AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS,
AMENDING THE GRAPEVINE CODE OF ORDINANCES,
CHAPTER 2 ADMINISTRATION, ARTICLE IV ACCESS TO
PUBLIC INFORMATION BY AMENDING SECTION 2-126
COST OF COPIES AND CHARGES FOR ACCESS TO
PUBLIC RECORDS; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, it is the policy of the City of Grapevine, Texas (the "City") that all
persons are, unless otherwise expressly provided by law, at all times entitled to full
and complete information regarding the affairs of government and the official acts of
those who represent them as public officials and employees; and
WHEREAS, it is the policy of the City to provide suitable copies of public
records and routine information within a reasonable period of time after the date the
records or routine information was requested; and
WHEREAS, due to increased cost of labor and materials it is necessary for the
City to charge a fee in accordance with Art. 6252-17a, Section 9, Vernon's Ann. Civ.
. Stat. for access to public records and routine information prepared and maintained by
the City; and
WHEREAS, the fee charged to a person requesting public records and routine
information shall be reasonable and not excessive and the City shall make every effort
to charge a fee that matches the actual cost of providing the records and routine
information.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, THAT:
Section 1 . The Grapevine Code of Ordinances, Chapter 2 Administration,
Article IV, Section 2-126 (c)(1)a,b and c is hereby amended to read as follows:
"a. For fifty (50) pages or less of readily available information, the charge
shall be twenty-five cents (5.25) per page, fifty cents (5.50) per
duplexed page;
�,� b. For more than fifty (50) pages of readily available information, the charge
shall be (51 .00) for the first page and twenty-five cents (S.25) for each
additional page, fifty cents (5.50) per each duplexed page;

c. For any quantity of information deemed not to be readily available, the
� actual charge shall be the combined components of (51 .00) for the first
page and twenty-five cents (5.25) for each page thereafter, fifty cents
; (5.50) per duplex page, plus actual labor costs incurred by the City in
providing the requested information. The City Manager may determine
an average salary rate composed of the salary rates of all individuals
within the City who are normally responsible for performing such tasks.
Such average salary rate may be used as a standard rate and applied to
all such requests."
Section 2. This ordinance shall be cumulative of all other ordinances of the City
and shall not repeal any of the provisions of said ordinances except in those instances
where provisions of those ordinances are in direct conflict with the provisions of this
ordinances.
Section 3. If any section, article, paragraph, sentence, clause, phrase or word
in this ordinance, or application thereto any person or circumstance is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this ordinance; and the City Council hereby
declares it would have passed such remaining portions of this ordinance despite such
invalidity, which remaining portions shall remain in full force and effect.
Section 4. The fact that the present ordinances and regulations of the City of
Grapevine, Texas do not adequately regulate the traffic within the City creates an
�� emergency and the preservation of the public health, safety and welfare requires that
this ordinance take effect immediately from and after the date of its passage.
