SUBJECT: APPROVAL OF A RESOLUTION FOR THE PURCHASE AND
INSTALLATION OF A PRECAST RESTROOM FACILITY
THROUGH AN ESTABLISHED COOPERATIVE AGREEMENT
WITH THE STATE OF TEXAS TXMAS PURCHASING
PROGRAM
RECOMMENDATION:
City Council to consider a resolution to purchase and install a precast concrete restroom
facility to be located at Pickering Park from CXT Precast Products through an
established cooperative agreement with the State of Texas TXMAS purchasing program.
FUNDING SOURCE:
Funding for this purchase is currently available in account 121-48840-312-12-000016
(Council Quality of Life Fund/Buildings/Parks and Recreation 2012 Projects) in the
amount not to exceed $43,998.74.
BACKGROUND:
This purchase will be made in accordance with an existing Cooperative Agreement with
the State of Texas TXMAS Purchasing program as allowed by Texas Local Government
Code, Section 271.082 and 271.083, State Cooperative Purchasing Program.
The proposed restroom facility for Pickering Park was one of the projects the Council
discussed at the March 6, 2012 workshop on Quality of Life expenditures. A restroom at
Pickering Park would be a great amenity for the park as there is a nice group picnic
pavilion in the park and the park is also the host of youth baseball and soccer practices.
The park also has a nice loop hike and bike trail.
The Council Facilities Committee has selected split face block as the exterior finish for
the restroom facility. The color of the split face block will match the color of the rock
columns of the picnic pavilion in the park. The color of the roof of the restroom facility
will be dark green to match the color of the pavilion roof.
Bids were taken by the Cooperative and a contract was awarded to CXT Precast
Products under contract TXMAS-5-560100. Parks and Recreation staff reviewed the

contract for specification compliance and pricing and determined that the contract would
provide the best product and pricing for meeting the needs of the City. The Cooperative
Purchasing Agreement satisfies all bidding requirements under the Texas Local
Government Code.
Staff recommends approval.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE,TEXAS,AUTHORIZING THE CITY MANAGER
OR THE CITY MANAGER'S DESIGNEE TO PURCHASE A
PRECAST RESTROOM FACILITY THROUGH AN
ESTABLISHED STATE COOPERATIVE CONTRACT AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of Grapevine, Texas is a local government in the State of
Texas and as such is empowered by the Texas Local Government Code, Section 271.082
and 271.083 to purchase an item under state contract therefore satisfying any state law
requiring local governments to seek competitive bids; and
WHEREAS, the State of Texas TXMAS Purchasing program is a qualified
purchasing cooperative program as authorized by Section 271.082 and 271.083 of the
Texas Local Government Code; and
WHEREAS, the City of Grapevine, Texas, has established a Cooperative
Agreement with the State of Texas, # M2201 and wishes to utilize a contract meeting all
State of Texas requirements; and
WHEREAS, the State of Texas TXMAS program has an established contract #
TXMAS-5-560100 with CXT Precast products for concrete buildings.
NOW,THEREFORE, BE 11 IF RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the above preamble are true and correct and
are incorporated herein as if copied in their entirety.
Section 2. That the City Council of the City of Grapevine authorizes the purchase
of a precast restroom facility from CXT Precast Products for a total cost not to exceed
$43,998.74.
Section 3. That the City Manager, or his designee, is authorized to take all steps
necessary to consummate the purchase of said restroom facility.
