HomeMy WebLinkAboutORD 1996-027 �¢ , ORDINANCE NO. 96-27 �:_..� AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES, CHAPTER 16 PARKS AND RECREATION, ARTICLE I, BY AMENDING SECTION 16-2 AND 16-4 RELATIVE TO THE PARK BOARD; SECTION 16-8 RELATIVE TO SPEED LIMITS FOR MOTOR BOATS; SECTION 16-10 RELATIVE TO VEHICULAR TRAFFIC; AND BY THE ADDITION OF NEW SECTIONS; PROVIDING FOR PLACEMENT OF SIGNS; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED FIVE HUNDRED DOLLARS (5500.00) FOR EACH OFFENSE IN VIOLATION OF THE ORDINANCE;PROVIDING FORSEVERABILITY; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That the Grapevine Code of Ordinances, Chapter 16 Parks and Recreation, Article I, Section 16-2 Parks and Recreation Board - Number of inembers, �� r qualifications and terms, paragraph 5 is hereby amended to read as follows: "There is hereby created an ex-officio member of the board who shall be a student of either Grapevine High School or Colleyville Heritage High School and be nominated by the Superintendent of the Grapevine-Colleyville Independent School District and approved by the Park Board and by the City Council. The student shall be a Grapevine resident. The appointment of this ex-officio member shall be on an annual basis and the term of the appointment shall begin and conclude in June of each year." Section 2. That the Grapevine Code of Ordinances, Chapter 16 Parks and Recreation, Article I, Section 16-4 Parks and Recreation Board - Duties and responsibilities, is hereby amended by the deletion of Subsection 16-4(9). Section 3. That the Grapevine Code of Ordinances, Chapter 16 Parks and Recreation, Article I, Section 16-8 Speed Limits for motor boats in McPherson's Slough is hereby amended by deletion of Section 16-8 in its entirety and insertion of new Section 16-8 to read as follows: �R� R "16-8. Operation of all vessels or watercraft in protected areas on Lake Grapevine; posting of signs. ��. � (a) Definitions. (1) Vessels or watercraft, including, but not limited to, powerboats, � cruisers, houseboats, sailboats, jet skis and any other such equipment capable of navigation on water. �,:.;� (b) Speed Limits. It shall be unlawful for any person to operate a vessel or watercraft so as to cause a hazardous wake or wash within a water area that has been clearly marked by buoys. It shall also be unlawful for any person to operate a vessel or watercraft within a water area that has been clearly marked by buoys or some other distinguishing device as a bathing, fishing, swimming or otherwise restricted area by a political subdivision of the State. (c) The City Manager or his designated representative is directed to post signs at appropriate locations on Lake Grapevine to notify parties of said "No Wake" zones." Section 4. That the Grapevine Code of Ordinances, Chapter 16 Parks and Recreation, Article I, Section 16-10 is amended in its entirety to read as follows: "16-10. Vehicular traffic prohibited in public parks; posting of signs. (a) It shall be unlawful for any motor vehicle traffic to stop, stand, park or cross over or into any park, playground or recreational area � � owned, leased, operated or under control of the City, except in specifically designated areas or when City sponsored or co- sponsored events are being held. (b) The City Manager or his designated representative is directed to post signs giving notice that all vehicular traffic is prohibited except in specifically designated areas." Section 5. That the Grapevine Code of Ordinances, Chapter 16 Parks and Recreation, Article I is amended by renumbering Section 16-12 Park closings - Hours of operation, to become Section 16-14 and by the addition of Sections 16-1 1 , 16-12 and 16-13 to read as follows: "16-11 . Bicycling and skating prohibited on tennis courts and basketball courts; posting of signs. (a) It shall be unlawful for any person to ride a bicycle, skateboard, in-line skates or rollerskates on any tennis court or basketball �, ,Ty court owned or leased by the City of Grapevine. (b) The City Manager or his designated representative is directed to ,�,� post signs giving notice that such action is prohibited." ORD. NO. 96-27 2 "16-12. Golfing in public parks prohibited; posting of signs. (a) It shall be unlawful for any person to hit a golf ball in, into, upon or over any public park owned or leased by the City except in areas designated and posted with proper signage. (b) The City Manager or his designated representative is directed to post signs giving notice that such action is prohibited in public parks except in areas designated for that purpose." "16-13. Glass containers in parks prohibited; posting of signs. (a) Definitions. (1) G/ass beverage container means a container for the holding of a liquid for drinking purposes, which container is made of glass. (2) Parks shall mean any public parks owned, operated or under control of the City of Grapevine. (b) Possession unlawful; exceptions. (1) It shall be unlawful for any person to use or possess any �� ,� glass beverage container in any park owned or leased by the City of Grapevine. (2) The prohibition in this section shall not apply where any such glass beverage container is used or possessed within the immediate enclosed confines of any privately owned or operated motor vehicle. (c) The City Manager or his designated representative is directed to post signs giving notice that all glass containers are prohibited." Section 6. That any person, firm, corporation, agent or employees thereof who violates any of the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be fined up to 5500 for each offense. Each day that a violation exists shall constitute a separate offense. Section 7. That all ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect; M provided, however, that the ordinance or ordinances under which the cases currently filed and pending in the Municipal Court of the City of Grapevine, Texas, shall be deemed repealed only when all such cases filed and pending under such ordinance or �;,,�, ordinances have been disposed of by a final conviction or a finding not guilty or nolo contendere, or dismissal. ORD. NO. 96-27 3 Section 8. if any section, article, paragraph, sentence, clause, phrase or word � � in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the �.._� validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 9. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
