` ORDINANCE NO. 94-96
�` AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS ABANDONING AND VACATING
CERTAIN RIGHT-OF-WAY LOCATED WITHIN IRA E.
WOODS AVENUE (FORMERLY S.H. 26) AS DESCRIBED
IN EXHIBIT A, HEREINAFTER DESCRIBED AS THE
"PROPERTY"; SUBJECT TO THE CITY RETAINING A
SANITARY SEWER EASEMENT ACROSS THE PROPERTY AS
DESCRIBED IN EXHIBIT B; PROVIDING A
SEVERABILITY CLAUSE; DECLARING AN EMERGENCY
AND PROVIDING AN EFFECTIVE DATE
WHEREAS, certain public street right-of-way lacated �rithirt '�a
E. Wocds Avenue (formeriy S.H. 26 as described in Exhibit A) is no
longer needed for public use and will not be needed in the future
for public use; and
WHEREAS, abandoning and vacating this right-of-way will
relieve the City of Grapevine, Texas from the cost and expense of
maintaining said property; and
WHEREAS, Robert L. Taylor owns the property in fee simple
,�,.,, titl.e that is contiguous to the Property and has requested the City
to abandon and vacate the Property and to quit-claim all of the
interests the City may have in the Property; and

WHEREAS, the City acquired other right-of-way from Robert L.
Taylor, et al. in Cause No. 387-117269-88 in which case a Final
Judgment was entered in the 348th Judicial District Court of
Tarrant County, Texas on March 14 , 1994; and
WHEREAS, Robert L. Taylor has submitted claim letters to the
City dated April 27, 1994 and August 8, 1994; and
WHEREAS, in the August 8, 1994 letter, Robert L. Taylor agreed
to resolve any and all differences with the City relating to the
acquisition of right-of-way in the heretofore described suit and
arising from the City's relocatior_ of t2�e curb line o� Ira E. Woods
Avenue by Robert L. Taylor paying to the City the sum of $7,500.00
in consideration of the City's vacation and abandoning of the
City's interest in the Property and conveying any interest the City
may have to Robert L. Taylor; and
WHEREAS, both the City and Robert L. Taylor do hereby agres to
the settlement terms of this ordinance and acknowledges same by
signing this Ordinance; and
� WHEREAS, this abandonment and conveyance is in compliance with
the Texas Local Government Code, Chapter 272, provisions relating
to the sale of property or interests in property.

� NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
�► Section 1. That all the matters stated in the preamble of
this Ordinance are true and correct and are hereby incorporated
into the body of this Ordinance as if copied in their entirety.
Section 2. That the right-of-way in Ira E. Woods Avenue
described in Exhibit A, attached hereto and made a part hereof, is
hereby abandoned and vacated for public use and the same is hereby
abandoned and vacated insofar as all public right to title and
interest in and ta said right-of-way is concerned except as to
retention of a sanitary sewer easement within the Property
described in Exhibit B. '
Section 3. That the City Manager is hereby instructed to
have prepared and authorized to execute a quit claim deed on behalf
of the City releasing the City's rights to the Property and
conveying said interest to Robert L. Taylor upon receipt of
$7,500.00 in cash and a signed and acknowledged copy of this
ordinance by Robert L. Taylor.
Section 4. That the terms and provisions of this ordinance
shall be deemed to be severable, and that if the validity of any
�„ section, subsection, word, sentence or phrase shall be held to be
invalid, it shall not affect the remaining part of this ordinance.
� Section 5. The fact that the present ordinances and
regulations of the City of Grapevine, Texas are inadequate to
properly safeguard the public health, safety, morals, peace and
general welfare of the public creates an emergency which requires
that this ordinance become effective from and after the date of its
passage, and it is accordingly ordained.

GRAPEVINE, TEXAS on this 15th day of November , 1994.
