PUBLIC HEARING, RED BIRD LANE EASEMENT Mayor Tate declared the public hearing open. City Manager Mark S. Watson stated the public hearing was being conducted relative to a pending request by property owners for a partial abandonment of an existing 50 ' easement located on Lot 1, Block 2 of Grapevine Lake Estates, adjacent to Red Bird Lane. Residents in the area petitioned the City objecting to the connection of the western portion of Red Bird Lane (in the Placid Peninsula Addition) to the eastern portion of Red Bird Lane (in Grapevine Lake Estates) by use of the right-of-way easement through Lot 1, Block 2 of Grapevine Lake Estates to provide accessibility to Lots 4, 5, and 6 of Block 2 in Grapevine Lake Estates. The potential developer of Lots 4, 5 and 6 has requested the lots be accessed from the east through Lot 1, Block 2 of Grapevine Lake Estates. , - i � � 04/02/91 � 6 s i j Mayor Tate then invited guests present to comment regarding the ; requested easement abandonment. i iMr. Norris Palmer, 3547 Red Bird Lane, addressed the City Council on behalf of residents concerned with the proposed connection of a thoroughfare between Red Bird Lane East and Red Bird Lane West. i Mr. Palmer requested the City Council consider the abandonment of � a portion of the easement that runs north and south to the west of Ms. Cheryl Brown's property (Lot 1, Block 2 of Grapevine Lake Estates) , a portion of Red Bird Lane East that runs east and west of Mr. and Mrs. Palmer's property (Lot 9, Block 1 of Grapevine � Lake Estates) and Lot 9A, Block 1 of Grapevine Lake Estates, a � City owned tip of land west of Red Bird Lane East. He presented � a petition containing 67 signatures of area residents supporting � the proposal and stated the petitioners were not requesting to � eliminate a legal and justifiable approach to Lots 4, 5, and 6, � Block 2 of Grapevine Lake Estates, or alter the current platting of the lots, or to effect a decrease in the value of the lots; � but requesting approval of abandoning a part of the easement and � a portion of Red Bird Lane East along Lot 9A, Block 1 of � Grapevine Lake Estates. If the request is approved, the neighborhood's concern with the possible connection of Red Bird Lane East and Red Bird Lane West would be settled. Residents in the area believed the easement, as it exists now, had been � abandoned and there was no intent from the City to connect Red Bird Lane East and Red Bird Lane West. Mr. Palmer stated the residents did not have any desire to restrict in any way the sale or purchase of Lots 4, 5, and 6, Block 2 of Grapevine Lake Estates. He presented slides and schematics depicting the east and west entrances to the subject area noting that access from the west to the proposed development of Lots 4, 5, and 6 is a developed and � dedicated roadway; whereas, access from the east to the subject � lots would require considerable expansion and improvements. � He stated the citizens' basis for the request of the partial abandonment of the easement lying between Red Bird Lane East and � Red Bird Lane West and abandonment of Lot 9A, as well as a � partial abandonment of Red Bird Lane East as follows: preservation of existing trees, prevention of potential drainage problems, preservation of neighborhood safety and protection of property values. He stated favorable action in this matter would � provide reasonable and substantial access to Lots 4, 5, and 6, ' and most importantly, it will be possible for the current owner of Lots 4, 5, and 6 to sell the land to be developed and ! alleviate the distress of the possible connection of Red Bird i Lane that defies all concerned. i � Mr. Robert Tatangelo, 3525 Red Bird Lane, stated his opposition to the proposed connection of Red Bird Lane East to Red Bird Lane � West and stated his support of the pedestrian walkway as it 2 04/02/91 � currently exists. He opposes the abandonment of the easement along Red Bird Lane East that would allow vehicular traffic through the Red Bird Lane West cul-de-sac to access Lots 4, 5, and 6. He reguested the City Council authorize permanent barricades on Red Bird Lane West to eliminate vehicular traffic from the west. He requested the public easements remain as they currently exist. Ms. Elva Tatangelo, representing Mr. Lance Sutter (property owner of Lots 4, 5, and 6, Block 2 of Grapevine Lake Estates) read the following