HomeMy WebLinkAboutORD 1995-100 ORDINANCE NO. 95-100 � „� AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS EXTENDING CURRENT FRANCHISE AGREEMENT WITH PARAGON CABLE FOR A PERIOD OF SIX MONTHS TO CONSIDER AMENDMENTS TO THE FRANCHISE AGREEMENT; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the franchise agreement between the City of Grapevine and Paragon Communications expires on February 20, 1996; and WHEREAS, the City of Grapevine formally requested a six (6) month franchise extension with Paragon Communications on November 6, 1995 to complete an evaluation of its citizens' current franchise agreement and future needs; and WHEREAS, Paragon Communications (d/b/a Paragon Cable) and the City of Grapevine, Texas agree to consider a franchise amendment; and WHEREAS, the City hereby extends Paragon Cable's existing television '� franchise for a period of six (6) months from February 20, 1996 until August 20, � 1996 to allow adequate time for research; and � � WHEREAS, all other terms and conditions of the franchise shall remain in full force and effect, subject to applicable law; and � WHEREAS, the amendment shall be without prejudice to the rights of either party under provisions of applicable law, including without limitation, the provisions of 47 USC Section 546. In particular, Paragon Cable has submitted timely notice pursuant to 47 USC 546(a) with respect to renewal of the franchise and need not submit such notice again. All rights and protections under 47 USC 546 which are available to Paragon Cable and the City as a result of such submission will continue to be available until this franchise is renewed or such renewal is denied pursuant to the provisions of 47 USC 546. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: „�,,, Section 1 . That all matters stated in the preamble are true and correct as if copied herein in their entirety. � �,. � Section 2. That the City and Paragon Cable agree to a six (6) month franchise extension until August 20, 1996. �:;� Section 3. That the City and Paragon Cable maintain all legal rights provided by 47 USC Section 546. Section 4. That this ordinance shall become effective on March 7, 1996.
