ORDINANCE NO. 95-80
„�„ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
FIFTEEN FOOT (15') UTILITY EASEMENT DEDICATED IN
LOT 16, BLOCK 1 , HIGH COUNTRY PHASE I ADDITION IN
EXCHANGE FOR THE DEDICATION OF A VARIABLE
WIDTH UTILITY EASEMENT IN LOT 16, BLOCK 1 , HIGH
COUNTRY PHASE I ADDITION, CITY OF GRAPEVINE,
TEXAS; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, a fifteen foot (15') u�ility easement dedicated in Lot 16, Block 1,
High Country Phase I Addition, recorded in Volume 388-154, Page 99, Plat Records
of Tarrant County, and Volume 7317, Page 1247, Deed Records of Tarrant County,
more specifically described in Exhibit "A" attached hereto and incorporated herein for
all purposes, is not needed for public use and will not be needed in the future for
public use; and
'""� WHEREAS, the owners of Lot 16, Block 1 , High Country Phase I Addition have
requested the City of Grapevine to abandon and vacate said fifteen foot (15') utility
� easement; and
WHEREAS, the request for abandonment and vacation has been reviewed and
approved by the franchised utilities in the City of Grapevine; and
WHEREAS, abandoning and vacating this portion of said utility easement will
relieve the City of Grapevine, Texas from the cost and expense of maintaining said
property; and
WHEREAS, in exchange for abandoning and vacating said utility easement, the
City will receive a variable width utility easement in Lot 16, Block 1 , High Country
Phase I Addition, more specifically described in Exhibit "B" attached hereto and
incorporated herein for all purposes dedicated by the owners of Lot 16, Block 1 , High
Country Phase I Addition to the City of Grapevine.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1 . That all matters stated in the preamble of this ordinance are true
�. and correct and are hereby incorporated into the body of this ordinance as if copied
in their entirety.

Section 2. That a fifteen foot (15') utility easement dedicated in Lot 16,
`� Block 1 , High Country Phase I Addition recorded in Volume 388-154, Page 99, Plat
Records of Tarrant County and Volume 7317, Page 1247, Deed Records of Tarrant
,�, County, as shown in Exhibit "A" attached hereto and made a part hereof, is hereby
abandoned and vacated for public use and the same is hereby abandoned and vacated
insofar as all public right, title, and interest in and to said utility easement is
concerned in exchange for the dedication of a variable width easement in Lot 16,
Block 1 , High Country Phase I Addition, more specifically described in Exhibit "B"
attached hereto and made a part hereof.
Section 3. That the terms and provision of this ordinance shall be deemed to
be severable, and that if the validity of any section , subsection, word, sentence or
phase shall be held to be invalid, it shall not affect the remaining part of this
ordinance.
Section 4. The fact that thz prese�t ordinances and regulations of the City of
Grapevine, Texas are inadequate to property safeguard the health, safety, morals,
peace and general welfare of the public creates an emergency which requires that this
ordinance become effective from and after the date of its passage.