letters into the record: ***************************************************************** April 1, 1991 2078 Santiago Way, North Clearwater, FL 34623 City of Grapevine City Council: In 1983 Sharon and I bought the property located at 3548 Redbird Lane including lots 4, 5, and 6 from Ed and Ruth Matheson. We purchased the property as our homestead and as an investment. The privacy and view of Lake Grapevine were real enticement and motivating factors for our purchase. We had considered buying Lot #9 to build our home, but upon checking with the City of Grapevine (I believe it was Mr. Baddiker) we were informed that the lot was too small to build on because of zoning requirements for setbacks from both the road and the lot lines. Being disappointed that we could not build on Lot 9, and yet also being satisfied that no one else would build on the lot, we purchased the property at 3548 Redbird. As you may know a short time afterwards Lot #9 was purchased and built upon by Norris Palmer. I remember distinctly the meeting in which the variance, which I vigorously opposed, was given to Mr. Palmer. I was extremely surprised that the variance was given as I was told before that that no house could be built on that particular lot. The basic effect of the variance was a gift of free land to the Palmers. I had thought incorrectly that the zoning setbacks were created for a reason and was awakened rather rudely to the fact that variances to these zoning requirements are given out rather easily if one can prove a � "financial hardship" . 3 I, a � 04/02/91 � � s � � The financial hardship that was imposed upon my wife ! Sharon and I was never really considered. Our home once offered a serene setting with a fantastic view of sailboats sailing on Lake Grapevine. After the Palmers f built their ample-sized, two store house on an "unbuildable lot" our view was limited to BMW's and an ! occasional RV sailing by on Redbird. Though the � Palmers proved to be great neighbors and fine people, I ' feel that the building of their particular home on Lot j 9 created a financial hardship for our family. In j effect, it lowered the value of our house. As a matter '; of fact, after adding in the improvements we made to I our house and calculating the sale of the house to � Cheryl Brown this last May, we realized a loss of � between $15, 000 and $20, 000 when we should have � realized a gain of at least that amount. � It is now brought to my attention that another financial hardship could very easily be imposed on our � family and our investment in land in the City of � � Grapevine as a result of the potential of access being denied to lots 4, 5, and 6 from Redbird Lane off Oakwood. I have received a report that Mr. Palmer has requested the abandonment of this particular road so that he can have sole use of that property. It appears to me that Mr. Palmer in effect desires even more free ,.. land from the city that was given him with the variance � he received when he built on Lot #9. As in the past, this would be an obvious example of Mr. Palmer's gain and the Sutter family's loss. I humbly ask you to consider the financial hardship both � past and future to our family and allow access to lots � 4, 5, and 6 to Redbird Lane off Oakwood Drive. � fi � Sincerely, �� W. Lance Sutter ***************************************************************** � Honorable Mayor William Tate and Members of the � Grapevine City Council � Ref: Petition to abandon a portion of East Red � Bird Lane, and the fifty foot easement ; accessing Lots 4, 5, 6, Block 2 Grapevine � Lake Estates � I am Elva Tatangelo, the listing agent of Lots 4, 5, 6, Block 2, Grapevine Lake Estates. Prior to listing ( these lots, I visited with the City of Grapevine Engineering Dept. , to determine access to these lots � 4 04/02/91 via East Red Bird. I was informed that East Red Bird is in fact a dedicated city street, which adjoins a fifty foot public easement for direct access to the lots in question. At this time I expressed my concern about the "Private Drive" sign and the obvious landscaping encroachment on East Red Bird Lane. I was told that there was no way that an individual could legally encroach on a public street and deny access. Based on the information provided me by the city engineering department, I proceeded to market the property. As a licensed real estate broker for