SUBJECT: DOOLEY STREET RIGHT-OF-WAY ABANDONMENT
RECOMMENDATION:
City Council consider adopting an ordinance abandoning a segment of Street Right of
Way for Dooley Street at the request of the property owner at 151 S. Dooley Street, and
take any necessary action.
BACKGROUND:
The property owner at 151 S. Dooley Street has recently constructed a monument sign
which encroaches approximately six inches into the street right-of-way and
approximately 10' 6" over the front building line bordering S. Dooley Street. (See exhibit
attached.)
The property owner has requested that the City consider abandoning a 10' 6" wide strip
of street right-of-way along his frontage on S. Dooley Street to alleviate the two
encroachments.
The 10' 6" wide strip would be retained as a utility, public access, drainage and sidewalk
easement.
This property dedicated 10' of additional right-of-way to the City by plat dated March 18,
1986 to provide half of the planned 75' right-of-way necessary for a Type "E", four-lane
collector.
Ultimately, the City chose to reduce the width of the pavement section at the time we
reconstructed Dooley Street to a Type "F", two-lane collector to limit the impacts on the
residential neighborhoods along Dooley Street from Wall Street to College Street.
The request, if approved, would place the adjusted right-of-way line approximately 3' 6"
behind the curb in the Dooley Street sidewalk bordering the site with an easement in its
place.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
PORTION OF DOOLEY STREET RIGHT OF WAY IN THE
CITY OF GRAPEVINE, TEXAS AS HEREINAFTER
DESCRIBED; DECLARING AN EMERGENCY AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, the property owner of 151 South Dooley Street has requested that a
strip of the right of way of Dooley Street bordering the subject tract, as herein after
described be abandoned and vacated; and
WHEREAS, the right of way is not needed for public use and will not be needed in
the future for public use; and
WHEREAS, abandoning and vacating the said right of way will relieve the City of
Grapevine, Texas from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the preamble of this ordinance are true and
correct and are hereby incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That the public street right of way located adjacent to the subject
property described iin Exhibit"A", attached hereto and incorporated herein for all purposes,
is hereby abandoned and vacated for public use and the same is hereby abandoned and
vacated insofar as all public right, title, interest in and to said right of way is concerned,
subject to the retention by the City of said right of way as a public access, utility, sidewalk
and drainage easement.
Section 3. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection,word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 4. The fact that the right of way is no longer needed by the public for
public usage and would create a hardship or burden upon the City of Grapevine to keep
open and maintain such access easement creates an urgency and an emergency for the
immediate preservation of the public health, safety, and general welfare which requires that
this ordinance shall take effect immediately from and after its passage and it is accordingly
so ordained.

GRAPEVINE, TEXAS on thus the 3rd day of January, 2012.
