HomeMy WebLinkAboutORD 1997-068 ��� 1 � � ��'�„�„ ORDINANCE NO. 9�-ss _�:: +� � AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF - GRAPEVINE, TEXAS, ABANDONING AND VACATING A 24 - FOOT INGRESS/EGRESS EASEMENT DEDICATED .��-, ACROSS LOT 1 AND LOT 2, GRAYSON/121 ADDITION; � PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, a 24 foot ingress/egress easement dedicated across Lot 1 and Lot 2, �!'?j SCr/�2� �uuliiOt�, ���Gf ucu ��i �c+uli i2i f�, �iiue i y.ri2, riai netords c�f Tarrant Gouniy, more specifically described in Exf�ibit "A" attached hereto and incorporated herein for all purposes, is not needed for public use and will not be needed in the future for public use; and WHEREAS, the owners of Lots 1 and 2, Grayson/121 Addition, have modified their cross access location and requested the City of Grapevine to abandon and vacate said 24 foot ingress/egress easement; and ,,,�, WHEREAS, abandoning and vacating this portion of said ingress/egress easement will relieve the City of Grapevine, Texas from the cost and expense of maintaining said � property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble of this ordinance are true and correct and are hereby incorporated into ordinance as if copied in their entirety. Section 2. That a 24 foot ingress/egress easement dedicated across a portion of Lots 1 and 2, Grayson/121 Addition, recorded in Cabinet A, Slide 1952, Plat Records of Tarrant County, as shown in Exhibit "A" attached hereto and made a part hereof, is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar as all public right, title, and interest in and to said ingress/egress easement is concerned. Section 3. That the terms and provision of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase "�� shall be held to be invalid, it shall not affect the remaining part of this ordinance. � '��- �::�. Section 4. The fact that the present ordinances and regulations of the City of � � Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace � and general welfare of the public creates an emergency which requires that this ordinance - become effective from and after the date of its passage. Said 24 foot wide ingress/egress easement being 12 feet on each side of the following - described center line. _ BEGINNING at a point in the East right-of-way line of Grayson Drive and lying S 03° 9' 42" E 179.00 feet, from the Northwest corner of the aforesaid Lot 1, Block 1, GRAYSON/121 ADDITION; _-- THENCE N 89° 40' 33" E 49.14 feet, to a point for a corner; THENCE S 03° 33' 28" E 89.30 feet, to a point at the beginning of a curve to the left; THENCE SOUTHEASTERLY 36.23 feet, along said curve to the left having a radius of 50 feet, a central angle of 41° 30' 59", and a chord bearing S 24° 18' 52" E 35.44 feet, to a point at the end of said curve; THENCE S 45° 04' 15" E 114.05 feet, to a point for a corner; THENCE S 40° 39' 53" W 67.02 feet, to a point in the aforesaid East right-of-way line of Grayson Drive and the end of this center line description. .w� `�'/ / ACK M.
