AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS ABANDONING AND VACATING A PORTION OF COUNTY ROAD 3030 AND COUNTY ROAD 3008 RIGHT-OF-WAY AS DESCRIBED IN EXHIBIT "A" AND EXHIBIT "B" SUBJECT TO RETENTION AS A UTILITY EASEMENT; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the owner of the tract bordered by William D. Tate Avenue, Mustang Drive, State Highway 121 and State Highway 114 has requested that a portion of County Road 3030 and County Road 3008 right-of-way as described in Exhibit "A" and Exhibit "B", attached hereto and made a part hereof, be vacated and abandoned; and WHEREAS, the road is not needed by the public for vehicular travel; and WHEREAS, the abandoning and vacating of the roadway has no material affect on travel; and WHEREAS, the City Council deems the public interest is best "�i'� served by such abandonment and vacation; and � WHEREAS, the public right-of-way as described in Exhibit "A" and Exhibit "B" attached hereto and made a part hereof, must be retained and continue to be dedicated to the public as a utility easement for the welfare, use and benefit by the City of Grapevine and the general public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all the matters stated in the preamble of this ordinance are true and r,orrect and are hereby incorporated into the body of this ordinance as if copied in their entirety. Section 2 . That a portion of the County Road 3030 and County Road 3008 right-of-way as described in Exhibit "A" and Exhibit "B" attached hereto and made a part hereof, is hereby abandoned and vacated for public use of the City of Grapevine subject to the retention by, and continued and remaining dedication to the City of Grapevine for the public use as a utility easement. ,�.=�, Section 3 . That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. - .. , i , �: ; _ , � Section 4 . The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to �».:: � properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage. � PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on this the 4th day of August , 1992.
