IN ACCORDANCE WITH ARTICLE 6252-17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS OF 61ST LEGISLATURE, REGULAR SESSION, THE BUILDING BOARD OF APPEALS MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 9TH DAY OF APRIL, AT 5:00 P.M. g� COMMUNITY DEVELOPMENT DIRECTOR STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Building Board of Appeals for the City of Grapevine, Texas met in regular session, Monday evening, May 10, 1993, at 6:30 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present: Joe Lipscomb Chairman Greg Czapanskiy Member Dennis Roberts Member constituting a quorum with members Vernie Henderson and Art Gordon absent. Also present was Council Representative, Ted Ware, and the following City Staff: Greg Wheeler Building Official Paula Pennington Secretary CALL TO ORDER Chairman Joe Lipscomb called the meeting to order at 6:30 P.M. NEW BUSINESS BBA 93-04 CHARLES MARTINEZ An application was submitted to the Building Inspection Division of Community Development by Mr. Charles Martinez for his residence located at 4126 Bentley Court, Grapevine, Texas. Mr. Martinez was contacted by his homeowner association that the satellite dish that he has in his backyard is visible from Hall -Johnson Road. The homeowners association informed Mr. Martinez that he was in violation of deed restrictions because it is visible from any direction. Mr. Martinez would like to increase the height of his fence by two (2) feet rather than remove the satellite dish. Greg Wheeler, Building Official explained the case to the Board. Mr. Charles Martinez spoke in reference to his case and said that he would like to build an additional fence inside for appearance and the fences will be about eight (8) inches apart. With no one else to speak for or against the request, Dennis Roberts made a motion to close the public hearing, Greg Czapanskiy seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Czapanskiy, Roberts Nays: None Absent: Henderson, Gordon Greg Czapanskiy then made a motion to grant the variance, Dennis Roberts seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Czapanskiy, Roberts Nays: None Absent: Henderson, Gordon BBA93-05 MARVIN BALVIN GRAPEVINE TRUCK LEASING An application was submitted to the Building Inspection Division of Community Development by Mr. Marvin Balvin for the Grapevine Truck Leasing, Inc., of 141 Central Avenue, Grapevine, Texas. The location for the variances is located on Lot IR, Block 1, Northwest Crossing Shopping Center. Currently, the Grapevine Truck Leasing, Inc., owns this lot on which it stores several of its vehicles. The company has been experiencing theft and vandalism of its vehicles on this unprotected lot. The security fence would help eliminate the easy access to this lot and the vehicles for vandalism. Greg Wheeler, Building Official explained the case the case to the Board. Marvin Balvin spoke for his case and informed the Board that he would like to fence the property for security. With no one else to speak for or against the request, Greg Czapanskiy made a motion to close the public hearing, Dennis Roberts seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Czapanskiy, Roberts Nays: None Absent: Henderson, Roberts Dennis Roberts then made a motion to grant the variance, Greg Czapanskiy„ seconded the motion which prevailed by the following: Ayes: Lipscomb, Czapanskiy, Roberts Nays: None Absent: Henderson, Gordon BBA93-06 BRYANT NICHOLS AND MELISSA HARROUN A request for this variance was submitted by Mr. Bryant Nichols and Ms Melissa B. Harroun for the location of 2837 Placid Circle, legally known as Lot 40, Block 4, Placid Peninsula Addition, Grapevine, Texas. The applicants would like to install a handrail that is approximately 6 two (2) inches and seven eighths (7/8) at its widest part and two (2) inches and three sixteenths (3/16) at its narrowest part. Greg Wheeler, Building Official explained the case to the Board and stated that staff recommended denial of the variance because it would set a precedent. Mr. Bryant Nichols and Ms Melissa Harroun both spoke in reference to their case, and explained that they would like the bigger rail for the safety of their children and elderly. With no one else to speak for or against the request, Dennis Roberts made a motion to close the public hearing, Greg Czapanskiy seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Czapanskiy, Roberts Nays: None Absent: Henderson, Gordon Dennis Roberts then made a motion to deny the variance, Greg Czapanskiy seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Czapanskiy, Roberts Nays: None Absent: Henderson, Gordon OLD BUSINESS DB93-01 CARWASH 214 WEST NORTHWEST HIGHWAY Greg Wheeler updated the Board on the case. With no one else to speak for or against the case, Dennis made a motion to close the public hearing, Greg Czapanskiy, seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Czapanskiy, Roberts Nays: None Absent: Henderson, Gordon Dennis Roberts then made a motion to raze the location of 214 West Northwest Highway in fifteen (15) days, Greg Czapanskiy seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Czapanskiy, Roberts Nays: None Absent: Henderson, Gordon 3 MINUTES The Building Board of Appeals considered the minutes of the April 12, 1993 meeting. Dennis Roberts made a motion to approve the minutes, and Joe Lipscomb seconded which prevailed by the following vote: Ayes: Lipscomb, Roberts Nays: None Absent: Henderson, Gordon Abstain: Czapanskiy ADJOURNMENT With no further discussion, Dennis Roberts made a motion to adjourn the meeting, Joe Lipscomb seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Czapanskiy, Roberts Nays: None Absent: Henderson, Gordon The meeting was adjourned at 7:10 P.M.
