SUBJECT: APPROVAL OF A RESOLUTION FOR THE PURCHASE OF
THOR GUARD LIGHTNING PREDICTION AND WARNING
SYSTEMS FOR PARR PARK, BEAR CREEK PARK, DOVE
PARK, AND PICKERING PARK FROM THOR GUARD INC.
AND CONSIDER THEM A SOLE SOURCE VENDOR
RECOMMENDATION:
City Council to consider approval of a resolution for the purchase of Thor Guard lightning
prediction and warning systems for Parr, Dove, Pickering, and Bear Creek Park from Thor
Guard, Inc., a sole source vendor.
FUNDING SOURCE:
Funds for this purchase are available in account 121-42281-312-12-000015 (Council
Quality of Life) for the amount not to exceed $34,855.00
BACKGROUND INFORMATION:
This procurement will be made as a sole source in accordance with Local Government
Code Chapter 252, Subchapter B, Section 252.022 (A) (7) (A).
The Parks and Recreation Department determined that the addition of these four additional
lightning prediction systems will provide coverage to all parks and integrate well with the
other Thor Guard systems in Grapevine where organized youth sport activities are currently
scheduled. Oak Grove Soccer, Softball, Baseball, and Meadowmere Park currently have
these lightning prediction systems.
Thor Guard, Inc. is the sole source manufacturer and provider of Thor Guard lightning
prediction and warning systems. The quote is attached for review.
Staff recommends approval.

of the THOR GUARD lightning Prediction and Warning Systems. As a matter of fact,
THOR GUARD is the only company that manufactures a true, site-specific lightning
prediction system in the world. Our products are manufactured in Sunrise, Florida.
THOR GUARD products are 'designed and operate through the use of our
proprietary technology. Our Patent and Trademark numbers are 4,095,221 and
2,390,039, respectively. THOR GUARD has not given any other company the right to
manufacture our products
We look forward to the opportunity to furnish and install our systems at your
facility.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, AUTHORIZING THE CITY MANAGER
OR THE CITY MANAGER'S DESIGNEE TO DECLARE THOR
GUARD INC. A SOLE SOURCE PROVIDER FOR THOR
GUARD LIGHTNING PREDICTION AND WARNING
SYSTEMS AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of Grapevine, Texas is a local government in the State of
Texas and as such is empowered by the Texas Local Government Code Chapter 252,
Subchapter B, Section 252.022 (a) (7) (A) to consider items available from only one
source as an exception to the bidding requirements of the State of Texas; and
WHEREAS, Thor Guard, Inc. is the sole distributor of Thor Guard lightning
prediction and warning systems; and
WHEREAS, the City of Grapevine Parks and Recreation Department has a need to
purchase Thor Guard lightning prediction and warning systems for Dove Park, Pickering
Park, Parr Park, and Bear Creek Park.
NOW, THEREFORE, BE IT RESOLVED BYTHE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the above preamble are true and correct and
are incorporated herein as if copied in their entirety.
Section 2. That the City Manager, or his designee, is authorized to take all steps
necessary to purchase Thor Guard lightning prediction and warning systems for Dove
Park, Pickering Park, Parr Park, and Bear Creek Park from Thor Guard, Inc. in the total
annual amount of$34,855.00.
Section 3. That this resolution shall take effect from and after the date of its
passage.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 6th day of March, 2012.
