HomeMy WebLinkAboutORD 1993-041 ��, � . � _ � � j 3}; :., �,,�� ORDINANCE N0. 93-41 ,��„F AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS ABANDONING AND VACATING A TEN FOOT (10') UTILITY EASEMENT DEDICATED IN LOT 44, BLOCK 3, TIMBERLINE SOUTH ADDITION IN EXCHANGE FOR THE DEDICATION OF A NINE AND ONE- HALF FOOT (9.5') UTILITY EASEMENT IN LOT 44, BLOCK 3, TIMBERLINE SOUTH ADDITION IN THE CITY OF GRAPEVINE, TEXAS; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, a ten foot (10') utility easement dedicated in Lot 44, Biock 3, Timberline South Addition, recorded in Volume 388-196, Page 98-99, Plat Records of Tarrant County, more specifically described in Exhibit "A" attached hereto and incorporated herein for all purposes, is not needed for public use and will not be needed in the future for public use; and WHEREAS, the owners of Lot 44, Block 3, Timberline South Addition have �``'z' requested the City of Grapevine to abandon and vacate said ten foot (10') utility easement; and � WHEREAS, the request for abandonment and vacation has been reviewed and approved by the franchised utilities in the City of Grapevine; and WHEREAS, abandoning and vacating this portion of said utility easement will relieve the City of Grapevine, Texas from the cost and expense of maintaining said property; and WHEREAS, in exchange for abandoning and vacating said utility easement, the City wiii re�eive a nine and �ne-haii fooi i3.�'i utility easernent in Lot 44, Block 3, Timberline South Addition, more specifically described in Exhibit "B" attached hereto and incorporated herein for all purposes dedicated by the owners of Lot 44, Block 3, Timberline South Addition to the City of Grapevine. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: � Section 1 . That all the matters stated in the preamble of this ordinance are true ( and correct and are hereby incorporated into the body of this ordinance as if copied in their entirety. :-' � ;� � � s .JJ �. ia �::. Section 2. That a ten foot (10') utility easement dedicated in Lot 44, Block 3, `� � Timberline South Addition recorded in Volume 388-196, Page 98-99, Plat Records of Tarrant County as shown in Exhibit "A" attached hereto and made a part hereof, is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar as all public right, title, and interest in and to said utility easement is concerned in exchange for the dedication of a nine and one-half foot (9.5') utility easement in Lot 44, Block 3, Timberline South Addition, more specifically described in Exhibit "B" attached hereto and made a part hereof. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 4. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage.