the last 9 years, it is my opinion that these lots in Grapevine Lake Estates are far more desirable with direct access through East Red Bird. Grapevine Lake Estates is a very desirable subdivision with many amenities including a private marina, and Lakeview Park. The lots in question are part of Grapevine Lake Estates and I don't think that the City Council should deny them this access. Thank you! � Elva Tatangelo ***************************************************************** Mr. Ralph Putnam, 3635 Oakwood Drive, stated his opposition to the vacation of a portion of Red Bird Lane East and a portion of the 50' easement of Lot 1, Block 2 of Grapevine Lake Estates. Mr. Putnam (proposed developer of Lots 4, 5, and 6, Block 2 of Grapevine Lake Estates) , expressed his opposition to the connection of Red Bird Lane East and Red Bird Lane West and requested access to the subject lots from Oakwood Drive as they were originally platted. He stated his proposal for access through the existing 50 ' easement would not require the removal of any existing oak trees if the roadway were limited to the average width of Oakwood Drive (18 ' ) , there would be no interference with the current natural drainage, there is no desire to increase lake traffic in the area, and new homes in the area would increase property values. He stated the subdivision, as platted, offers access to the lake, park and boat launching facilities. Ms. Ruth Sutphen, 3532 Red Bird Lane, stated her support of the requested easement abandonments as proposed by Mr. Norris Palmer. � Ms. Vicky Butler, 3543 Red Bird Lane, reviewed the history of the 50 ' easement over the past 40 years stating the basic long term issue over the years has been the preservation of these 5 04/02/91 � ' � neighborhoods and quality of life, not the connection of Red Bird Lane East and Red Bird Lane West. Ms. Butler read the following letter from Mr. Lance Sutter : (April 2, 1990) to the City's Public Works Department into the record: **************************************************************** I am writing again to request the steps necessary to vacate a portion of a road easement on property I own described as follows: Lot 1, Block 2 , Grapevine Lake Estates Addition, Section No. 1, an addition to the '� City of Grapevine, Tarrant County, Texas. According to j the plat thereof recorded in Volume 388-1 Page 38, of � the plat records of Tarrant County, Texas. � � I understand that the attached survey does not allow a a wide enough access off from Red Bird Lane. What I � would suggest is a 25 foot easement as indicated by the � yellow highlighted portion of the attached survey. I � ` will leave the 50 foot easement on lots 4, 5, and 6 ' (which we also own) alone to permit a turn around area � should the fire department require it. Twenty five 6 feet should be more than enough to service those lots �° as the Red Bird Lane on the north side (highlighted in � red) is only 13 feet wide. This particular section of I Red Bird services three residences. � � � This vacation of a portion of the easement would lessen � the hardship this particular easement now causes anyone � desiring to build on Lot 2 . � ; I appreciate your help with this matter. I i � Sincerely, � � Lance Sutter � 3548 Red Bird Lane c � ***************************************************************** � Ms. Butler commented that Mr. Sutter' s request -- an abandonment � of the northern portion of the 50 ' easement, proposing an access i from Red Bird Lane West along 25 ' through Lot 1 back to Lot 4 -- � is exactly (with engineering adjustments) what is currently ( requested. Ms. Butler explained that due to seasonal rains, City � Staff had not been able to adequately address the request for the � abandonment before Mr. Sutter sold property to Ms. Cheryl Brown. ; Ms. Butler presented documents that led residents in the area to believe the lots in question had been replatted to Lots iR and 2R, Block 2 of Grapevine Lake Estates and a copy of a petition 6 II � � 04/02/91 that had been submitted in 1982 objecting to Red Bird Lane becoming a thoroughfare to vehicles from Grapevine Lake Estates to Placid Peninsula. Ms. Butler also presented documents pertaining to Board of Zoning Adjustment Application No. BZA86-19 (April 3, 1986) filed by Mr. and Mrs. Norris Palmer relative to requested variances on Lot 9, Block 1 of Grapevine