HomeMy WebLinkAboutORD 1993-030 LJT U . � � ORDINANCE N0. 93-30 ,� ,� AN ORDINANCE OF THE GTY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS ANNEXING ADJACENT AND CONTIGUOUS TERRITORY TO THE CITY OF GRAPEVINE, TEXAS; FINDING THAT ALL NECESSARY AND REQUIRED LEGAL CONDITIONS HAVE BEEN SATISFIED; PROVIDING THAT SUCH AREAS SHALL BECOME A PART OF THE CITY AND THAT THE OWNERS AND INHABITANTS THEREOF SHALL BE ENTITLED TO THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BE BOUND BY THE ACTS AND ORDINANCES NOW IN EFFECT AND TO BE HEREAFTER ADOPTED; PROVIDING A SEVERABILITY CLAUSE; AND FURTHER PROVIDING FOR AMENDING AND CORRECTING THE OFFICIAL BOUNDARIES OF THE CITY AS HERETOFORE ADOPTED; PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine, Texas ("the City"1, pursuant to the Municipal Annexation Act ("the Act"1, Chapter 43, Local Government Code, has heretofore � ` provided proper notice and conducted public hearings relating to annexation proceedings on the tracts described in Exhibits "A", "B", "C" and "D"; and ��:,,� WHEREAS, in accordance with the Municipal Annexation Act, service plans were prepared by the appropriate department of the City, which plans were made available for inspection and explained to the inhabitants of the areas to be annexed at the public hearings conducted as hereinafter described; and WHEREAS, all required statutory notices pursuant to the Act have been accomplished; and WHEREAS, public hearings were conducted by the Grapevine City Council on June 1, 1993 and June 15, 1993, which public hearings were conducted after notices had been published in a newspaper of general circulation in the City and in the area proposed to be annexed not more than twenty (20) days nor less than ten (10) days prior to each hearing; and WHEREAS, the property to be annexed is contiguous and adjacent to the City limits of the City of Grapevine and not within the boundaries or extra-territorial jurisdiction of another City. � � � � J I � � � . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF � ' GRAPEVINE, TEXAS: �.�;� Section 1 . That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied herein in their entirety. Section 2. The service plans submitted in accordance with the Municipal Annexation Act are hereby approved as part of this ordinance, made a part hereof and attached hereto as Exhibit "A1 ", "B1 ", "C1 " and "D1 ". Section 3. That the property described in Exhibits "A", "B", "C", "D", which exhibits are attached hereto and incorporated herein for all purposes, be and is hereby annexed and brought within the corporate limits of the City of Grapevine, Tarrant County, Texas, and the same is hereby made an integral part hereof. Section 4. That the owners and inhabitants of the areas herein annexed be entitled to all of the rights and privileges of other citizens and property owners of said City and are hereby bound by all acts, ordinances and all other legal action now in full force and effect and all those which may be hereafter adopted. Section 5. If any section, subsection, sentence, phrase or word herein be found to be illegal, invalid unconstitutional or if any portion of said property is � ° incapable of being annexed by the City of Grapevine, Texas for any reason whatsoever, the adjudication shall not affect any other section, sentence, phrase, ���. word, paragraph or provision of this ordinance or the application of any other section, sentence, phrase, word, paragraph or provision to any other person, situation or circumstances, nor shall such adjudication affect any other section, sentence, phrase, word, paragraph, or provision of the Grapevine City Code. The City Council declares that it would have adopted the valid portions and applications of this ordinance and would have annexed the valid property without the invalid part, and to this end the provisions of this ordinance are declared to be severable. Section 6. That the official map and boundaries of the City of Grapevine, Texas heretofore adopted and amended by and are hereby amended so as to include the aforementioned territory as part of the City of Grapevine. Section 7. That this ordinance shall tal<e effect immediately upon second and final reading. Tate Avenue/State Highway 121 and Arlington-Grapevine Road, bounded by the Dallas/Fort Worth International Airport property to the northeast, west of Grapevine-Euless Road, the Pavestone Industry Addition and State Highway 360 to the south into the City of Grapevine. POLICE PROTECTION: The subject site, within Police District 4, is patrolled twenty-four (24) hours a day, seven (7) days a week witl� one (1) officer per shift assigned to the district; and because the site is surrounded by existing City of Grapevine incorporated land, no additional patrols will become necessary. FIRE PROTECTION: Fire protection and emergency medical service will be provided to Site 1 by Station 3 located at 2627 Briarwood until Station 4 is completed at 5051 Hollyberry Trail. The Fire Department presently serves all adjacent property. Because of the City's participation in a fire protection � agreement with Tarrant County, this unincorporated area is already receiving fire protection from the City of Grapevine, no additional fire protection and emergency medical service will � � become necessary. SAIVITARY SEWER SERVICE: Sanitary sewer service to Site 1 has the potential to be served along its northwest perimeter fronting Arlington-Grapevine Road by a 20-inch sanitary sewer line flowing into the Trinity River Authority (TRA) system. This 20-inch line continues southwest down Arlington- Grapevine Road to State Highway 360 and then proceeds southeast along the northeastern perimeter of State Highway 360. The subject site will have close access to this line again in the vicinity of the Pavestone Industry Addition to the south. The last location to serve this site is the 36-inch TRA line which is located on the south side of Big Bear Creek crossing Grapevine- Euless Main. Four homes are currently in existence on this large tract. The homes are not presently served by City sewer. There are no plans to provide sewer service to this area until it is platted and de�eloped. At that time, the developer will have to construct the necessary sewer lines to serve the ar�a. - . . _ - . . � wrw� Site 1 Annexation Service Plan 1 � � It� � I �bf � �x�ieir.��, ro�� ��_.3� � WATER SERVICE: pa9� .—•.•_., Of ,� ., Water service to Site 1 has one (1) potential service point, which is a 20-inch waterline crossing beneath State Highway 360 at the Pavestone Industry Addition to the south. The developer of �� the tract will have to extend that 20-inch waterline to meet the City's Water Master Plan and construct lines adequately sized to serve the entire tract. STREET SERVICE: Street service for Site l, which fronts on Arlington-Grapevine Road and on Grapevine-Euless Road are maintained as unimproved rural street sections. Development of this tract will require improvements to these two streets and interior streets will be constructed by the developer at his cost. The City has no plans to improve the roadway network at this time. We have developed an estimate for a 2-inch asphalt overlay and a 6-inch base improvement for Arlington-Grapevine Road at $28,000.00. DRAINAGE: Drainage to Site 1 encompasses a major tributary to Big Bear Creek, which receives water from Ball Street and William D. Tate Avenue at State Highway 114 area and drains into the Pavestone ��-� Industry Addition, under State Highway 360 and ultimately to Big Bear Creek.
