Boyle, Jr. City Attorney Linda Huff City Secretary � I I ' , CALL TO ORDER ( { Mayor Pro Tem Ware called the meeting to order at 7: 50 p.m. ITEM 1. ORDINANCE AMEND ORDINANCE NO. 92-02 MUNICIPAL BOND ELECTION City Manager Mark S. Watson requested the City Council consider an ordinance amending Ordinance No. 92-02 (calling the Municipal Bond Election) to reflect the entire City as one voting district for the City election and amend Proposition No. 3 to state "City Hall Bonds" instead of Municipal Administrative Services Building Bonds. Mr. Watson reported that due to redistricting, there had been three (3) new precincts created by Tarrant County. Also, the wording for Proposition 3 - Municipal Administrative Services Building - referred to the Fire Station and City Hall as being one proposition; therefore, the reason for the request to amend the ordinance. Council Member Wickman requested the City Council discuss , Proposition 1 Street Improvements relative to the Pool Road/Hall- Johnson Road widening project. City Attorney John F. Boyle, Jr. advised the wording for the agenda was specific and limited , discussion to the precinct issue and wording of Proposition 3 . ' The caption of the proposed ordinance was read into the record. o2/ii/9a Council Member Spencer, seconded by Council Member Pittman, made a motion to adopt the ordinance as recommended. The motion prevailed by the following vote: Ayes . Ware, Spencer, Wilbanks, Traverse, Pittman & Wickman Nays . None Absent: Tate ORDINANCE NO. 92-07 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING ORDINANCE 92-02 CALLING A BOND ELECTION TO BE HELD WITHIN THE CITY, MAKING PROVISIONS FOR THE CONDUCT OF THE ELECTION AND OTHER PROVISIONS INCIDENT AND � RELATED TO THE PURPOSE OF THIS ORDINANCE; AND i' DECLARING AN EMERGENCY , RECESS AND RECONVENE � Mayor Pro Tem Ware announced the City Council would take a brief recess. Upon reconvening in the Council Chambers, all members of the City Council were present. i i I. , { ITEM 2 . WORKSHOP, APPEALS AND REVIEW BOARD f City Manager Mark S. Watson reviewed information prepared by City ; Staff and the City Attorney relative to the processes of an Appeals � and Review Board. He presented a survey of nine cities regarding ° number of inembers, qualifications, appointment, appealable � discipline and limits of authority. Mr. Watson presented two � options to the City Council for discussion: (1) advisory only, and � (2) final authority. City Attorney John F. Boyle, Jr. reviewed the alternatives developed by City Staff. The make-up and jurisdiction of both proposed boards would be the same: five (5) members appointed by the vote of at least four (4) members of the City Council for a two (2) year staggered term, resident of the City for a minimum of three (3) years preceding appointment, shall not have held an elective or appointive office with the City of Grapevine for a two (2) year period immediately preceding appointment, and may be removed by four (4) members of the City Council at will. � Jurisdiction of either board would be for terminations or suspensions of 15 days or more. Both proposed boards would have identical power to subpoena witnesses, records and other materials. Each board would develop written procedures for conducting hearings that have been approved by the City Attorney and the City Council. The board would cover all City employees, with the exception of the City Manager. 2 : 02/11/92 . Mr. Boyle reviewed the specifics of the Appeals And Review Board - Advisory Only - stating that its function would be in an advisory capacity to the City Manager and would be convened for all appeals � by an employee to the City Manager requesting reversal of a decision made to terminate or for suspension or 15 days or more. Mr. Boyle reported that an Appeals and Review Board - Final Authority - would function as an Appeals and Review Board for all decisions of the City Manager for termination or suspension of an ' employee for 15 days or more. The only alternatives available to I i the Final Authority Eoard would be to determine whether the City Manager's decision should be sustained or reversed and the Board's 'I � decision would be final. i I � Discussion ensued regarding the proposed appeals board's functions ; and qualifications. The hearings would be conducted like a trial, and a lawyer would be best qualified to serve as the Chairman of ' � the Board. There would possibly be attorneys present on behalf of � � the employee. Comments were made relative to requiring a minimum ! age of 30 years and five (5) years of residency for board members. � i During deliberation, Mr. Boyle reported the advisory board could be � created by resolution/ordinance without a charter amendment, ' whereas the final authority board would require a charter ; � amendment. There was no formal action taken by the City Council. It was the � consensus of the City Council that Staff and the City Attorney prepare documents for consideration on the Appeals and Review Board ifor the next City Council meeting. 1 ADJOURNMENT � Council Member Spencer, seconded by Council Member Wilbanks, made a motion to adjourn at 9: 15 p.m. The motion prevailed by the ' � following vote: �� , �I Ayes: Tate, Ware, Spencer, Wilbanks, Traverse, Pittman & Wickman ; !