Lake Estates, which depicted the vacated 50 ' easement and the replat of Lots 1R and 2R, Block 2 of Grapevine Lake Estates. At that time, residents of the area questioned the connection of Red Bird Lane from the east to the west. Ms. Butler briefly reviewed the history from 1951 of the plats of Placid Peninsula and Grapevine Lake Estates and cited several individuals that had opposed the connection of Red Bird Lane from the east to the west. Ms. Butler ended her comments by stating the residents in the area do not want the two roads connected, nor a barricade on Red Bird Lane West. Ms. Cheryl Brown, 3548 Red Bird Lane, expressed her opposition to the possible connection of Red Bird Lane from the east to the west, requested favorable consideration of the requested abandonment of a portion of an easement through Lot 1, Block 2 and Lot 9A, Block 1 of Grapevine Lake Estates and a portion of Red Bird Lane East to provide access from the west to Lots 4, 5, and 6, Block 2 of Grapevine Lake Estates to maintain the safety, trees, and quality of life in the neighborhood. Ms. Karen Palmer, 3547 Red Bird Lane, spoke in favor of the requested abandonment in Grapevine Lake Estates for the betterment of the neighborhood and to settle an issue that has been recurring for over 40 years (possible connection of the two Red Bird Lanes) . Ms. Palmer read a statement from an appraisal by Ms. Brenda Taylor, Appraiser/Consultant, . . . "Accessibility is not as good as some other subdivisions in Grapevine; however, privacy appears to be a high priority in the area and any inconvenience is felt to be offset by the seclusion enjoyed by the property owners. Narrow asphalt streets without curbs and gutters add to the rustic atmosphere. Most of the lots are enhanced by native trees and some have a view of the lake. . . .however, it is my opinion that the extension of Red Bird Lane could have a negative impact on the properties that have frontage on the proposed road. The use and enjoyment could be diminished due to the lack of privacy and increased traffic created by the new road. " Ms. Palmer stated the proposed homes could be built on Lots 4, 5, and 6 with adequate access from the west and not ruin the neighborhood by the connecting of the two roads. Ms. Nancy LeBlanc, 3603 Grandview Drive, spoke in favor of the � requested abandonment to provide access from the west. Ms. Leslie Nelson, owner of Labrador Bay Estates, stated support of the abandonment as requested by Mr. Norris Palmer. 7 �! 04/02/91 i i i RECESS AND RECONVENE Mayor Tate announced the City Council would take a brief recess. All members of the Cit Council were resent u on reconvenin . Y P P g i Mr. Dennis Ground, 2408 Lake Shore, expressed his support for the re uested abandonment to q provide access from the west. . Mr. Rick Hampton, 2523 Anglers Drive, spoke in favor of the abandonment to maintain the integrity of the neighborhoods. Mr. Norris Palmer summarized the citizens' request for I abandonment: Lot 9A, Block 1 of Grapevine Lake Estates, a � portion of Red Bird Lane East and the northern portion of the existing easement be abandoned to the Palmer's and Brown's and � the two Red Bird Lanes not be connected. � Ms. Tatangelo summarized Mr. Sutter's request: provide access to � Lots 4, 5, and 6, Block 2 of Grapevine Lake Estates from Red Bird j Lane East through Oakwood Drive. � Mr. Putnam summarized his request: provide access to Lots 4, 5, � and 6, Block 2 of Grapevine Lake Estates from Red Bird Lane East, � do not abandon easements, and do not connect the two Red Bird Lanes. He stated that if access is provided from the west, the � marketability of the homes will be affected by restricting access ; to the lake, boat launching ramps and parks. � Council discussed the possibility of the developer using part of � Lot 9A, Block 1 of Grapevine Lake Estates to connect to the private easement of Red Bird Lane East to provide access to Lots 4, 5, and 6. Council discussion ensued relative to the City's current standards for public access easement for street � right-of-way which requires a minimum 31 ' street with back to i back curb and gutter. Discussion ensued relative to the trees that would be destroyed as result of the pavement through Red Bird Lane East. Council Member Wilbanks commented on the issue that a roadway � from the east running north and south along the