REVIEW 25th ANNUAL MAIN STREET DAYS ACTIVITIES Director of Festivals and Events Gayle Hall reviewed the schedule of events for the 25th Annual Main Street Days — Ultimate Backyard Experience to be held on May 15, 16 and 17, 2009. There was no formal action taken by the City Council. ITEM 2. DISCUSS STATEWIDE DATABASE FOR UNINSURED MOTORISTS Police Chief Eddie Salame advised that the Texas Department of Public Safety has created a database for uninsured motorists that would allow officers to check the insurance status of a car. Municipal Court records indicate that over 75% of citations issued for Failure to Maintain Financial Responsibility were dismissed, mostly because the drivers presented the Court with the required proof. Discussion ensued that the Police Chief would develop an administrative policy regarding towing of vehicles and report to the City Council at a later date. 05/05/09 There was no formal action taken by the City Council. EXECUTIVE SESSION Mayor Tate announced the City Council would conduct a closed session regarding: (A) conference with City Manager and Staff to discuss and deliberate commercial and financial information received from business prospects the City seeks to have locate and expand in the City; with which businesses the City is conducting economic development negotiations under Section 551.087, Texas Government Code. Upon reconvening in open session in the Council Chambers, Mayor Tate asked if there was any action necessary relative to the closed session. City Manager Bruno Rumbelow stated there was no action necessary relative to conference with City Manager and Staff under Section 551.087, Texas Government Code. Presentation by Rick and Donna Lawlis, Chairpersons of the 25th Annual Main Street Days. CITIZEN COMMENTS NEW BUSINESS 2. Consider on ordinance providing for the issuance of City of Grapevine, Texas Combination Tax and Revenue Certificates of Obligation, Series 2009, in the approximate principal amount of $8,995,000.00; awarding the sale of said certificates; levying a tax in payment thereof, prescribing the form of said certificates, approving the official statement; and take any necessary action. 3. Consider approval of a Local Government Funding Agreement with TxDOT for Grapevine's funding participation in right of way acquisition for State Highway 121 and take any necessary action. 4. Consider an ordinance amending the Grapevine Code of Ordinances, Chapter 8 Courts and Criminal Procedure relative to the term of the Municipal Court Judge, providing for the reappointment of the current Judge and take any necessary action. CONSENT AGENDA Consent items are deemed to need little Council deliberation and will be acted upon as one business item. Any member of the City Council or member of the audience may request that an item be withdrawn from the consent agenda and placed before the City Council for full discussion. Approval of the consent agenda authorizes the City Manager, or his designee, to implement each item in accordance with Staff recommendations. 5. Consider the Third Addendum to the Convention Development & Marketing Agreement with Opryland Hotel Texas Limited Partnership relative to the hotel expansion. Public Works Director recommends approval. 6. Consider approval of an Adopt-An-Area agreement with Girl Scout Troop#1435 for Kimball Road,from Silvercrest Lane to Lake Grapevine and the C. Shane Wilbanks Trail, from Snakey Lane to Silvercrest Lane and an Adopt-An-Area agreement with the Grapevine Disc Golf Association for the Bear Creek Disc Golf Course in Bear Creek Park. Parks & Recreation Advisory Board and Parks & Recreation Director recommends approval. 7. Consider the minutes of the April 21, 2009 City Council meetings as published. City Secretary recommends approval. ITEM 1. PRESENTATION, 25TH ANNUAL MAIN STREET DAYS OUTDOOR ADVENTURE Rick and Donna Lawlis, Chairpersons of the 25th Annual Main Street Days Ultimate Backyard Experience, highlighted the family fun and traditional activities planned for May 15th, 16th and 17th. ITEM 2. ORDINANCE, COMBINANTION TAX AND REVENUE CERTIFICATES OF OBLIGATION, SERIES 2009 Administrative Services Director John McGrane recommended approval of an ordinance providing for the issuance of City of Grapevine, Texas Combination Tax and Revenue Certificates of Obligation, Series 2009, in the approximate principal amount of $8,995,000.00; awarding the sale of said certificates; levying a tax in payment thereof, 05/05/09 prescribing the form of said certificates, approving the official statement; and take any wwww necessary action. Mr. McGrane recommended award of the bid to the lowest bidder, Wachovia Securities LLC, at a rate of 4.139486%. He advised that the Certificates of Obligation would by used to purchase equipment in the amount of$1,633,060.00 and for the balance of the cost for the Convention & Visitors Bureau building in the amount of $7,285,000.00. Council Member Coy, seconded by Council Member Spencer, offered a motion to adopt the ordinance for the issuance of $8,995,000.00 Certificates of Obligation as recommended. APPROVE LOCAL GOVERNMENT FUNDING AGREEMENT, TXDOT, STATE HIGHWAY 121 RIGHT OF WAY Public Works Director Matt Singleton recommended approval of a Local Government Funding Agreement with TxDOT for Grapevine's funding participation in right of way acquisition for State Highway 121 in northeast Grapevine in an amount of $ 495,300.93 and authorization for the City Manager to execute the agreement. Phase I I is critical to re- establish the full access to Grapevine Mills and the surrounding commercial areas. The $150+ Million Roadway project, when completed, will provide three main lanes and three service road lanes in each direction and should serve the area well for years to come. TxDOT requires that local governments provide 10% of the funding for these projects. The estimated cost of right of way on the Grapevine side of the project is $6.4 Million. Dallas County has committed $154,699.07 in funds which represents approximately 24% of the local share with the balance of$495,300.93 being the responsibility of Grapevine. ORDINANCE, AMEND CHAPTER 8 COURTS AND CRIMINAL PROCEDURE, TERM OF MUNICIPAL COURT JUDGE Administrative Services Director McGrane recommended approval of an ordinance amending the Grapevine Code of Ordinances, Chapter 8 Courts and Criminal Procedure relative to changing the term of the Municipal Court Judge from four years to two years and providing for the reappointment of the current Judge, David Florence, for a two year term effective May 5, 2009. Motion by Council Member Freed, seconded by Council Member Spencer, to approve the ordinance as recommended prevailed by the following vote: Ayes: Tate, Wilbanks, Spencer, Stewart, Freed, Lease & Coy Nays: None ORDINANCE NO. 2009-15 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING THE GRAPEVINE CODE OF ORDINANCES, CHAPTER 8 COURTS AND CRIMINAL PROCEDURE RELATIVE TO THE TERM OF APPOINTMENT FOR THE MUNICIPAL COURT JUDGE; REAPPOINTMENT OF THE CURRENT MUNICIPAL COURT JUDGE FOR A TWO (2) YEAR TERM; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY;AND PROVIDING AN EFFECTIVE DATE CONSENT AGENDA The next order of business for the City Council to consider was the consent agenda items, which were deemed to need little or no discussion and were acted upon as one business item. Mayor Tate asked if there was any member of the audience or the City Council who wished to remove an item from the consent agenda for full discussion. There were none. Item 5. Third Addendum, Convention Development & Marketing Agreement, Opryland Hotel Texas Limited Partnership Public Works Director recommended approval of the Third Addendum to the Convention Development & Marketing Agreement with Opryland Hotel Texas Limited Partnership to extend the required commencement date for the hotel expansion from September 12, 2009 to September 12, 2012 and to extend the renewal date of the option for Parcels 5 and 7 to September 12, 2012. 3 05/05/09 Motion by Council Member Lease, seconded by Council Member Wilbanks, to approve as recommended prevailed by the following vote: Ayes: Tate, Wilbanks, Spencer, Stewart, Freed, Lease & Coy Nays: None Item 6.
