Q9 &S 7 _ L_ I FROM: RON STOMBAUGH, ASSISTANT DIRECTOR, DEVELOPMENT SERVICES • Staff recommends the Site Plan Review Committee consider the proposed change to conditional use request CU18-19 (Ord. 2018-64) approved at the August 21, 2018 meeting to amend the previously approved site plan for a planned commercial center developed as an office complex along with a convenience store with gasoline sales, off - premise beer and wine sales, outside dining, and a car wash, specifically to reduce building separation between two single story office structures, and take any other action necessary. Conditional use request CU18-19 was considered and approved at an August 21, 2018 public hearing and allowed for the creation of a planned commercial center on an 11.3- acre tract of land at the northeast corner of East Northwest Highway and Boyd Drive. Within the planned commercial center, a 3.3-acre portion located at the northwest corner of East Northwest Highway and Ruth Wall Road is to be developed as a convenience store with gasoline sales, off -premise beer and wine sales, outside dining and a car wash; the remaining eight acres with frontage along Boyd Drive and East Northwest Highway will be developed as a multi -phased office complex. With this request the applicant proposes a reduction in the building separation between two structures located at the northwest corner of the site (805 and 809 East Northwest Highway). Previously approved at a separation of 40 feet, the applicant proposes a reduction of 14 feet, resulting in a building separation of 26 feet when constructed. The reduction is necessary to accommodate square footage for the structure addressed at 805 East Northwest Highway for a software company that intents to purchase both structures. The zoning ordinance allows as part of the planned commercial center designation a reduction in building separation below the 40-foot requirement and this reduction creates no conflict with building code requirements. The increase in square footage for the new structure is negligible (an increase of ten square feet from 4,952 to 4,962 s.f.). After a brief discussion, Larry Oliver moved to approve special use application SU20-01.
