Home My WebLink AboutORD 1996-041 (� . , � �� \u� � -� � � � ORDINANCE NO. g6-4t � AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ""�` GRAPEVINE, TEXAS, ABANDONING AND VACATING A TEN FOOT 110') UTILITY EASEMENT DEDICATED IN LOT 9, BLOCK C, COLLEGE CREEK ADDITION IN EXCHANGE FOR THE DEDICATION OF A FIVE FOOT (5') UTILITY EASEMENT IN LOT 9, BLOCK C, COLLEGE CREEK ADDITION, CITY OF GRAPEVINE, TEXAS; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, a ten foot(10') utility easement dedicated in Lot 9, Block C, College Creek Addition, recorded in Volume 388-178, Page 49, Plat Records of Tarrant County, more specifically described in Exhibit "A" attached hereto and incorporated herein for all purposes, is not needed for public use and will not be needed in the future for public use; and WHEREAS, the owners of Lot 9, Block C, College Creek Addition have � requested the City of Grapevine to abandon and vacate said ten foot (10') utility easement; and �, WHEREAS, the request for abandonment and vacation has been reviewed and approved by the franchised utilities in the City of Grapevine; and WHEREAS, abandoning and vacating this portion of said utility easement will relieve the City of Grapevine, Texas from the cost and expense of maintaining said property; and WHEREAS, in exchange for abandoning and vacating said utility easement, the City will receive a five foot (5') utility easement in Lot 9, Block C, College Creek Addition, more specifically described in Exhibit "B" attached hereto and incorporated herein for all purposes �+edicated by the owners of Lat 9, 81ock C, College Creek Addition to the City of Grapevine. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: ,,,�„ Section 1 . That all matters stated in the preamble of this ordinance are true and correct and are hereby incorporated into the body of this ordinance as if copied in their entirety. � , ,_ . g,. ' , �.; �� Section 2. That a ten foot (10') utility easement dedicated in Lot 9, Block C, '""�' College Creek Addition recorded in Volume 388-178, Page 49, Plat Records of Tarrant County, as shown in Exhibit "A" attached hereto and made a part hereof, is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated �`" insofar as all public right, title, and interest in and to said utility easement is concerned in exchange for the dedication of a five foot (5') easement in Lot 9, Block C, College Creek Addition, more specifically described in Exhibit "B" attached hereto and made a part hereof. Section 3. That the terms and provision of this ordinance shall be deemed to be severable, and that if the validity of any section , subsection, word, sentence or phase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 4. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to property safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage.
