HomeMy WebLinkAboutORD 1999-150 ORDINANCE NO. 99-150 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES, CHAPTER 25, UTILITIES AND SERVICES, ARTICLE II WATER AND SEWERS, SECTIONS 25-36.1(a) CONSTRUCTION METERS; AND 25-38(d) UTILITY HEARING OFFICER; PROVIDING A SEVERABILTIY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That Chapter 25, Section 25-36.1(a), Construction Meters, of the Grapevine Code of Ordinances is hereby amended by amending Section 25-36.1(a) in its entirety to read as follows: Section 25-36.1(a) Construction Meters - "(a) Construction meters shall be read and reading submitted to the City utility billing office at the completion of the intended use or monthly, which ever is a��-� the most frequent reading. Readings may be submitted by telephone, facsimile machine, Internet transmission or in person. Readings must be submitted to the utility billing office on or before the close of business on the 10th day of the month following the end of the completed billing month or the next working day if the 10th falls on a holiday or weekend. Meters must be brought to the utility billing office for inspection by the last day of the month each calendar quarter. If the readings are not submitted to the City utility billing office in a timely manner, as required by this code provision, there shall be a penalty assessed of $50.00 for failure to provide a reading. This penalty will be assessed even if the reading indicates no change since prior usage. Construction meter users shall also be charged a rental fee from the City for their use of the City owned construction meter at a rate of$30.00 per month for all months in excess of 90 days that the meter is held by the meter user. This rate will be in addition to the required minimum bills and volume charges. Failure to include the rent with the payment shall cause revocation of the right to use the meter and the meter will be returned to by the City." Section 2. That Chapter 25, Section 25-38(d), Utility Hearing Officer, of the "� Grapevine Code of Ordinances is hereby amended by amending the last line of Section 25-38(d) to read as follows: "(d) It will be the duty of the utility hearing officer to determine that customers are _ � not over charged or charged with services not rendered and make other adjustments to late fees and penalties as may be warranted to alleviate situations beyond the control of the customer." Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
