence exceeding thirty-six (36) inches in the required front yard. The request is to allow a fence to be constructed exceeding the maximum height by one (1) foot as shown on the plans. If approved, it would allow a four (4) foot fence to be constructed in the required front yard. Scott Williams, Building Official, stated that Staff does not feel this property has any unusual conditions to warrant an increase in fence height. Mr. Richard Smith, property owner was introduced to speak to the request. Mr. Smith had photographs and a copy of a police report as exhibits to show that his 3 BBA MINUTES 4/14/97 property was constantly being used by people cutting through his yard because of its proximity to the lake. He told the board he was proposing a four (4) foot wrought iron fence which would allow visibility but added security for his property. He stated that he felt a fence of four (4) feet would deter the foot traffic through his yard by not allowing someone to simply step over the fence and cut through his yard. He also stated his neighbor has an existing four (4) foot fence that he would connect to and he would prefer the fence heights conform for appearance sake as well as the safety factor. Further, he stated that he would also install a four (4) foot gate to the front door and the single car driveway. Lisa McCallam, property owner of 1836 Chris Craft and 1829 Chris Craft, spoke in favor of Mr. Smith's request stating that several properties in the area had existing four (4) foot fences which deters people from entering their yards. She asked the board to consider Mr. Smith's request based on security and continuity of fence heights. Charles Bloomberg moved to close the public hearing, with a second by Art Gordon. The motion prevailed as follows: Ayes: Lipscomb, Roberts, Gordon, Bloomberg, Kidd Nays: None Absent: Smith After a brief discussion about the security issues of fencing front yards in the neighborhood, Art Gordon moved, with a second by Russell Kidd, to approve the request to allow a four (4) foot fence in the front yard. The motion prevailed by the following vote: Ayes: Lipscomb, Roberts, Gordon, Bloomberg, Kidd Nays: None Absent: Smith Mr. Scott Williams, Building Official, told the board he wanted to bring the issue of adopting the 1994 Uniform Building and Mechanical Code before them to consider the revisions. Mr. Williams reminded the board that the city was currently enforcing the 1991 uniform codes. He said that the building industry was working toward uniformity in the codes. There are currently 3 major codes in the United States: UBC, SBCCI and BOCA. Mr. Williams stated that the goal for the three promulgating bodies Ell was to have a single national code by year 2000. The 1994 Uniform Codes are a step in that direction, for although there is not a great deal of technical change, the 1994 Uniform Codes are laid out in the same format, chapter by chapter, as the other two major codes. Mr. Williams further stated that he felt this was the appropriate time to change local amendments to the codes if necessary. He also thought that the board should consider modifying certain other building related ordinances such as the Fence and Dangerous Building Codes. He stated he would like to begin a study of the documents at the next meeting to allow everyone the opportunity to review and understand the revisions. He told the board he would have code books as well as an analysis of revisions and the City of Grapevine local amendments available at the next meeting for their review. Mr. Dick Ward, Fire Marshall, spoke to the board about the proposed building code changes. He stated there were concerns within the fire industry concerning fire sprinklers for all commercial buildings. He said he would also be coming before them to discuss revisions to the fire code. Mr. Williams requested the board meet at 5:30 p.m. for the next few meetings to allow additional time to consider the revisions. He told them they would begin with the building and mechanical code followed by the fire code and fence ordinance. Dennis Roberts moved to close the public hearing. Russell Kidd seconded the motion which prevailed as follows: Ayes: Lipscomb, Roberts, Gordon, Bloomberg,,Kidd Nays: None Absent: Smith The last item for the Building Board of Appeals to consider were the minutes of the February 10, 1997, meeting. Russell Kidd made a motion to approve the minutes as read. Charles Bloomberg seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Roberts, Gordon, Bloomberg, Kidd Nays: None Absent: Smith 9 BBA MINUTES 4/14/97 With no further business, Charles Bloomberg made a motion to adjourn. Dennis Roberts seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Bloomberg, Kidd Nays: None Absent: Roberts, Smith With nothing further the meeting was adjourned at 7:00 P.M.
