SUBJECT: SLOPE EASEMENT AND TEMPORARY DRAINAGE AND CONSTRUCTION EASEMENT ABANDONMENT — LOT 1, BLOCK 1, FELLOWSHIP OF THE PARKS ADDITION RECOMMENDATION: City Council consider adopting an ordinance abandoning a 30 foot wide slope easement adjacent to Hall Johnson Road and a 26 foot wide temporary construction and drainage easement on Lot 1, Block 1, Fellowship of the Parks Addition, and take any necessary action. BACKGROUND: The owner of Lot 1, Block 1, Fellowship of the Parks Addition has requested the City to abandon and vacate the two easements to facilitate the construction of a new church on the undeveloped site. The slope easement was acquired during the construction of Hall-Johnson Road by the developer of Saybrooke Addition in 1990 and the temporary drainage and construction easement was acquired by the City for the construction of the Hall Johnson Outfall Sanitary Sewer line in 1984. Abandonment of the easements poses no negative impact to City facilities. Staff has reviewed the request and has no objections. Staff recommends approval. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ABANDONING AND VACATING THE PUBLIC'S RIGHTS IN A CERTAIN TEMPORARY CONSTRUCTION AND DRAINAGE EASEMENT AND A SLOPE EASEMENT LOCATED ON LOT 1, BLOCK 1, FELLOWSHIP OF THE PARKS ADDITION TO THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the property owner of Lot 1, Block 1, Fellowship of the Parks Addition, Grapevine, Tarrant County, Texas has requested that a 30 foot wide slope easement adjacent to Hall-Johnson Road and a 26 foot wide temporary construction and drainage easement located in the western half of the subject lot, as herein after described be abandoned and vacated; and WHEREAS, the easements are not needed for City use and will not be needed in the future for City use; and WHEREAS, abandoning and vacating said easements will relieve the City of Grapevine, Texas from the.cost and expense of maintaining said property. NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS. Section 1. That all matters stated in the preamble of this ordinance are true and correct and are hereby incorporated into the body of this ordinance as if copied in their entirety. Section 2, That the City of Grapevine's rights in the 30 foot wide slope easement bordering Hall-Johnson Road, recorded in Volume 9938, Page 264, Deed Records,Tarrant County, Texas and the 26 foot wide temporary construction and drainage easement located in the western half of Lot 1, Block 1, Fellowship of the Parks Addition, recorded in Volume 8272, Page 508, Deed Records,Tarrant County,Texas, depicted in Exhibits"A"& "B" attached hereto and incorporated herein for all purposes, are hereby abandoned and vacated for City use and the same are hereby abandoned and vacated insofar as all City right, title, interest in and to said easements are concerned. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection,word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 4. That the fact that the easements are no longer needed by the public for public usage and would create a hardship or burden upon the City of Grapevine to keep open and maintain such easement creates an urgency and an emergency for the immediate preservation of the public health, safety, and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
