HomeMy WebLinkAboutORD 1999-051 ORDINANCE NO. 99-51 ' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS EXTENDING THE SUSPENSION OF THE PROPOSED RATE SCHEDULES FILED BY LONE STAR GAS COMPANY UNTIL MAY 2, 1999, PROVIDING THAT THE CURRENT RATES REMAIN UNCHANGED DURING THE PERIOD EXTENDING THE SUSPENSION; PROVIDING FOR NOTICE HEREOF TO SAID COMPANY; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE IS PASSED IS OPEN TO THE PUBLIC AS REQUIRED BY LAW; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, Lone Star Gas Company heretofore on December 2, 1998, filed its Statement of Intent, together with its rate filing package proposing to change its rate schedules within the corporate limits of the City of Grapevine, effective January 7, 1999 (the proposed effective date); and WHEREAS, on December 15, 1998, the City Council passed Ordinance °�ri� No. 98-142 which suspended the effective date of Lone Star Gas Company's proposed rates until April 7, 1999; and �<� WHEREAS, the City and Lone Star Gas Company continue to negotiate a � settlement to the proposed rates; and WHEREAS, due to the on-going negotiations, Lone Star Gas Company by letter dated March 19, 1999 agreed to suspend the effective date of its proposed rates until May 2, 1999; and WHEREAS, in order to allow sufficient time to conclude negotiations with Lone Star Gas Company regarding the proposed changes to the rate schedule, it is the desire of the City Council of the City of Grapevine to continue the suspension of the rate, pursuant to Section 104.107(a)(1) of the Gas Utility Regulatory Act, until May 2, 1999. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all the statements contained in the preamble are found to be true and correct and are hereby incorporated as if copied in their entirety. a Section 2. That the effective date of the proposed changed rate schedules of Lone Star Gas Company is hereby suspended beyond the initial 90 day period and until ���,:� May 2, 1999 from the proposed effective date. Section 3. That the rate schedules of Lone Star Gas Company in effect within the City of Grapevine on the date on which Lone Star Gas Company files its said Y Statement of Intent shall continue in force during the period of suspension provided in Section 2 heretofore. Section 4. That the City Secretary's office of the City of Grapevine is hereby directed to deliver a copy of this ordinance to Lone Star Gas Company promptly after the passage hereof. Section 5. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public and that public notice of the time, place and purpose of said meeting was given, all as required by law. Section 6. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
