SUBJECT: APPROVAL OF A RESOLUTION FOR THE PURCHASE OF
PORTABLE TOILET RENTAL SERVICES THROUGH AN
INTERLOCAL AGREEMENT WITH THE CITY OF FORT
WORTH
RECOMMENDATION:
City Council to consider approval of a resolution for the purchase of portable toilet rental
services for the Parks and Recreation Department from MMG Building and Construction
Services, LLC through an interlocal agreement with the City of Fort Worth, Texas. The
total cost of this purchase is not to exceed the budgeted amount of$27,000.
FUNDING SOURCE:
Funds are budgeted in accounts 100-44573-312-3 (General Fund/Park
Maintenance/Leases and Rentals), 119-44753-312-9 (Lake Park Funds/Lake
Parks/Leases and Rentals), 100-44573-415-3 (General Fund/Streets/Leases and
Rentals), and 818-44573-104-1 (Heritage Foundation/Nash Farms/Leases and Rentals)
and not to exceed $27,000.
BACKGROUND:
This procurement will be under the Interlocal Cooperation Act, Chapter 791, Texas Local
Government Code that states that any entity participating through an interlocal
agreement satisfies any bidding requirements required Under State law. Council
approved the interlocal agreement and participation with the City of Fort Worth on
January 19, 1999. The City of Fort Worth's volume of use enables better pricing than
could be obtained through independently bidding this service
The City of Fort Worth solicited over 43 vendors and received three bids from which they
awarded a contract to MMG Building and Construction Services, LLC on November 3,
2011. This contract includes four, one-year renewal options. This initial contract period
will begin on January 17, 2011 and will end on December 13, 2012 and represent
between a 9% and 50% savings from the previous contract with United Site Services
that the City of Grapevine was utilizing, also through an interlocal with the City of Fort
Worth. MMG Building & Construction Services, LLC is a certified woman-owned
business based in Fort Worth and currently has municipal contracts with other cities
including Fort Worth and is also a member of the Grapevine Chamber of Commerce.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS AUTHORIZING THE CITY MANAGER
OR THE CITY MANAGER'S DESIGNEE TO PURCHASE
PORTABLE TOILET RENTAL SERVICES THROUGH AN
ESTABLISHED INTERLOCAL AGREEMENT AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of Grapevine, Texas is a local government in the State of Texas
and as such is empowered by the Texas Local Government Code, Section 271.102 to enter
into a Cooperative Purchasing Program Agreement with other qualified entities in the State
of Texas; and
WHEREAS, the City of Grapevine, Texas has established an Interlocal Agreement
with the City of Fort Worth, Texas and wishes to use established contracts meeting all
State of Texas bidding requirements; and
WHEREAS, the City of Fort Worth, Texas has established a contract with MMG
Building and Construction Services, LLC, contract #11-0351, for portable toilet rental
services; and
WHEREAS, The City of Grapevine's Parks Department has a need to purchase
portable toilet rental services for the City's needs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That all matters stated in above preamble are true and correct and
are incorporated herein as if copied in their entirety.
Section 2. That the City Council of the City of Grapevine authorizes the purchase
of portable toilet rental services from MMG Building and Construction Service, LLC
through an Interlocal Agreement with the City of Fort Worth for amounts not to exceed
$27,000.00.
Section 3. That the City Manager, or his designee, is authorized to take all steps
necessary to consummate the purchase of said products and services.
Section 4. That this resolution shall take effect from and after the date of its passage.
