ORDINANCE N0. 94-59
�,,, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS ABANDONING AND VACATING
TERRELL STREET PUBLIC ROAD RIGHT-OF-WAY LOCATED
BETWEEN DALLAS ROAD AND NASH STREET; PROVIDING
A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY
AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the public street right-of-way of Terrell Street between Dallas Road
and Nash Street is no longer needed for public use and will not be needed in the
future for public use; and
WHEREAS, abandoning and vacating this right-of-way will relieve the City of
Grapevine, Texas from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:

Section 1 . That all the matters stated in the preamble of this Ordinance are
`� true and correct and are hereby incorporated into the body of this Ordinance as if
copied in their entirety.
Section 2. That the fifty foot (50') wide public street right-of-way of Terrell
Street between Dallas Road and Nash Street, as described by metes and bounds in
Exhibit A, attached hereto and made a part hereof, is hereby abandoned and vacated
for public use and the same is hereby abandoned and vacated insofar as all public
right to title and interest in and to said right-of-way is concerned, subject to the
retention of a fifty foot (50') wide right-of-way within the area described in Exhibit A
as a utility easement for public utility facilities.
Section 3. That the City Manager is hereby instructed to have prepared and
authorized to execute a Quit Claim Deed on behalf of the City releasing the City's
rights to the Terrell Street right-of-way described in Exhibit A, subject to the retention
of said right-of-way as a utility easement for public utility facilities as noted in
Section 2 of this document.
Section 4. That the terms and provisions of this ordinance shall be deemed to
�...� be severable, and that if the validity of any section, subsection, word, sentence or
phrase shall be held to be invalid, it shall not affect the remaining part of this
ordinance.

,� , Section 5. The fact that the present ordinances and regulations of the City of
Grapevine, Texas are inadequate to properly safeguard the public health, safety, .
morals, peace and general welfare of the public creates an emergency which requires
� that this ordinance become effective from and after the date of its passage, and it is
accordingly ordained.
