CORRECTING THE OFFICIAL BOUNDARIES OF THE CITY AS HERETOFORE ADOPTED; PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine, Texas ("the City"), pursuant to the Municipal Annexation Act ("the Act"1, Chapter 43, Local Government Code, has heretofore �"''� provided proper notice and conducted public hearings relating to annexation proceedings on the tract described in Exhibit "A"; and WHEREAS, in accordance with the Municipal Annexation Act, service plans were prepared by the appropriate department of the City, which plans were made available for inspection and explained to the inhabitants of the area to b� annexed at the public hearings conducted as hereinafter described; and WHEREAS, all required statutory notices pursuant to the Act have been accomp�ished; and L":NFF.�;S, N�.:�!;� he�ri:�as were conaucted b� xhe �rapevine City Counci� �n September 14, 1993 and September 21, 1993, which public hearings were conducted after notices had been published in a newspaper of general circulation in the City and in the area proposed to be arnexed not more than twenty (20) days nor less than ten (10) days prior to each heari�g; and WHEREAS, the property to be annexed is contiguous and adjacent to the City limits of the City of Grapevine and not within the boundaries or extra-territorial jurisdiction of another City. �,.,�, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF +� GRAPEVINE, TEXAS: I f � .� i '� � � � Section 1 . That all of the above premises are found to be true and correct and � are incorporated into the body of this ordinance as if copied herein in their entirety. �,n„ Section 2. The service plans submitted in accordance with the Municipal Annexation Act are hereby approved as part of this ordinance, made a part hereof and attached hereto as Exhibit "B". Section 3. That the property described in Exhibit "A", which is attached hereto and incorporated herein for all purposes, be and is hereby annexed and brought within the corporate limits of the City of Grapevine, Tarrant County, Texas, and the same is hereby made an integral part hereof. Section 4. That the owners and inhabitants of the area herein annexed be entitled to all of the rights and privileges of other citizens and property owners of said �� City and are hereby bound by all acts, ordinances and �II ather legal ac�ion notiv in full force and effect and all those which may be hereafter adopted. Section 5. If any section, subsection, sentence, phrase or word herein be found to be illegal, invalid unconstitutional or if any portion of said property is incapable of being annexed by the City of Grapevine, Texas for any reason whatsoever, the adjudication shall not affect any other section, sentence, phrase, word, paragraph or provision of this ordinance or the application of any other section, �"` ' sentence, phrase, word, paragraph or provision to any other person, situation or circumstances, nor shall such adjudication affect any other section, sentence, phrase, word, paragraph, or provision of the Grapevine City Code. The City Council declares that it would have adopted the valid portions and applications of this ordinance and would have annexed the valid property without the invalid part, and to this end the provisions of this ordinance are declared to be severable. Section 6. That the official map and boundaries of the City of Grapevine, Texas heretofore adopted and amended by and are hereby amended so as to include the aforementioned territory as part of the City of rrapevine. Section 7. That this ordinance shall take effect immediately upon second and final reading. GENERAL: The proposed annexation of Parcel 1 is generally located north, south, and west of Meadowmere Park, east of Lonesome Dove Road and north of Dove Road, northwest of the City of Grapevine. A portion of the property adjacent to Lake Grapevine at the north end of Lonesome Dove Road is part of the Corps of Engineer property. POLICE PROTECTION: The subject site is in the proximity to District 3. The tract is surrounded by Southlake and Grapevine jurisdictional boundaries. Routine patrol would be somewhat diminished due to: A. limited access to the entrance of the tract B. inhabited portion of the tract is not in the proximity to the roudnely patrolled area of District 3 Response times for calls for service would increase due to the extended amount of travel time required without adding an additional person to District 3. Presently one (1) officer is responsible for District 3. There is also the possibility of investigating an interlocal agreement ��� with the City of Southlake to provide additional police protection in this area. "*�' Sergeant Bailey of the Tarrant County Sheriff's Office reported the following information regarding calls for service: 7anuary - December, 1991 75 calls in area January - December, 1992 101 calls in azea Sergeant Bailey reported that 98% of the calls were in the El Dorado Mobile Fiome Park. FIRE PROTECTION: Fire protection and emergency medical service will be provided to Parcel 1 by Station 2located at 2801 Panhandle Drive. The site is presently in the Southlake Fire District, but the Grapevine Fire Department responds to most of the calls in this area. Because of the City's participation in a fire protection agreement with Tarrant County, this unincorporated area is already receiving fire protection from the City of Grapevine, no additional fire protection and emergency medical service will become necessary. �:,�, Parcel 1 Annexation Service Plan 1 f.� _ ,.. , r; � l � � �,� �.� J / .� � - . L-`^si I�J• 1/��/ � z . , �-ti..,�C. 9�-f� , � . ��j3 �h . , SANTTARY SEWER SERVICE: U The nearest sanitary sewer service to Parcel 1 is a 6 inch force main in Kimball Road, which ;�,w�� is already at capacity and does not have the excess capacity available to serve this site. William Infeldt's development in the area is served by a private sewer force main that pumps to the Kimball Road Lift Station. A number of existing homes, trailers and businesses along Lonesome Dove Road are apparently served by septic tanks. The exisdng restaurant at the end of Lonesome Dove Road, adjacent to Lake Grapevine, is currently served by a private sewer force main that pumps to the Kimball Road Lift Station. There are no plans to provide sewer service to this area until development occurs. At that time, the developer will have to provide service for the area. This azea will be difficult to serve with utiiities except through an interlocal agreement with Southlake. WATER SERVICE: The nearest Grapevine waterline for this area is an 8 inch line in Kimball Road, which may be inadequate to serve this large site. The Corps property has City of Grapevine water service. The existing restaurant is now served �` � by the Corps through a City of Grapevine water connection. � William Infeldt's property is served by the City of Southlake. A number of existing homes, trailers and businesses along Lonesome Dove Road are served by Southlake. There are no plans to provide water service to this area until development occurs. At that time, the developer will have to provide service for the area. This area will be difficult to serve with utilities except through an interlocal agreement with Southlake. STREET SERVIC�: Parcel 1 will require the development of new streets as part of the overall development of this area. Improvements to all streets will need to meet City Standards for street construction. The portion of Parcel 1 owned by the Corps of Engineers has no roads which will be maintained by the City. The City has no plans to improve the existing roadway network at this time. (~it-�.� ; (�� (r � � . . �r�- �3-�.� �.:..� DRAINAGE: � � A significant portion of the entire ETJ in this area is located below the 564 elevation, which is ,�,,,,� the 100-year flood elevation of Lake Grapevine, and an additional area is located below elevation 572, which is the flowage easement elevation reserved by the Corps of Engineers for future flooding of the lake. No construction of habitable structures is allowed below elevation 572. The majority of this entire ETJ is below elevation 572 and cannot be developed for any habitable type endeavor. The area immediately adjacent to Lonesome Dove Road appears to be above elevation 572 and has the potential for residential or commercial development, however a large majority of this property, particularly bordering Lonesome Dove Road, cunently has residences or ir.obile homes franting this roadway.
