AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
�.- GRAPEVINE, TEXAS, ABANDONING AND VACATING A
�.:�� SIXTY FOOT (60') DRAINAGE EASEMENT IN THE CITY OF
-_ GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED;
� PROVIDING A SEVERABILITY CLAUSE; DECLARING AN
�� EMERGENCY AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the owners of a certain tract of land recorded in Cabinet A, Slide 3718,
Plat Records of Tarrant County and a certain tract of land recorded by deed of record as
shown in Volume 12693, Page 0291, Deed Records of Tarrant County, Texas, containing
a sixty foot (60') drainage easement, more specifically described in Exhibit "A" attached
hereto and incorporated herein for all purposes, has requested the drainage easement, as
herein after described be abandoned and vacated; and
WHEREAS, the drainage easement is not needed for public use and will not be
needed in the future for public use; and
- WHEREAS, abandoning and vacating said drainage easement will relieve the City
of Grapevine, Texas from the cost and expense of maintaining said property; and

WHEREAS, in exchange for abandoning and vacating said drainage easement the
City will receive the dedication of a forty-five foot (45') wide drainage easement across Lots
2 & 3, Block 5, Grapevine Mills Addition, more specifically described in Exhibit "B",
attached hereto and incorporated herein for all purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the preamble of this ordinance are true and
correct and are hereby incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That the drainage easement located within the property described in
Exhibit "A", attached hereto and incorporated herein for all purposes, is hereby abandoned
and vacated for public use and the same is hereby abandoned and vacated insofar as all
public right, title, and interest in and to said drainage easement is concerned in exchange
for the dedication of a drainage easement, more specifically described in Exhibit "B",
attached hereto and made a part hereof.
Section 3. That the terms and provisions of this ordinance shall be deemed to be
� severable, and that if the validity of any section, subsection, word, sentence or phase shall
- be held to be invalid, it shall not affect the remaining part of this ordinance.
_ Section 4. The fact that the drainage easement is no longer needed by the public

:_- for public usage and would create a hardship or burden upon the City of Grapevine to keep
� open and maintain such drainage easement creates an urgency and an emergency for the
immediate preservation of the public health, safety, and general welfare which requires that
this ordinance shall take effect immediately from and after its passage and it is accordingly
so ordained.

_ BEING a tract of land situated in the Henry Suggs Survey, Abstract no. 1415, in the City of
Grapevine and being a portion of Blocks 5 and 6, Replat of Grapevine Mills Addition, an
addition to the City of Grapevine according to the plat thereof recorded in Cabinet A, Slide 3718
of the Plat Records of Tarrant County, Texas(PRTC'I), also being a portion of Tracts 3 and 4, as
said tracts are described in the Public Common Access Easement recorded in the deed recorded in

more particularly described by metes and bounds as follows(bearings referenced to the Final Plat

intersection of the westerly right of way line of State Highway 26 and the northerly right of way
