ORDINANCE NO. 95-65 ���� �� ��� `r�Ci�1 'Jk;" uGtJ�i��O Er-;CcY c:4r¢1!`l IJt�Cl2%`SC AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, APPROVING, ADOPTING AND RATIFYING THE REPORT OR STATEMENT OF THE DIRECTOR OF PUBLIC WORKS OF THE CITY OF GRAPEVINE, TEXAS, OF THE TOTAL COST OF WATER AND SANITARY SEWER IMPROVEMENTS IN A PORTION ; OF THE CITY OF GRAPEVINE, TARRANT COUNTY, TEXAS, AND DALLAS COUNTY, TEXAS, TO WIT: LOCATED IN AN AREA GENERALLY DESCRIBED AS BEING BORDERED BY BETHEL ROAD AND STATE HIGHWAY 26 ON THE SOUTH; FAIRWAY DRIVE ON THE WEST; THE FLOWER MOUND CITY LIMITS LINE AND DENTON CREEK ON THE NORTH; AND DENTON CREEK, STATE HIGHWAY 121 , AND THE COPPELL CITY �IMITS ON THE EAST; MORE SPECIFICALLY DESCRIBED IN ATTACHED EXHIBITS "A" THROUGH "E"; DETERMINING THE COST OF SUCH IMPROVEMENTS AND THE AMOUNTS BASED UPON ACREAGE PROPOSED TO BE ASSESSED AGAINST PROPERTY ADJACENT TO, SERVED BY, AND BENEFITTED " BY THE PROPOSED IMPROVEMENTS, AND THE OWNERS THEREOF; PROVIDING A SEVERABILITY CLAUSE; � = DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, a need for water system improvements and sanitary sewer system improvements has been established by the City of Grapevine through its approved Water and Sanitary Sewer Master Plan; �nd WHEREAS, water system improvements and san;tary sewer system improvements in northeast Grapevine are a high priority to the City of Grapevine; and WHEREAS, water system improvements and sanitary sewer system improvements in northeast Grapevine are a significant benefit to the overall health, safety and welfare of the general public and the citizens of the City of Grapevine; and WHEREAS, the water system improvements and sanitary sewer system improvements would result in substantial special benefits to the owners of property to be served by said improvements; and WHEREAS, the Director of Public Works of the City of Grapevine, Texas has prepared plans and specifications for the irriprovements of the hereinafter described �. portions of said water and sanitary sewer system facilities in the referenced area, and has submitted such plans and specifications to the City Council of the City of Grapevine, Texas, at its regular meeting held on the 1 st day of August, 1995, and the � 5 I � I �� 20 � � I 2I � � � 2 �37 , same having been examined and reviewed by the City Council of the City of Grapevine, Texas, and found to be in all matters and things proper, did approve same; and � WHEREAS, the City Council of the City of Grapevine, Texas has heretofore ordered that the hereinafter described water and sanitary sewer system improvements in the northeast area of the City of Grapevine, Texas, be constructed; and WHEREAS, the Director of Public Works of the City of Grapevine, Texas has prepared and filed with the City Council the total actual cost of such improvements and his estimates of the amounts proposed to be assessed against the properties adjacent to, to be served by, and benefitted by the system, and the owners thereof, based upon acreage; and WHEREAS, all assessments, are to be made and levied by the City Council as it may deem just and equitable, having in view the special benefits in enhanced value to be received by such parcels of property and owners thereof, the equities of such owners, and the adjustment of the apportionment of the cost of improvements so as to produce a substantial equality of benefits received and burdens imposed. WHEREAS, based upon equality of benefits received, and burdens imposed, the City Council has determined that all assessments shall be based upon acres of land served by the proposed improvements in lieu of the front foot rule, as the front foot rule would result in injustices or inequalities. WHEREAS, based upon the water lines proposed in the improvements acting as a fully interdependent delivery network for water supply to all properties to be served by the improvements, the City Council has determined that assessments for the cost of water line improvements shall be derived by distributing the total cost of the improvements to the total properties adjacent to, to be served by, and benefitted by the network, and the owners thereof, on a per acre basis. WHEREAS, based upon the individual sanitary sewer lines proposed in the improvements acting semi-independently in a non-fully interconnected system, the City Council has determined that the assessment for the costs of each sanitary sewer line shall be derived by distributing the cost of each line only to those properties adjacent to, to be served by, and benefitted by each individual line, and the owners thereof, on a per acre basis. WHEREAS, the plans and specifications for the improvements hereinafter described are on file in the office of the Director of Public Works, 307 West Dallas Road, Grapevine, Texas, 76051 , Room 214. �� WHEREAS, the City Council has heretofore determined the necessity of levying an assessment against the property adjacent to, to be served by, and benefitted by the hereinafter described water and sanitary sewer system improvements and the owners thereof. ORD. NO. 95-65 2 � Si � l f�;' � � 5 � i21 � � � � 98 _ NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: ~ Section 1 . That the report or statement of estimates filed on or before September 5, 1995, with the City Council by the Director of Public Works of the City of Grapevine, Texas, of the total cost of such improvements, is hereby approved, adopted and ratified and the report or statement of actual costs of such improvements and the recommended amounts proposed to be assessed against the property adjacent to, to be served by, and benefitted by the proposed improvements, and the owners thereof, having been duly examined are hereby approved and adopted. The method of calculating the recommended assessment is to take the lesser of the enhancement to the property and ninety percent (90%) of the total costs of the improvement, based upon the acreage served. Section 2. That the actual cost of improvements of the hereinafter described water and sanitary sewer system improvements with the amounts based on acreage served and the recommended assessments proposed to be assessed for such improvements against property adjacent to, to be served by, and benefitted by the improvements, and the owners thereof, as shown on Exhibits "A" through "E", attached hereto and made a part hereof are hereby approved. Section 3. That Water and Wastewater Impact Fees are hereby waived for those properties proposed to be assessed for water and sanitary sewer improvements as identified in Exhibits "A", "B", and "C", attached hereto and made a part hereof. Section 4. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5. The fact that the water and sanitary sewer system improvements and portions thereof to be improved as herein provided are in need of being improved without delay creates an emergency and public necessity for the immediate preservation of the public peace, health and safety which requires that this ordinance be passed as an emergency measure and that this ordinance take effect from and after its passage, and it is accordingly so ordered and ordained.
