HomeMy WebLinkAboutORD 1997-066 �� ORDINANCE NO. 97-ss � AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING CHAPTER 25, UTILITIES AND SERVICES, ARTICLE III, SOLID WASTE DISPOSAL; REPEALING CONFLICTING ORDINANCES, PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00)AND A SEPARATE OFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That Chapter 25, Utilities and Services, Article III, Solid Waste Disposal is amended by the addition of a new Section 25-97(c) relative to Service rates - schedules ��� for retail establishments located in multi-tenant retail facilities and the renumbering of existing subsections as "d" through "i". New subsection 25-97(c) should read as follows: � "Sec. 25-97. Service Rates - Schedules (c) retail establishments located in multi-tenant retail facilities with a leasable area under roof or not less than 1,300,000 square feet shall be charged the following rates for the collection and removal of garbage, refuse, trash and other solid waste: (1) With the exception of food service establishments, retail establishments of greater than 50,000 rentable square feet referred to as Anchor Stores shall be charged $0.015/sq. ft./ month. (2) With the exception of food service establishments, retail establishments of 20,000 - 50,000 rentable square feet referred to as Major Stores shall be charged $0.03/ sq. ft./month. (3) With the exception of food service establishments, retail establishments of under 20,000 rentable square feet referred to as Specialty Shops shall be charged $0.055/ sq. ft./month. (4) Specialty Food establishments of 2,000 and less rentable square feet shall be charged $0.20/sq. ft./month. (5) Theater establishments shall be charged $0.03/ sq. ft./month. «��s� (6) Major Restaurant establishments of 10,000 - 35,000 rentable square feet shall be charged $0.045/ sq. ft./ month. (7) Restaurant establishments of 10,000 and less rentable square feet shall be charged $0.15/sq. ft./ month. (8) Food Court establishments of 1,500 and less rentable square feet shall be charged $0.70/sq. ft./month." Section 2. That all ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect provided, however, that the ordinance or ordinances under which the cases currently filed and pending in the Municipal Court of the City of Grapevine, Texas shall be deemed repealed only when such cases filed and pending under such ordinance or ordinances have been disposed of by a final conviction or a finding of not guilty, nolo contendere, or dismissal. Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto, any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. � Section 4. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) for each offense and a separate offense shall be deemed committed each day during or on which a violation occurs or continues. Section 5. The fact that the present ordinances and regulations of the City of Grapevine are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
