HomeMy WebLinkAboutORD 1995-049 ORDINANCE NO. 95-49 �,.� AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING THE GRAPEVINE CODE OF ORDINANCES, CHAPTER 7 BUILDINGS AND CONSTRUCTION, ARTICLE VII, RELATIVE TO MOVING OF BUILDINGS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS (5500.00) FOR EACH OFFENSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That Chapter 7, Article VII, Section 7-162(c)(4) be, and the same is hereby amended in its entirety to read as follows: "(c)(4) A drawing or plot plan showing the dimensions of the lot or tract of land '"��� upon which the house, building or structure is to be moved or relocated, and the location of existing buildings or structures upon the lot, if any, together with the location of existing buildings or structures upon adjoining lots. Additional information may be required for submittal as determined by the Building Official. Such drawings shall be prepared by a State of Texas Professional Land Surveyor, Professional Engineer or Registered Architect." Section 2. That Chapter 7, Article VII, Section 7-162(c) be, and the same is hereby amended by the creation of a new paragraph 7-162(c)(5) to read as follows: "(c)(5) A completed building permit application with all accompanying drawings, specifications, and calculations including foundation plans designed by a State of Texas Licensed Professional Engineer. Such documents must be reviewed and found to be in compliance with all applicable ordinances by the Building Official prior to scheduling the public hearing for the Move-In Building Request." Section 3. That Chapter 7, Article VII, Section 7-162 be, and the same is hereby amended by the creation of a new paragraph 7-162(h) to read as follows: "(h) Within ninety (90) days of moving the structure on to the lot, the applicant shall place the building upon a permanent foundation and provide complete weather protection. Special permission may be granted in writing by the Building Official to extend this time period for unusual circumstances." � ,��, Section 4. That Chapter 7, Article VII, Section 7-165 be, and the same is hereby amended by amending Section 7-165(a) in its entirety to read as follows: �, "(a) Any person shall before moving any house, building or other structure along, upon or across any public street, avenue, thoroughfare or alley in the City, file with the Building Official a surety bond executed by some good and solvent surety company authorized to do business in the state, payable to the City for the use and benefit of any injured party, conditioned that the person applying for said permit will indemnify and save and protect the City, or any person harmless from any and all damages arising from or caused by the moving of such house, building or other structure." Section 5. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Five Hundred Dollars ($500.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 6. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such � a invalidity, which remaining portions shall remain in full force and effect. �" �' Section 7. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
