EXECUTIVE SESSION ' Mayor Tate announced the City Council would conduct a closed session regarding [A] pending or contemplated litigation (relative to Dallas/Fort Worth International Airport Board's decision relative to proposed Runway 16/34 West) , [B] real estate (relative to right-of-way acquisition on Mustang Drive) , and [C] personnel (relative to City Manager position) under amendments to Article ; 6252-17, V.A.T.C. S. , Subsections 2 (e) , 2 (g) and 2 (f) . Upon reconvening in open session in the Council Chambers, Mayor Tate asked if there was any action necessary relative to the closed session. Interim City Manager Petty stated there was no action necessary relative to [A] pending or contemplated litigation (relative to Dallas/Fort Worth International Airport Board's � decision relative to proposed Runway 16/34 West) under amendments to Article 6252-17, V.A.T.C. S. , Subsection 2 (e) . , Regarding [B] real estate (relative to right-of-way acquisition on Mustang Drive) , Mr. Petty requested authorization for Staff to submit a final offer for Parcel 6 designated on the Mustang Drive right-of-way map and approve a resolution initiating eminent domain � € 09�15�92 ' � proceedings, if necessary. PRESENTATION, PLAQUE OF APPRECIATION, MR. GERALD THOMPSON Mayor Tate presented a Plaque of Appreciation to former Board of Zoning Adjustment Member, Mr. Gerald Thompson, who served on the Commission from June 1979 to June 1992 . Community Development Director H. T. Hardy advised Conditional Use Application CU92-12 had been submitted by Modernage, Inc. dba ; Grady's American Grill requesting a waiver to specific requirements ' � of Section 47E. 2 pursuant to Section 47F of Ordinance No. 82-73, as amended, and requesting a conditional use permit for an amendment to a site plan approved by Ordinance No. 92-14 by changing the i' location of the bar area and changing the windows and doors on the building elevations. ' Ms. Kim Woodard, representing Brinker International, addressed the City Council and the Planning & Zoning Commission requesting favorable consideration of the application. She noted the bar area had been relocated from the front of the restaurant to the right side of the building. There were no questions from the City Council and the Planning & Zoning Commission. Mayor Tate invited guests present to comment ; regarding the conditional use application. PUBLIC HEARING, ZONING APPLICATION Z92-04 AND CONDITIONAL ' USE APPLICATION CU92-14j MR. JAMES F. MASON Mayor Tate declared the public hearing open. Community Development Director H. T. Hardy advised Zoning ; Application Z92-04 and Conditional Use Application CU92-14 had been j filed by Mr. James F. Mason requesting rezoning of 3 . 734 acres from ; i � 2 09/15/92 "GU" Governmental Use District and "PID" Planned Industrial Development District to "CC" Community Commercial District Regulations. The zone change request would allow development of an 18.230 acre tract located at the northeast intersection of William D. Tate Avenue and the south frontage road of State Highway 114. Mr. Hardy reported Conditional Use Application CU92-14 was filed requesting a waiver to specific requirements of Section 47E.2 pursuant to Section 47F of Ordinance No. 82-73, as amended, and requesting a conditional use permit for a Planned Commercial Center on 18.230 acres and to allow a forty (40' ) foot pole sign and the possession, storage, retail sale and on-premise consumption of alcoholic beverages (beer, wine and mixed beverages) in conjunction with the operation of a restaurant on Lot 1, Block 1, The CrossRoads of DFW Addition. Mr. Hardy advised a 7, 136 square foot restaurant (Outback Steakhouse) with a maximum occupancy of 272 persons will be developed on Lot 1. The restaurant meets the new parking standards of one (1) space for every 3 (three) persons, which requires 91 parking spaces. Mr. Euless Lane, of Weir & Associates, Inc. , addressed the City Council and Planning & Zoning Commission requesting favorable consideration of the zoning application and conditional use application. Discussion ensued relative to the location of Crossroads Drive to Mustang Drive (373 feet from the intersection of William D. Tate Avenue and Mustang Drive) . Mr. Hardy advised , the proposed drive cuts on Crossroads Drive are in compliance with the Driveway Standards and that the proposed drive cut on the South Frontage Road of State Highway 114 is being reviewed by the Texas Department of Transportation. Mayor Tate invited guests present to comment regarding the zoning application and the conditional use application. No one wished to speak and there was no correspondence to report. Commissioner Young, seconded by Commissioner Freed, offered a motion to close the public hearing. COUNCIL OF GOVERNMENT TRANSPORTATION COUNCIL Council Member Wilbanks reported that funding for streets and roads are now being taken before a Council of Government subcommittee and then another committee makes a recommendation to the State Department of Transportation. There are three areas for funding: roads, intersections and enhancements (bike trails, etc. ) ; Grapevine was fortunate that funding was included for ; Northwest Highway improvements. Also, $500, 000. 00 was s funded for parks and trails. Funding for the flyovers � for Farm-to-Market Road 2499 and State Highway 121 were � not included in this year. The committee agreed to perform a transportation study showing all roads leading ; into Grapevine. Mr. Wilbanks reported projects will be ; reviewed by the subcommittees and monies reallocated ' every year. , ITEM 31. GRAPEFEST UPDATE Foundation Director Ron Emrich stated over 50, 000 people attended GrapeFest and that f inal f igures are still being tallied. He expressed appreciation to all the Council # for their efforts in making GrapeFest a success. ; i ITEM 32.
