Trigg Grocery Addition. The addition sy FW a°p Hall-Johnson % contains approximately 20,728 square feet and has �� a I approximately 160 feet of frontage along East Dallas ' T- Road. m Glade Rd. REQUESTED SPECIAL USE AND COMMENTS: The applicant is requesting a special use permit to allow the development of a church. Cowboy Heritage Church intends to relocate to subject site and occupy the existing building on a temporary basis, possibly up to two years, until a permanent location is acquired. The proposed site will utilize the existing 2,672 square foot building, seating 93 persons and providing 31 parking spaces. If approved this will be the first reading of an ordinance given the subject site requires approval of variances and a special exception respectively, relative to lot depth, minimum open space, maximum impervious area, landscaping and parking within the landscape setback area. These items will be heard before the Board of Zoning Adjustment at their December 6, 2010 meeting. If approved by the Board the second reading will occur at the Council's December 21, 2010 meeting. 0:IZCU/SU10-10.4 1 November 5,2010(1 IMAM) PRESENT ZONING AND USE: The property is currently zoned "LI" Light Industrial District and is developed with an unoccupied building. HISTORY OF TRACT AND SURROUNDING AREA: The subject property and the adjacent properties to the west and north were rezoned from "1-2" Heavy Industrial District to "LI" Light Industrial District in the city-wide rezoning of_ 1984. A conditional use permit (CU97-53) allowing outside storage in conjunction with a truck and van leasing facility was approved for the property to the north at the November 18, 1997 joint public hearing. The property to the east was rezoned from 1-1" Light Industrial District to "LI" Light Industrial District in the city-wide rezoning of 1984 and is the former site of the Super Shuttle transportation service. The property to the South was rezoned from "1-2" Heavy Industrial District to "LI" Light Industrial District in the city-wide rezoning of 1984. At the November 21, 2000 meeting a revised conditional use permit (C000-63) was approved on the property to the north allowing outside storage in conjunction with a truck leasing business. At the December 18, 2002 SPRC meeting, conditional use permit(CU02-59)was approved on the site to the south to replace signage. At the April 18, 2006 meeting, conditional use permit(CU06-06)and planned development overlay (PD06-04) was approved on the property to the east establishing the site for the Faith Christian School high school expansion in addition to ball field light standards which exceeded the maximum permitted height. At the April 17, 2007 meeting, conditional use permit(CU07-09)was approved on the on the property to the east to modify the site Layout and elevations of the proposed facility. This .approval also outlined the applicant's intention to phase construction under one roof, with the athletic,. performing arts facilities and classrooms contained in the first phase and subsequent phases for additional classrooms and a football stadium. At the December 12, 2007 SPRC meeting, conditional use permit (CU07-38)was approved on the site to the east for the addition of two exterior staircases, a porte cochere, plus a condition of approval was added for 85 additional parking spaces to be located due north of the existing building in order to receive a Certificate of Occupancy for the 800 seat auditorium. At the July 21,2009 meeting,conditional use permit CU09-16 (Ord. 2009-27)and planned development PD09-04 (Ord. 2009-28)were approved on the site to the east to relocate portable buildings (for classrooms)from Worth Street and for a deviation to the masonry requirement for the portable buildings. Few activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal is not an appropriate use. in this noise zone. MASTER PLAN APPLICATION: The Master Plan designates the subject property as an Industrial/Commercial land use. The applicant's proposal is in compliance with the Master Plan. At the present time this location is being tested on a monthly basis to ensure that there is no indication of fuel leakage from the previous use a garage and gas station. It is our understanding that this testing will go on for another two year to prove that there is no petroleum products remaining from the prior use. It is also our understanding that the property owners are considering tearing down the existing structure and replacing it with a yet to be determined new building. No new buildings or additions are planned by our church at this location. Substantial clean up work of weeds, brush etc has already been started at the site. The previous tenants left behind trash and other debris that has been removed. The interior concrete floor has been ground down to eliminate the uneven surface and remove old bolts from the previous racks and lifts. Holes in the walls and roof will be repaired. Heating an air conditioning will reinstalled. Electrical system will be repaired to restore lighting. No harm will be caused by the church occupying this property and the building will be used a couple of evenings a week and services on Sunday. Dallas Road is a major thoroughfare but any traffic created by the church will be at off traffic hours. The property will be no longer used to store petroleum and other chemicals as it was in the past. We were notified by the City's Development Services that the property would need to be replatted and the survey corrected and brought up to date. This has been completed by PEISER Surveying Company that occupies the building to the west of our proposed property at 623 E Dallas Road Grapevine TX 76051. adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street locating spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health and the general welfare; effect on light and air; the effect on the overcrowding of the land; the effect on the concentration of population; the effect on the transportation, water, sewerage, schools, parks and other facilities; and WHEREAS, the City Council of the City of Grapevine, Texas at a public hearing called by the City Council of the City of Grapevine, Texas did consider the following factors in making a determination as to whether this requested special use permit should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 49 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS,the City Council further considered among other things the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings, encourage the most appropriate use of land throughout this city; and WHEREAS, the City Council of the City of Grapevine, Texas does find that there is a public necessity for the granting of this special use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved propertywith reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas does find that the special use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population,facilitates the adequate provisions of transportation,water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas has determined that there is a necessity and need for this special use permit and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified; and,therefore,feels that the issuance of this special use permit for the particular piece of property is needed, is called for, and is in the best interest of the public at large., the citizens of the City of Grapevine, Texas, and helps promote the general health, safety, and welfare of this community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: ORD. NO. 2 Section 1. That the City does hereby issue a special use permit in accordance with Section 49 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of the City Code, by granting Special Use Permit SU10-10 to allow a church (Cowboy Heritage Church) in a district zoned "LI" Light Industrial District with a special use permit for a church under City of Grapevine Ordinance No. 82 -73 within the following described property: proposed to be platted as Lot 2, Block 1, W.B. Trigg Grocery Addition (701 East Dallas Road), all in accordance with a site plan approved pursuant to Section 49 of Ordinance No. 82-73, attached hereto and made a part hereof as Exhibit "A", and all other conditions, restrictions, and safeguards imposed herein, including, but not limited to, the following: None. Section 2. That the City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas to reflect the herein special use permit. Section 3. That in all other respects, the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability forthe particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. That this ordinance shall be cumulative of all other ordinances of the City of Grapevine,Texas affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and.that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00)and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. That this ordinance shall become effective from and after the date of its final passage.
