HomeMy WebLinkAboutORD 1999-103 ORDINANCE NO. 99-103 t AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE CODE OF ORDINANCES, CHAPTER 19, ARTICLE II, OF THE CITY OF GRAPEVINE CODE OF ORDINANCES RELATIVE TO THE PLANNING AND ZONING COMMISSION AND ITS BYLAWS; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That Chapter 19, Article II, Division 2. Bylaws, of the Code of Ordinances of the City of Grapevine, Texas relating to the Planning and Zoning Commission is hereby amended to read as follows, and all other sections, subsections, paragraphs, definitions, words and phrases are not amended by are hereby ratified, verified and affirmed: A. That Section 19-35 is hereby amended by amending subsection (b) to read as follows: "(b) Regular meetings. Regular meetings shall be held on the third Tuesday of each month in the Council Chambers of the City Hall, unless otherwise determined by the Commission. It is the intent of the Commission to consider no more than eight (8) zoning cases per meeting. If an unusually large number of zoning cases should occur, tf�e Commission may schedule an additional meeting concurrently with the City Council. Section 2. If any sections, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. �,.� Section 4. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, �,.:,�, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