cul-de-sac of Red Bird Lane West would create the possibility of the two Red Bird Lanes being joined. Access from the west appears to be the more direct, reasonable approach to the lots proposed to be developed as it provides direct accessibility to the remainder of the City, other than the lake, and best address the issues of the trees and road width. He stated he is not in favor of a total abandonment of the area requested and that the City retain a pedestrian/bicycle pathway through the area from the east. i Mayor Tate explained that access from the east to the lots in question would not be feasible as there was not enough right-of-way available through Red Bird Lane East to meet the �;: City's minimum standard of 31 ' . 8 I i 04/02/91 Council Member Spencer, seconded by Council Member Wilbanks, made a motion to close the public hearing. Boyle, Jr. advised the City owns the title to Lot 9A, Block 1 of Grapevine Lake Estates (which is not right-of-way) and it would be necessary, unless the Council waived the requirements, that the radius as it ties into that area of Red Bird Lane East meet the City standards, which would be the 31' in the 50 ' easement. Apparently, the radius can't be placed within the area unless Lot 9A is utilized. Mr. Boyle stated that it appears that 9A (located on the west end of Red Bird Lane East contiguous to the property to the west) and Lot 1A (located north of Oakwood Drive contiguous to the property to the north) were in essence "spite" strips (created in 1951) which would preclude developers from the north and west from developing without tying into the subdivision without dealing with the owners of the property (both lots are not buildable) . In 1969, both lots (lA and 9A) were quit claimed to the City. Brief discussion ensued relative to reducing the 50' public easement to a pedestrian pathway. Mr. Boyle advised the matter before the City Council was to hold the public hearing and then the City Council can either take no action or instruct the City Staff to bring back the necessary documents in final form to address the vacation of the easement, retain walkway easements, or however the City Council desires to address the title issue of Lot 9A. Council Member Wilbanks made a motion for City Staff to bring back a recommendation to consider abandonment of the City's current easement on Red Bird Lane (identified as Red Bird Lane East) with a public easement of up to ten feet (10' ) and also abandon a portion of Lot 9A, Block 1 of Grapevine Lake Estates that is a part of the property adjoining Ms. Brown's property. The City of Grapevine and the U. S. Corps of Engineers today announce that the restrictions will include all lands and adjacent water within 300' of the shoreline. The Corps' ruling supplements the City ordinance which prohibits alcoholic consumption on and within 15' ° of roads, parks, . . . . . . . Colonel William Brown, Fort Worth District Office, explained in that over the years, the consumption of alcoholic beverages at Grapevine Lake has adversely affected the public welfare, safety, maintenance. . . . . . ***************************************************************** Discussion ensued relative to the exempt areas at Grapevine Lake under the Federal Ordinance: the marinas, pavilions (if rented) , and 300 ' beyond the shore line. Following discussion, it was the consensus of the City Council to have Ordinance No. 91-06 on the next City Council agenda for consideration. UPDATE FIRE FIGHTERS' AND POLICE OFFICERS' CIVIL SERVICE LAW ELECTION City Manager Watson reported the Civil Service Law has been placed on the May 4 ballot and requested the City Council consider setting a workshop session with the fire fighters and police officers to discuss concerns, needs and options available both to the City Council and the fire fighters and police officers. Following discussion, it was the consensus of the City Council to conduct a workshop on Tuesday, April 9, 1991 at 7: 00 p.m. at the Grapevine Convention Center, 1209 South Main Street. ITEM 14. OLD MILL RUN TRAFFIC UPDATE Director of Public Works Jerry Hodge reported his Staff has contacted the Grapevine/Colleyville Independent School District to consider an access off State Highway 26 that would be a main drop off point for both the high school and junior high school to alleviate the school traffic problems on Old Mill Run.
